Declaring Lands in South Auckland, Otago, and Southland Land Districts, Vested in the Auckland, Otago, and Southland Education Boards as Sites for Public Schools, to be Vested in His Majesty the King

A PROCLAMATION

WHEREAS by subsection (6) of section 5 of the Education Lands Act, 1949 (hereinafter referred to as the said Act), it is provided that notwithstanding anything contained in any other Act, the Governor-General may from time to time, by Proclamation, declare that any school-site or part of a school-site which in his opinion is no longer required for that purpose shall be vested in His Majesty; and thereupon the school-site, or part thereof, as the case may be, shall vest in His Majesty freed and discharged from every educational trust affecting the same, but subject to all leases, encumbrances, liens, or easements affecting the same at the date of the Proclamation.

Now, therefore, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred by subsection (6) of section 5 of the said Act, do hereby proclaim and declare that the land described in the First Schedule hereto, being an area vested in the Auckland Education Board, the lands described in the Second Schedule hereto, being areas vested in the Otago Education Board, and the land described in the Third Schedule hereto, being an area vested in the Southland Education Board, as sites for public schools, shall be vested in His Majesty the King, freed and discharged from every educational trust affecting the same, but subject to all leases, encumbrances, liens, or easements affecting the same at the date hereof.

FIRST SCHEDULE

SOUTH AUCKLAND LAND DISTRICT

ALL that area, situated in Block X, Whakatane Survey District, containing by admeasurement 1 acre 3 roods 23·4 perches, more or less, being part Allotment 314A, Waimana Parish. As the same is more particularly delineated on the plan marked L. and S. 6/6/974, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. (South Auckland S.O. plans 12674 and 15297².)

SECOND SCHEDULE

OTAGO LAND DISTRICT

SECTION 13A, Airedale Settlement, situated in Block I, Papakaio Survey District : Area, 1 acre 2 roods, more or less. (S.O. plan 8972.)

All that area containing by admeasurement 2 acres, more or less, being part Section 5, Block I, Catlins Survey District, and being all the land comprised and described in Certificate of Title, Volume 231, folio 3, limited as to parcels and title (Otago Registry). As the same is more particularly delineated on the plan marked L. and S. 6/6/834, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. THIRD SCHEDULE

SOUTHLAND LAND DISTRICT

ALL that area containing by admeasurement 10 acres, more or less, being part Section 282, Block LXXI, Hokonui Survey District, and being all the land comprised and described in Certificate of Title, Volume 44, folio 241 (Southland Registry). As the same is more particularly delineated on the plan marked L. and S. 6/6/985, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.

(North Auckland S.O. plan 824A 1.)

SOUTH AUCKLAND LAND DISTRICT

Section 10, Block X, Coromandel Survey District : Area, 15 acres and 20 perches, more or less. (South Auckland S.O. plan 2249A.)

All that area containing by admeasurement 2 acres, more or less, being part Section 2, Block II, Otanake Survey District. SECOND SCHEDULE

TARANAKI LAND DISTRICT

ALL that area containing by admeasurement a total of 2 acres 2 roods 18·16 perches, more or less, being Lot 1, as shown on a plan deposited in the Land Registry Office at New Plymouth under No. 6423 ; and all the land as shown on a plan deposited as aforesaid under No. 1993 ; both being parts Section 18, Block XIV, Cape Survey District, and being all the land comprised and described in Certificate of Title, Volume 158, folio 201 (Taranaki Registry).

Allocating Land Taken for a Railway to the Purpose of a Road at Tuatapere

A PROCLAMATION

WHEREAS the land described in the Schedule hereto forms part of land taken for the purposes of the Orepuki-Waiau Railway, and it is considered desirable to allocate such land to the purposes of a road :

Now, therefore, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities vested in me by section 226 of the Public Works Act, 1928, and of every other power and authority in anywise enabling me in this behalf, do hereby proclaim and declare that the land described in the Schedule hereto shall, upon the publication hereof in the New Zealand Gazette, become a road, and that the said road shall be under the control of the Wallace County Council, and shall be maintained by the said council in like manner as other public highways are controlled and maintained by the said council.

SCHEDULE

APPROXIMATE area of the piece of land : 4·5 perches.

Being part Railway land in New Zealand Gazette 1902, page 734, being part Section 6, Block XIII, Waiau Survey District.

Situated in Wallace County. (S.O. 5765.)

In the Southland Land District ; as the same is more particularly delineated on the plan marked L.O. 10908, deposited in the office of the Minister of Railways at Wellington, and thereon coloured orange.

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 12th day of June, 1951.
