Requiring the Hutt County Council Under the Town-planning Act 1926 to Prepare and Submit to the Town-planning Board Extra-urban Planning Schemes in Respect of Areas Comprising the Whole of the County and Revoking Existing Orders in Council

THE HON. K. J. HOLYOAKE PRESIDING IN COUNCIL

WHEREAS the Hutt County Council is the responsible authority within the meaning of the Town-planning Act 1926, of a certain rural area as defined in the said Act—namely, the Hutt County:

And whereas by the Orders in Council referred to in the First Schedule hereto the Hutt County Council was required, pursuant to section 25 of the Town-planning Act 1926, to prepare and submit to the Town-planning Board extra-urban planning schemes in respect of the parts of the County defined in the said Orders in Council:

And whereas by the Order in Council referred to in the Second Schedule hereto the Hutt County Council was required, pursuant to the said section 25 to prepare and submit to the said Board an extra-urban planning scheme in respect of the whole of the said County:

And whereas it is expedient for the more convenient preparation and submission of extra-urban planning schemes for certain defined areas within the said rural area that the Orders in Council referred to in the said First and Second Schedules be revoked and other provision made in substitution therefor:

And whereas His Excellency the Governor-General is of opinion that, for the proper consideration of the town-planning schemes which the adjacent boroughs in the Wellington Metropolitan area are required to prepare under the Town-planning Act 1926, the preparation and submission of separate extra-urban planning schemes is necessary for certain other defined areas within the said rural area—namely, the defined areas described in the Third, Fourth, Fifth, Sixth, Seventh, Eighth, Ninth, Tenth, Eleventh, Twelfth, Thirteenth, and Fourteenth Schedules hereto:

Now, therefore, in pursuance and exercise of the powers conferred upon him by section 25 of the Town-planning Act 1926, and by paragraph (h) of section 25 of the Acts Interpretation Act 1924, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council hereby revokes the Orders in Council referred to in the First and Second Schedules hereto and hereby requires the Hutt County Council to prepare and submit to the Town-planning Board before the 31st day of December 1954, a separate extra-urban planning scheme in respect of each of the defined areas described in the Third, Fourth, Fifth, Sixth, Seventh, Eighth, Ninth, Tenth, Eleventh, Twelfth, Thirteenth, and Fourteenth Schedules hereto.

THIRD SCHEDULE

PARAPARAUMU-RAUMATI DISTRICT

All that area in the County of Hutt bounded as follows: Commencing at a point, being the intersection of the middle of the Waikanae River with the western boundary of the North Island Main Trunk Railway; thence proceeding in a southerly direction generally along that western side to a point in line with the south-western boundary of Muaupoko B; thence south-easterly to and along that south-western boundary and the crossing of the Levin-Paekakariki State Highway to the eastern side of that highway; thence southerly along that eastern side and the eastern side of Ruahine Street in the Town of Paraparaumu to the northern boundary of Lot 4 on the plan numbered 669, deposited in the Land Registry Office at Wellington; thence easterly along that northern boundary and southerly along the eastern boundaries of Lots 4 and 5, on the plan numbered 669 aforesaid to the south-eastern corner of Lot 5 aforesaid; thence southerly along a right line to the most southern corner of the land delineated on the plan numbered S.O. 19637 lodged in the office of the Chief Surveyor at Wellington; thence southerly generally along the western boundary of the land in the plan numbered 11423, deposited in the Land Registry Office in Wellington, to the southern boundary of Lot 1 on the plan numbered 11423 aforesaid; thence westerly along the southern boundary

of Lot 1 aforesaid to the north-eastern boundary of Lot 2 on the plan numbered 3450 deposited as aforesaid; thence north-westerly along the north-eastern boundary of Lot 2 aforesaid and its production to the eastern side of the Levin-Paekakariki State Highway; thence southerly generally along that eastern side to a point in line with the southern side of Poplar Avenue; thence to and along that southern side to the northern boundary of Lot 15 on the plan numbered 5751 deposited as aforesaid; thence westerly and southerly generally along the northern, western, and southern boundaries of Lot 15 aforesaid and Lot 17 on the aforesaid plan 5751 to the northern boundary of Lot 2 on the plan numbered 3093 deposited as aforesaid; thence westerly along that northern boundary and its production to the sea-coast; thence northerly generally along the sea-coast to the middle of the Waikanae River; thence easterly generally along the middle of the Waikanae River to the point of commencement.

