Cancelling the Vesting of Portion of a Reserve in the Picton Borough Council

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 14th day of February, 1951

Present:

THE HON. K. J. HOLYOAKE PRESIDING IN COUNCIL

WHEREAS the land described in the Schedule hereto forms portion of a reserve for public utility purposes and is vested, in trust, in the Picton Borough Council:

And whereas it is expedient that the vesting of the said land as hereinbefore referred to should be cancelled, and the Picton Borough Council has duly consented to such cancellation:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred upon him by subsection (1) of section 10 of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby cancel the vesting in the Picton Borough Council of the land described in the Schedule hereto.

MARLBOROUGH LAND DISTRICT

ALL that area containing by admeasurement 2 roods, more or less, being Sections 1016 and 1017, Town of Picton, and being part of the land comprised and described in Certificate of Title, Volume 41, folio 110 (Marlborough Registry). As the same is more particularly delineated on the plan marked L. and S. 6/1/315E, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.

WHEREAS the land described in the Schedule hereto is a reserve for an Agricultural and Pastoral Society’s showground, and is vested, in trust, in the Central Otago Agricultural and Pastoral Association:

And whereas it is expedient that the vesting of the said land as hereinbefore referred to should be cancelled, and the Central Otago Agricultural and Pastoral Association has duly consented to such cancellation:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred upon him by subsection (1) of section 10 of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby cancel the vesting in the Central Otago Agricultural and Pastoral Association of the land described in the Schedule hereto.

IN pursuance and exercise of the powers and authorities conferred upon him by subsection (1) (b) of section 7 of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the reservation for public utility purposes over the land described in the Schedule hereto; and doth hereby declare that the said land, being vested in the Crown, is Crown land available for disposal under the Land Act, 1948.
