PURSUANT to section 207 of the Public Works Act, 1928, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby proclaim and declare that the course of the Tuamarina Stream shall be altered or diverted within the area of land described in the Schedule hereto.

Authorizing the Taumarunui Borough Council to Erect and Use Certain Electric Lines in the Counties of Taumarunui and Kaitieke, and Amending and Revoking Certain Existing Licences

ORDER IN COUNCIL

At the Government House at Wellington, this 11th day of July, 1951

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby grant to the Taumarunui Borough Council (hereinafter referred to as the licensee), a licence subject to the terms and conditions hereinafter set forth, to lay, construct, put up, place, and use the electric lines described in the First Schedule hereto; and further with the consent of the licensee doth hereby amend as set forth in the Second Schedule hereto the Orders in Council referred to therein, and doth hereby revoke the Orders in Council referred to in the Third Schedule hereto.

CONDITIONS

  1. IMPLIED CONDITIONS

THE conditions directed to be implied in all licences by the Electrical Supply Regulations 1935 (except clause 27–14 thereof), and by the Electrical Wiring Regulations 1935, shall be incorporated in and shall form part of this licence except in so far as the same may be inconsistent with the provisions hereof.

  1. LICENCE SUBJECT TO REGULATIONS

The licence hereby conferred is subject to compliance by the licensee with the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, the Radio Interference Regulations 1934, and with any regulations hereafter made in amendment thereof or in substitution therefor respectively.

  1. DURATION OF LICENCE

This licence shall, unless sooner lawfully determined, continue in force until the 21st day of February, 1963.

  1. SYSTEM OF SUPPLY

The system of supply shall be as described in paragraphs (a) and (f) of clause 21–01 of the Electrical Supply Regulations 1935. The primary distribution voltages shall be 6,600 volts and 3,300 volts between phases.

FIRST SCHEDULE

ELECTRIC LINES AUTHORIZED

  1. LINES for the supply of electrical energy by the systems of supply hereinbefore described within that part of the County of Taumarunui in Block II, Piopiotea West Survey District, bounded by a line commencing at the intersection of the south-eastern boundary of Section 4, with the south-western boundary of Section N 2ε 3G 2r, and proceeding thence south-westerly then westerly along the southern boundary of Section 4 to the eastern boundary of Section 2; thence westerly by a right line across Section 2, and across the Kururau Road to the intersection of the eastern boundary of Section 38 with the Kururau Road; thence across the Kururau Road, and generally westerly, northerly, and easterly along the boundary of Section 35 and the north-eastern boundaries of Sections 1 and 36 to Kawae Road; thence along the north-eastern side of Kawae Road to the Kururau Road; thence across the Kururau Road and generally south-easterly along the north-eastern boundary of Section 4 to the point of commencement; the said area being more particularly delineated on the plan marked S.H.D. 136, deposited in the office of the Minister in Charge of the State Hydro-electric Department, and thereon outlined in green; the electric lines at present proposed to be erected and used being indicated by means of yellow lines and green lines on the aforesaid plan S.H.D. 136.

  2. Lines leading from the licensee’s Duncan Substation to supply one consumer in Section 34, Block III, Hunua Survey District, in the County of Kaitieke, and one consumer in Section D 5B 11B, Ohura South, Block III, Piopiotea Survey District, in the County of Taumarunui, such electric lines being shown by means of green lines on the plan marked S.H.D. 136, deposited as aforesaid.

  3. Lines leading from the licensee’s generating station at Piriaka to supply one consumer in Section D 5 D 2 Ohura South, Block III, Piopiotea Survey District in the County of Taumarunui, such electric lines being shown by means of green lines on the plan marked S.H.D. 136, deposited as aforesaid.