FOURTH SCHEDULE

PAEKAKARIKI DISTRICT

All that area in the County of Hutt, being the Paekakariki Riding, more particularly described in the New Zealand Gazette 1950, at pages 730 and 731.

FIFTH SCHEDULE

PUKERUA DISTRICT

All that area in the County of Hutt, bounded as follows: Commencing at a point on the sea-coast north-west of the northernmost corner of Pukerua 3c IA, situated in Block VI, Paekakariki Survey District; thence by a right line to that corner being a point on the eastern side of the North Island Main Trunk Railway; thence proceeding south-westerly generally along that eastern side to the block boundary between Blocks V and VI, Paekakariki Survey District; thence southerly along that block boundary to the southern boundary of Pukerua 3c 2A 1; thence westerly along that boundary to the eastern side of the Wellington-Paekakariki Centennial State Highway; thence southerly generally along that side to the southern boundary of Haukopua East; thence westerly across the Wellington-Paekakariki Centennial State Highway to and along the southern boundary of Haukopua East, across the North Island Main Trunk Railway; again along the southern boundary of Haukopua East to the southern boundary of Haukopua West; thence westerly along that southern boundary to and across the Pukerua Road and again along the southern boundary of Haukopua West to the sea-coast; thence northerly generally along the sea-coast to the point of commencement.

SIXTH SCHEDULE

PLIMMERTON-PAREMATA DISTRICT

All that area in the County of Hutt bounded as follows: Commencing at a point on the sea-coast. being the south-western corner of Haukopua West, situated in Block V, Paekakariki Survey District: thence proceeding in an easterly direction along the southern boundary of Haukopua West to and across the Pukerua Road and again by the southern boundary of Haukopua West to the southern boundary of Haukopua East; thence easterly generally along the southern boundary of Haukopua East to and across the North Island Main Trunk Railway, again along the southern boundary of Haukopua East to and across the Wellington-Paekakariki Centennial State Highway to the eastern boundary of the Taupo Riding. County of Hutt, as described in New Zealand Gazette 1950, page 731; thence southerly, westerly, and northerly along that riding boundary to the point of commencement.

Also all that area in the County of Hutt bounded as follows: Commencing at a point on the southern shore of Porirua Harbour in line with the eastern boundary of Section 94, Porirua District; thence to and along that boundary to the southern boundary of that section; thence westerly along the southern boundaries of Sections 94, 95, 96, and 97, Porirua District, and the northern boundary of Section 99, Block VIII, Paekakariki Survey District, and the production of the last-mentioned boundary to the shore of the Porirua Harbour; thence northerly and easterly generally along the shore of the Porirua Harbour to the point of commencement.

SEVENTH SCHEDULE

STOKES VALLEY DISTRICT

All that area in the County of Hutt bounded as follows: Commencing at a point, being the intersection of the northern boundary of the City of Lower Hutt as described in New Zealand Gazette 1945, pages 388 and 389, with the eastern boundary of the Hutt River; thence proceeding in a northerly direction along that eastern bank to the north-eastern boundary of Section 195, Hutt District; thence south-easterly along that north-eastern boundary to and across a public road; again along that north-eastern boundary to the most eastern corner of Section 195 aforesaid; thence south-westerly, south-easterly, and north-easterly along the north-western, south-western, and south-eastern boundaries of Section 205, Hutt District, to the north-eastern boundary of Section 248, Hutt District; thence south-easterly along that north-eastern boundary to the northern boundary of Section 235, Hutt District; thence easterly along that northern boundary to and across a public road; again along that northern boundary to and across a public road and again by that northern boundary to the most eastern corner of Section 235 aforesaid; thence southerly along the eastern boundary of Section 235 and 236, Hutt District, to the northern boundary of the land on the plan numbered 2937 deposited in the Land Registry Office at Wellington; thence westerly along that northern boundary, to and across a public road, again along that northern boundary and
