ALL that area in the Otago Land District, being part of the Kaikorai
Riding of the County of Taieri, containing two roods and thirty-
four perches, more or less, being part of Torquay Road and being
part Section 38, Block VI, Dunedin and East Taieri Survey District,
and bounded as follows: Commencing at the north-eastern corner of
Lot 31 on Deeds Plan 139; thence north-easterly along the produc-
tion of the northern boundary of that lot to a point on the western
boundary of Lot 42, Block II, Deeds Plan 140; thence south-
easterly along the western boundaries of Lots 42, 43, 44, and 45,
Block II, Deeds Plan 140, to the south-western corner of the said
Lot 45; thence westerly along the production of the southern
boundary of the said Lot 45 to a point on the eastern boundary of
Lot 8 on Deposited Plan 6635; thence north-westerly along the
eastern boundaries of Lots 8, 6, 4, and 2, on Deposited Plan 6635,
across Totnes Street and along the eastern boundaries of Lots 25,
26, 27, 28, 29, 30, and 31 on Deeds Plan 139 to the point of commence-
ment, all the above-mentioned lots being parts of Section 38,
Block VI, Dunedin and East Taieri Survey District.

PURSUANT to the Public Works Act, 1928, His Excellency
the Governor-General of the Dominion of New Zealand,
acting by and with the advice and consent of the Executive
Council, doth hereby consent to the land described in the First and Second
Schedules hereto being taken for a pleasure-ground.

FIRST SCHEDULE

APPROXIMATE area of the piece of land permitted to be taken:
2 acres 1 rood 33 perches.

Being part northern portion Allotment 11 of Section 7 of Small
Lots near the Village of Howick.

Situated in Block IV, Otahuhu Survey District (Auckland
R.D.). (S.O. 35425.)

In the North Auckland Land District; as the same is more
particularly delineated on the plan marked P.W.D. 133416,
deposited in the office of the Minister of Works at Wellington,
and thereon coloured yellow.

SECOND SCHEDULE

APPROXIMATE area of the piece of land permitted to be taken:
1 rood 22·6 perches.

Being Allotment 8, Section 3, Town of Howick, being more par-
ticularly shown on D.P. 8151, situated in the Howick Town
District, and being the whole of the land comprised and
described in Certificate of Title, Volume 858, folio 183 (Auckland
Land Registry).

PURSUANT to the Municipal Corporations Act, 1933, as amended
by section 15 of the Municipal Corporations Amendment Act,
1938, His Excellency the Governor-General of the Dominion of New
Zealand, acting by and with the advice and consent of the Executive
Council, doth hereby consent to the closing of the portion of
Katarina Street, in the Borough of Taumarunui, described in the
Schedule hereto.

APPROXIMATE area of the portion of street affected: 11·84 perches.

of Hastings, Subject to a Condition as to the Building-line

At the Government Buildings at Wellington, this 20th day of
February, 1951

Present:

THE HON. K. J. HOLYOAKE PRESIDING IN COUNCIL

PURSUANT to section 31 of the Municipal Corporations Amend-
ment Act, 1948, and section 125 of the Public Works Act,
1928, His Excellency the Governor-General of the Dominion of New
Zealand, acting by and with the advice and consent of the Executive
Council, doth hereby authorize the Hastings Borough Council to
permit the laying-off of the proposed street described in the Schedule
hereto at a width for part of its length of less than 66 feet, but not
less than 50 feet, subject to the condition that no building or part
of a building shall at any time be erected on the land adjoining the
said street within a distance of 48 feet from the centre-line of the
said street.

SCHEDULE

THAT proposed street in the Hawke’s Bay Land District, Borough
of Hastings, containing by admeasurement 3 roods 16·5 perches,
more or less, being part Lots 5 and 7, D.P. 6813, being part Here-
taunga Block.

As the same is more particularly delineated on the plan marked
P.W.D. 133179, deposited in the office of the Minister of Works
at Wellington, and thereon coloured red.

The Northern Side of Portion of Southwark Street, in the City of
Christchurch, Exempted from the Provisions of Section 128 of
the Public Works Act, 1928

At the Government Buildings at Wellington, this 20th day of
February, 1951

Present:

THE HON. K. J. HOLYOAKE PRESIDING IN COUNCIL

PURSUANT to section 128 of the Public Works Act, 1928, His
Excellency the Governor-General of the Dominion of New
Zealand, acting by and with the advice and consent of the Executive
Council, doth hereby approve of the following resolution passed by
the Christchurch City Council on the 24th day of October, 1950, in
so far as it affects the side and portion of street described in the
Schedule hereto, viz.:

“The Christchurch City Council, being the local authority
having control of the streets in the City of Christchurch, by
resolution declares that the provisions of Section 128 of the
Public Works Act, 1928, shall not apply to the northern side
of the portion of Southwark Street adjoining Town Reserve 7,
and being all of the land in Certificate of Title, Volume 184,
folio 28 (Canterbury Registry).”
