The South-western Side of Portion of Warspite Street, in the City of Auckland, Exempted from the Provisions of Section 128 of the Public Works Act 1928

ORDER IN COUNCIL

At the Government House at Wellington, this 16th day of July 1952

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the following resolution passed by the Auckland City Council on the 22nd day of May 1952, viz. :—

“The Auckland City Council, being the local authority having control of the streets in the City of Auckland, by resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to the south-western side of that portion of Warspite Street fronting part Allotment 25, Section 4, City of Auckland, comprised in certificate of title, Volume 831, folio 45 (Auckland Registry),”

such portion of street being described in the Schedule hereto.


SCHEDULE

THE south-western side of all that portion of street situated in the North Auckland Land District, City of Auckland, known as Warspite Street, fronting part Allotment 25, Section 4, City of Auckland. As the same is more particularly delineated on the plan marked P.W.D. 137596, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Fixing the Dates and Places for Payment of Land-tax and Income-tax

ORDER IN COUNCIL

At the Government House at Wellington, this 9th day of July 1952

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers and authority vested in him under the Land and Income Tax Act 1923, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and determines that the respective duties leviable under the said Act by way of land-tax and income-tax shall be paid on the days and dates set forth hereunder :—

Land Tax: For the year of assessment commencing on the 1st day of April 1952: In one sum on Tuesday, the 23rd day of September 1952.

Income Tax: For the year of assessment commencing on the 1st day of April 1952: In one sum on Tuesday, the 3rd day of February 1953.

And, in further pursuance and exercise of the powers and authority aforesaid, and with the like advice and consent as aforesaid, His Excellency also determines that the said duties of land-tax and income-tax shall be payable at any office of the Land and Income Tax Department or at any money-order post-office, and that notice to the foregoing effect shall be given by the Commissioner of Taxes accordingly.

Fixing the Date and Places for Payment of Social Security Charge Payable by Companies

ORDER IN COUNCIL

At the Government House at Wellington, this 9th day of July 1952

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers and authority vested in him under the Social Security Act 1938 and the Social Security Contribution (Companies) Regulations 1943, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and determines that the social security charge payable by any company on its chargeable income for the income year ended on the 31st day of March 1952 shall be paid in one sum on Tuesday, the 3rd day of February 1953.

And, in further pursuance and exercise of the powers and authority as aforesaid, and with the like advice and consent as aforesaid, His Excellency also determines that the said social security charge shall be payable at any office of the Land and Income Tax Department or at any money-order post-office, and that notice to the foregoing effect shall be given by the Commissioner of Taxes accordingly.

PURSUANT to the authority conferred upon me by section 301 of the Justices of the Peace Act 1927, I, Bernard Cyril, Baron Freyberg, the Governor-General of New Zealand, do hereby notify and declare that the persons whose names are set out in the Schedule hereto, being officers in the service of the Crown holding the offices stated opposite their names respectively in the said Schedule, are authorized to take and receive statutory declarations under section 301 of the Justices of the Peace Act 1927.

Appointing a Member of the Bluff Harbour Board

IN pursuance and exercise of the powers and authorities conferred upon me by the Harbours Act 1950, I, Bernard Cyril, Baron Freyberg, the Governor-General of the Dominion of New Zealand, do hereby appoint

William Caldwell

to be a member of the Bluff Harbour Board as a representative of the electors of the combined district of the County of Southland, of the Borough of Winton, and of the town district of Lumsden and Wyndham, in place of William Matthew Norman, deceased, to hold office until the third Saturday of November 1953.

As witness the hand of His Excellency the Governor-General, this 8th day of July 1952.

Appointment of Commissioner of Maori Land Court

PURSUANT to the power and authority conferred upon me by section 7 of the Maori Land Act 1931, I, Bernard Cyril, Baron Freyberg, the Governor-General of New Zealand, do hereby appoint

Bartholomew Sheehan, Esquire,

of Auckland, to be a Commissioner of the Maori Land Court, on and from the 1st day of July 1952.

As witness the hand of His Excellency the Governor-General, this 9th day of June 1952.

Land Reserved in the South Auckland Land District

FREYBERG, Governor-General

WHEREAS by section 167 of the Land Act 1948 it is enacted that the Governor-General may from time to time set apart as a reserve, notwithstanding that the same may be then held under pastoral lease or pastoral occupation licence, any Crown land for any purpose, which, in his opinion is desirable in the public interest, and notice thereof shall be published in the New Zealand Gazette :

Now, therefore, pursuant to section 167 of the said Act, I, Bernard Cyril, Baron Freyberg, the Governor-General of New Zealand, hereby reserve, subject to the reservations and conditions imposed by section 59 of the Land Act 1948, the land in the South Auckland Land District described in the Schedule hereunder written for recreation purposes.

SOUTH AUCKLAND LAND DISTRICT

SECTIONS 1 to 24 (inclusive), Block VI, Town of Moturiki, situated in Block VII, Tauranga Survey District: Area, 6 acres 1 rood 37·25 perches, more or less. (S.O. plan 17128L.)
