Amending the Constitution of the Kaingaroa Rural Fire District

Present:

Pursuant to the Forest and Rural Fires Act, 1947, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby make the following Order:

The Order in Council dated the 30th day of June, 1948, and published in the New Zealand Gazette on the 1st July, 1948, at page 815 (hereinafter referred to as the said Order in Council), is hereby amended by omitting the Schedule to that Order in Council and substituting the Schedule set out in the Schedule to this Order in Council.

"SCHEDULE
"SOUTH AUCKLAND LAND DISTRICT.—ROTORUA CONSERVANCY.— KAINGAROA RURAL FIRE DISTRICT
"All that area in the South Auckland Land District, Taupo, Rotorua, and Whakatane Counties, containing approximately 572,000 acres, situated in Tarawera, Ruawahia, Rangitaiki Lower, Paeroa, Kaingaroa, Galatea, Takapau, Wheao, Ahikereru, Tauhara, Otukotara, Heruiwi, Waitahanui, Maruanui, and Runanga Survey Districts, and bounded generally as follows: Commencing at a point on the left bank of the Rangitaiki River, being the junction of that river with the Pokairoa Stream; thence proceeding generally southward along the left banks of the Rangitaiki and Whirinaki Rivers to a point on the left bank of the last-named river, situated 40 chains eastward of the right bank of the Rangitaiki River; thence generally southward along a line parallel to and situated 40 chains to the eastward of the right banks of the Rangitaiki and Wheao Rivers to the Mangaretu Stream; thence southward along the said stream and the eastern boundaries of Heruiwi No. 4A Nos. 2 and 1 to Trig. Station Tiri Tiri; thence along the south-eastern boundary of Heruiwi No. 4A No. 1; thence southward and westward along the eastern and southern boundaries of Pukahunui No. 2 to an angle in the boundary about 80 chains north-west of a road; thence westward along a straight line for a distance of about 90 chains to Trig. Station No. 52 (Kokomoka), in Block XIII, Heruiwi Survey District; thence in a south-westerly direction along a straight line to Trig. Station No. 50 (Omeruiti), in Block VII, Maruanui Survey District; thence in a westerly direction along a straight line to Trig. Station 48A in Block VI, Maruanui Survey District; thence along a straight line to Trig. Station Wairangi in Block VII, Waitahanui Survey District; thence in a north-westerly direction along a straight line between Trig. Station Wairangi, aforesaid, and Trig. Station No. 45 in Block XIII, Tauhara Survey District, to and across the National Park—Taupo State Highway; thence northerly along the western side of the National Park—Taupo State Highway to a point opposite its junction with the old Taupo Road; thence eastwards across the aforesaid main highway and along the southern boundary of the Taupo Town District to the centre of the Taupo-Napier State Highway; thence south-easterly along the centre of the said road to the ten-mile peg; thence north-easterly along a straight line to a point on the south-western boundary of Kaingaroa No. 2 West No. 2 Block, 40 chains north-west from the north-western boundary of Run 60 (permanent State forest New Zealand Gazette, 1930, page 2639); thence along lines drawn parallel to and 40 chains distant from the north-western boundaries of Run 60 to Lot 1 of Kaingaroa No. 2 West No. 1 Block; thence along the south-western boundary of the said Lot 1 to the Waikato River; thence generally in a north-easterly direction along the right bank of the Waikato River to its junction with the Waiotapu Stream, and by the left bank of that stream to the southern boundary of Reporoa Settlement; thence in an easterly direction by the boundary of the Reporoa Settlement to the western side of the Reporoa Road; thence in a northerly direction generally by the western side of the road to the north-eastern corner of Section 34s, Reporoa Settlement; thence by the crossing of Loop Road to the Waiotapu Stream, and by that stream to the south-western boundary of Rotomahana-Parekarangi No. 34 No. 2B No. 2 Block, and by the last-mentioned boundary to and across the Taupo-Rotorua State Highway; thence in a north-westerly direction along a straight line to Trig. Station No. 30 (Maungaongaonga); thence in a north-easterly direction to the intersection of the north-eastern boundary of Rotomahana-Parekarangi No. 6A Section 2 No. 1B with the northern boundary of Block III, Paeroa Survey District; thence due eastward to a reserve surrounding Lake Rerewhakaitu; thence by the southern boundary of that reserve to the south-western boundary of Section 1, Block XIV, Ruawahia Survey District; thence in a south-easterly and north-easterly direction along the south-western and south-eastern boundaries of Section 1, aforesaid, and the south-eastern boundary of Rerewhakaitu No. 1A 2 Block; thence generally in an easterly direction along the southern boundaries of Pokohu C No. 1 Block and Matahina A No. 1B Block, and by the Pokairoa Stream to the left bank of the Rangitaiki River, the point of commencement. As the same is more particularly delineated on plan No. 47/59, deposited in the Head Office of the New Zealand Forest Service at Wellington, and thereon bordered red."

