IN pursuance and exercise of the powers conferred by section 44 of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council and with the consent of the licensee named therein, doth hereby revoke the Order in Council dated the 7th day of February, 1936, and published in the New Zealand Gazette on the 13th day of the same month at page 269, authorizing Herbert Stanley Chadwick, of Raetihi, to use water for the purpose of generating electricity.

PURSUANT to the Harbours Act, 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby license and permit the Hauraki Plains County Council (hereinafter called the Council, which term shall include its successors and assigns, unless the context requires a different construction) to use and occupy parts of the foreshore and land below low water-mark at Waitakaruru, on the Waitakaruru River, and at Pipiroa, Kopurahi, Hopai, Horahia, Ngatea, Puhanga, Kerepeehi (but excluding the Depot Wharf), Kaihere, Mangawhero, and Patetonga, on the Piako River, as shown on plan marked M.D. 7535 and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining wharves thereon as shown on the said plan, such licence to be held and enjoyed by the Council upon and subject to the terms and conditions set forth in the First Schedule hereto and doth prescribe that the dues and rates set forth in the Second Schedule hereto shall be charged and taken by the Council for the use of the said wharves.

FIRST SCHEDULE
CONDITIONS

  1. This licence is subject to the Foreshore Licence Regulations 1940 and the provisions of those regulations shall, as far as applicable, apply hereto.
  2. The annual sum payable by the Council to the Minister shall be one shilling (1s.), payable on demand.
  3. The term of the licence shall be fourteen years from the third day of February, 1951.
  4. The master of every vessel discharging ballast at the said wharves shall have all such ballast taken away and deposited above high-water mark, or at such place as may be approved by the Minister or by any person appointed by the Minister for that purpose.
