Authorizing the Auckland Transport Board to Erect and Use Certain Electric Lines in the City of Auckland (Herne Bay Route)

At the Government Buildings at Wellington, this 8th day of May, 1951

Present:

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby authorize the Auckland Transport Board (hereinafter with its successors and assigns referred to as the licensee), subject to the conditions hereinafter set forth, to lay, construct, put up, place, and use the electric lines described in the Schedule hereto.

CONDITIONS

  1. PURPOSE OF LINES

THE electric lines hereby authorized shall be used only for the purpose of supplying electricity to the licensee’s trackless trolley-omnibuses.

  1. IMPLIED CONDITIONS

The conditions directed to be implied in all licences by the Electrical Supply Regulations 1935 and the Electrical Wiring Regulations 1935 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.

  1. LICENCE SUBJECT TO REGULATIONS

In respect of the lines hereby authorized the licensee shall comply with the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, the Radio Interference Regulations 1934, and with any regulations hereafter made in amendment thereof or in substitution therefor respectively.

  1. SYSTEM OF SUPPLY

The system of supply shall be classified under paragraph (j) of clause 21–01 of the Electrical Supply Regulations 1935 and shall be a two-wire direct-current system at a pressure nominally rated at 550 volts, for supply to the licensee’s trackless trolley-omnibus system.

  1. DURATION OF LICENCE

This licence shall, unless sooner lawfully determined, continue in force until the 31st day of March, 1972.

  1. ALTERATIONS TO AUCKLAND ELECTRIC-POWER BOARD’S LINES OR WORKS

Where the construction, existence, or use of the lines hereby authorized necessitates any alteration to the Auckland Electric-power Board’s existing lines or works and/or the erection of any new or additional lines or works on the opposite side of any street to that on which the Board’s existing lines or works are situated the cost of any such alteration and/or additional cost involved in erecting any such new or additional lines or works shall be borne by the licensee.

SCHEDULE

LINES for the transmission of electrical energy by the system of supply hereinbefore described along certain routes in the City of Auckland, described as follows:—

(a) Lines for one-way traffic commencing at the intersection of Hobson Street and Victoria Street West and proceeding easterly along Victoria Street West to Queen Street; thence northerly along Queen Street to Wyndham Street; thence westerly along Wyndham Street to Hobson Street.

(b) Lines for one-way traffic commencing at the intersection of Victoria Street West and Albert Street and proceeding northerly along Albert Street until it connects with Fanshawe Street; thence westerly along Fanshawe Street to Hobson Street; thence southerly along Hobson Street to its intersection with Victoria Street West.

(c) Lines for two-way traffic commencing at the intersection of Hobson Street and Victoria Street West and proceeding westerly along Victoria Street West, College Hill, and Jervois Road to a turning circle in Jervois Road at its intersection with Herne Bay Road.

(d) Lines for two-way traffic commencing at the intersection of Victoria Street West and Halsey Street and proceeding northerly along Halsey Street to its intersection with Fanshawe Street.

The aforesaid lines being more particularly delineated by means of green lines on the plan marked S.H.D. 148, deposited in the office of the Minister in Charge of the State Hydro-electric Department.

  1. FIRE PRECAUTIONS IN PARKING-AREA

The use of the lines over the parking-area between Gaunt Street and Packenham Street in the licensee’s depot shall be subject to the following conditions:—

(i) The licensee shall erect a gas-tight fence to a design and standard approved by the Chief Inspector of Explosives being not less than 8 ft. in height and extending from Packenham Street to Gaunt Street along or near the boundary between the parking-area in the licensee’s depot and the adjoining property of Caltex (N.Z.), Ltd., bounded by the licensee’s depot and Packenham Street, Daldy Street, and Gaunt Street, and shall during the currency of this licence, or for so long as the property of Caltex (N.Z.), Ltd., is used for the storage of petroleum products, maintain the said fence in a gas-tight condition to the satisfaction of the Chief Inspector of Explosives.

(ii) If at any time to the knowledge of the licensee the said fence ceases to be gas-tight, the licensee shall immediately inform the Chief Inspector of Explosives, and the lines shall be made dead.

(iii) The lines, after having been made dead as aforesaid, shall not be livened up again until the said fence has been made gas-tight to the satisfaction of the Chief Inspector of Explosives and he has authorized the livening up of the lines.

(iv) The Chief Inspector of Explosives shall at all times be the sole judge of whether the said fence is gas-tight or not and whether the lines, having been made dead as aforesaid, may be livened up again or not, and his decision shall be final.

  1. ALTERATIONS TO AUCKLAND ELECTRIC-POWER BOARD’S LINES OR WORKS
