21 Aug.]\n\nConsenting to the Raising of a Loan of £704 by the Manawatu Catchment Board and Prescribing the Conditions Thereof\n\nFREYBERG, Governor-General\n\nORDER IN COUNCIL\n\nAt the Government House at Wellington, this 6th day of August 1952\n\nPresent:\n\nHis Excellency The Governor-General in Council\n\nWHEREAS the Manawatu Catchment Board (hereinafter called the said local authority) proposes, pursuant to the provisions of section 30 of the Soil Conservation and Rivers Control Act 1941, to raise a loan of seven hundred and four pounds (£704) to be known as “Kiwitea Stream Improvements Loan 1952” (hereinafter called the said loan) for the purpose of carrying out improvements to the Kiwitea Stream:\n\nNow, therefore, pursuant to section 11 of the Local Government Loans Board Act 1926, as set out in section 29 of the Finance Act 1932 (No. 2), His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the raising by the said local authority of the said loan for the said purpose up to the amount of seven hundred and four pounds (£704), and in giving such consent hereby determines as follows :—\n\n1. The term for which the said loan or any part thereof may be raised shall not exceed five (5) years.\n\n2. The rate of interest that may be paid in respect of the said loan or any part thereof shall be such as shall not produce to the lender a rate exceeding three pounds ten shillings (£3 10s.) per centum per annum.\n\n3. The said loan or any part thereof, together with interest thereon, shall be repaid by equal aggregate annual instalments extending over the term as determined in 1 above.\n\n4. No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.\n\nT. J. SHERRARD, Clerk of the Executive Council.\n\n(T. 49/708)\n\nAuthorizing William Albert Turner, of French Pass, Farmer, to Use Water for the Purpose of Generating Electricity\n\nFREYBERG, Governor-General\n\nORDER IN COUNCIL\n\nAt the Government House at Wellington, this 13th day of August 1952\n\nPresent:\n\nHis Excellency The Governor-General in Council\n\nPursuant to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby grants to William Albert Turner, of French Pass, Farmer (hereinafter referred to as the licensee), a licence, subject to the conditions hereinafter set forth, to take and use from an unnamed stream (hereinafter referred to as the said stream) situated in Section 6, Block VI, French Pass Survey District in the Nelson Land District, for the purpose hereinafter set forth, a stream of water not exceeding 0-25 of a cubic foot per second at any one time.\n\n## CONDITIONS\n\n### 1. Implied Conditions\n\nTHE conditions directed to be implied in all licences by the Water-power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated in and shall form part of this licence except in so far as the same may be inconsistent with the provisions hereof.\n\n### 2. Licence Subject to Regulations\n\nThis licence is issued under the Water-power Regulations 1934, and is subject thereto and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, the Radio Interference Regulations 1934, and to all regulations hereafter made in amendment thereof or in substitution therefor respectively.\n\n### 3. Utilization of Water and Location of Headworks\n\nWater shall be used under this licence solely for the purpose of generating electricity, and shall be taken from the said stream at the point in Section 6, Block VI, French Pass Survey District, indicated on the plan marked S.H.D. 209, deposited in the office of the Minister in Charge of the State Hydro-electric Department.\n\n### 4. General Description of Works\n\nThe licensee is hereby authorized, subject to the conditions hereof, to construct, maintain, and use the following works for the purpose of this licence, the positions of the said works being indicated on the said plan S.H.D. 209 :—\n\n(a) Headworks consisting of a dam and intake with a pipe-line leading to the power-house, hereinafter referred to, giving a static head of approximately 200 ft.\n\n(b) A pelton wheel and power-house with all necessary equipment for generating electricity, situated in Section 6, Block VI, French Pass Survey District.\n\n(c) Tail race, leading from the aforesaid power-house to the said stream.\n\n### 5. System of Supply\n\nThe system of supply shall be as described in paragraph (d) of Regulation 21-01 of the Electrical Supply Regulations 1935, and shall be a direct-current system.\n\n6. Duration of Licence\n\nUnless sooner lawfully determined, this licence shall continue in force until the 31st day of March 1973.\n\n### 7. Rental\n\nFor the purpose of assessing the rental or annual sum payable in respect of this licence, the licensee may install a suitable maximum-demand indicator to the satisfaction of the Inspecting Engineer of the State Hydro-electric Department, and, failing such installation, the rental shall be assessed on the maximum generating capacity of the plant installed. The present plant is rated at 2 kilowatts.\n\n8. No Right to Water Conferred\n\nNothing in this licence shall of itself confer upon the licensee any right to water.\n\nT. J. SHERRARD, Clerk of the Executive Council.\n\n(S.H.D. 11/20/1964)\n\nAuthorizing the Laying-off of an Extension of Fairfield Avenue in the City of Lower Hutt, at a Width Less than 66 ft., but Not Less than 40 ft., Subject to a Condition as to the Building-line\n\nH. F. O’LEARY, Administrator of the Government\n\nORDER IN COUNCIL\n\nAt the Government House at Wellington, this 20th day of August 1952\n\nPresent:\n\nHis Excellency The Administrator of the Government in Council\n\nPursuant to section 31 of the Municipal Corporations Amendment Act 1948 and section 125 of the Public Works Act 1928, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby authorizes the Lower Hutt City Council to permit the laying-off of the proposed street described in the Schedule hereto at a width for the whole of its length of less than 66 ft., but not less than 40 ft., subject to the condition that no building or part of a building shall at any time be erected on the land fronting the proposed street within a distance of 48 ft. from the centre-line of the said street.\n\n## SCHEDULE\n\nTHAT proposed street in the Wellington Land District, City of Lower Hutt, being an extension of Fairfield Avenue, containing by admeasurement 29.3 perches, more or less, being part Section 106, Epuni Hamlet. As the same is more particularly delineated on the plan marked P.W.D. 137940, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.\n\nT. J. O’LEARY, Administrator of the Government\n\nORDER IN COUNCIL\n\nAt the Government House at Wellington, this 20th day of August 1952\n\nPresent:\n\nHis Excellency The Administrator of the Government in Council\n\nPursuant to section 31 of the Municipal Corporations Amendment Act 1948, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby authorizes the Lower Hutt City Council to lay off the proposed street first described in the Schedule hereto at a width for part of its length of less than 66 ft., but not less than 40 ft., and the proposed street secondly described in the Schedule hereto at a width for the whole of its length of less than 66 ft., but not less than 40 ft.\n\n## SCHEDULE\n\nTHAT proposed street in the Wellington Land District, City of Lower Hutt, being an extension of Fairfield Avenue, containing by admeasurement 23.28 perches, more or less, being the land marked Road Reserve on D.P. 9890, and being also part Section 33, Hutt District, and being part of the land comprised and described in certificate of title, Volume 409, folio 152 (Wellington Land Registry).\n\nAlso that proposed street in the said land district and city, being an extension of Anderson Grove, containing by admeasurement 0.18 perches, more or less, being the land marked Road Reserve and being Lot 11 on D.P. 12406, and being also part Lot 42, Block VI, D.P. 1377, and part Section 29, Hutt District, and being part of the land comprised and described in certificate of title, Volume 136, folio 210 (Wellington Land Registry).\n\nT.