Boundaries of Borough of Masterton and County of Masterton Altered

Whereas in pursuance of section 136 of the Municipal Corporations Act, 1933, a petition was presented to the Governor-General praying that a certain area of land be excluded from the County of Masterton and included in the Borough of Masterton: And whereas, in pursuance of section 24 of the Local Government Commission Act, 1946, the said petition was referred to the Local Government Commission: And whereas, in pursuance of the provisions of the Local Government Commission Act, 1946, the Local Government Commission has approved as final a scheme bearing date the 22nd day of September, 1950, providing for the exclusion of the areas described in the First and Second Schedules to the said scheme from the County of Masterton and the inclusion of such areas in the Borough of Masterton, and providing also for the exclusion of the area described in the Third Schedule to the said scheme from the Borough of Masterton and the inclusion of such area in the County of Masterton:

And whereas it is deemed expedient to give effect to the final scheme as hereinafter appearing:
Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the Local Government Commission Act, 1946, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that as on and from the 18th day of October, 1950, the areas described in the First Schedule hereto shall be excluded from the County of Masterton and included in the Borough of Masterton, and that the area described in the Second Schedule hereto shall be excluded from the Borough of Masterton and included in the County of Masterton, and, with the like advice and consent, doth hereby also declare that the alteration of boundaries of the said borough and the said county hereinbefore made shall be deemed to have been effected under the Municipal Corporations Act, 1933.

FIRST SCHEDULE
AREAS EXCLUDED FROM THE COUNTY OF MASTERTON AND INCLUDED IN THE BOROUGH OF MASTERTON
All that area in the Te Whiti Riding of the County of Masterton, situated in Block I, Otahoua Survey District, containing 62 acres and 35 perches, more or less, bounded as follows: Commencing at a point on the northern side of Te Ore Ore Road and eastern boundary of the Borough of Masterton, as described in the New Zealand Gazette No. 75 of 18th September, 1941, at page 2808, in line with the north-western side of Columba Road; thence proceeding southerly generally to and along that side to the southernmost corner of Lot 2 on the plan numbered 12232, deposited in the Land Registry Office at Wellington, being also a point on the boundary of the Borough of Masterton, described as aforesaid; thence westerly, northerly, and easterly generally along that boundary to the point of commencement.
Also all that area in the Te Whiti Riding of the County of Masterton, situated in Block IV, Tiffin Survey District, containing 6 acres 2 roods, more or less, bounded as follows: Commencing at a point on the southern boundary of the Borough of Masterton, as described in the New Zealand Gazette No. 75 of 18th September, 1941, at page 2808; being also the northernmost corner of Section 29, Manaia Block; thence proceeding south-easterly along the north-eastern boundary of Section 29 to and across Columba Road; thence again along that north-eastern boundary to a point distant 255 links from the south-eastern side of Columba Road; thence south-westerly by a right line parallel with and distant 250 links from the south-eastern side of Columba Road to the south-western boundary of Lot 5 on the plan numbered 4527, deposited in the Land Registry Office at Wellington; thence north-westerly along that south-western boundary to its intersection with the north-eastern side of Millard Avenue; thence south-easterly along that side to a point in line with the south-eastern boundary of Lot 3, on the aforesaid plan numbered 4527; then south-westerly to and along that boundary, and north-westerly along the south-western boundary of the aforesaid Lot 3 to the south-eastern boundary of Lot 2 on plan numbered 4527, aforesaid; thence south-westerly along that boundary to the southernmost corner of Lot 2 aforesaid, being also a point on the boundary of the Borough of Masterton described as aforesaid; thence north-easterly along that boundary to the point of commencement.
Also all that area in the Te Whiti Riding of the County of Masterton, situated in Block IV, Tiffin Survey District, containing 21 acres 1 rood 20 perches, more or less, bounded as follows: Commencing at a point on the north-eastern boundary of Section 3, Manaia Block, distant 250 links from the south-eastern side of South Road, being also a point on the southern boundary of the Borough of Masterton as described in the New Zealand Gazette No. 75 of 18th September, 1941, at page 2808; thence proceeding south-westerly by a right line parallel with and distant 250 links from the south-eastern side of South Road to the north-eastern side of Millard Avenue; thence south-easterly along that side to a point in line with the south-eastern boundary of the land on Deeds Plan numbered 276, lodged in the Deeds Registry Office at Wellington; thence south-westerly to and along that boundary,
