FIFTH SCHEDULE

HASTINGS RIDING, COUNTY OF THAMES

ALL that area in the County of Thames, bounded by a line com-
mencing at a point being the intersection of the western boundary
of Block VIII, Whitianga Survey District, with the northern
boundary of the Thames County as hereinbefore described and
running southerly generally along the western boundary of the
aforesaid Block VIII, to and along the western boundary of Block
XII, Whitianga Survey District, to a point in the middle of the
Hikuwai River; thence up the middle of the said river, to and
along the main dividing range to the northern boundary of Block
I, Tairua Survey District; thence westerly generally along the
aforesaid northern boundary to and along the northern boundary
of Block III, Thames Survey District, along the northern and
western boundaries of Block II, Thames Survey District, along
the northern boundary of Block IV, Thames Survey District, to
and down the middle of the Tararu Stream to the north-eastern
boundary of the Borough of Thames; thence northerly and east-
erly generally along the north-eastern boundary of the aforesaid
Thames Borough, as described in New Zealand Statistics, 1918,
page 264, and New Zealand Gazette No. 94 of the 31st day of July,
1919, page 2479, and along the shores of the Firth of Thames, to
and along the southern boundary of the Coromandel County as
hereinbefore described to the point of commencement.

TAIRUA RIDING, COUNTY OF THAMES

All that area in the Thames County, bounded by a line com-
mencing at a point of intersection of the western boundary of
Block VIII, Whitianga Survey District, with the southern boundary
of the Coromandel County and running easterly generally along
the southern boundary of the aforesaid county, as hereinbefore
described, to the middle of the entrance of Tairua Harbour; thence
southerly and westerly generally along the shores of the Pacific
Ocean and the southern boundary of the Thames County, as here-
inbefore described, to the source of the Waipaheke Stream ; thence
northerly generally by the main dividing range through Blocks
II and I, Ohinemuri Survey District, Blocks XIII, IX, V, and I,
Tairua Survey District, to and along the eastern boundary of the
Hastings Riding, as hereinbefore described, to the Coromandel
County boundary, being the point of commencement.

Altering Times of Sittings of the Supreme Court in the Canterbury
and the Westland Judicial Districts

WHEREAS by the Judicature Act, 1908, it is enacted that any
three or more of the Judges, of whom the Chief Justice shall
be one, may from time to time appoint sittings of the Court for the
despatch of civil and criminal business, and may from time to time,
subject to the approval of the Governor-General in Council, make for
each district rules respecting the places and times for holding
sittings of the Court:

And whereas by Rule under their hands bearing date 29th
September, 1949, published in the New Zealand Gazette of 17th
November, 1949, five of the Judges of the Supreme Court of New
Zealand, with the approval of the Governor-General in Council,
did appoint sittings for the trial of criminal and civil cases and
causes under the Divorce and Matrimonial Causes Act, 1928,
for the respective judicial districts thereinafter mentioned:

And whereas it was therein appointed (inter alia) that--

(1) For the Canterbury Judicial District such a sitting should
be held at Christchurch, on Tuesday, 7th November, 1950, at
10.30 a.m.; and

(2) For the Westland Judicial District such a sitting should be
held at Greymouth, on Monday, 27th November, 1950, at 10.30 a.m. :

And whereas it is expedient to revoke the two above-recited
appointments and to make appointments in substitution therefor:

Now, therefore, we, three of the Judges of the Supreme Court
of New Zealand, in pursuance of the powers vested in us by the
Judicature Act, 1908, and all other powers us thereunto enabling, do
hereby revoke the said two above-recited appointments and in lieu
thereof appoint that sittings for the trial of criminal and civil cases
and causes under the Divorce and Matrimonial Causes Act, 1928,
shall be held in--

(1) The Canterbury Judicial District at Christchurch, on Tuesday,
the 14th day of November, 1950, at 10.30 a.m.; and

(2) The Westland Judicial District at Greymouth, on Monday,
the 6th day of November, 1950, at 10.30 a.m.

Given under our hands at Wellington, this 21st day of August,
1950.

Agreement for Grant of Easement in Favour of Thomas McDonald,
of Wellington, Retired, and Thomas Ambrose Tarrant, of Wel-
ington, Solicitor, Over Land in the City of Wellington Taken
for an Automatic-telephone Exchange, Assented to

WHEREAS by an agreement dated the 25th day of August,
1950, Thomas McDonald, of Wellington, Retired, and
Thomas Ambrose Tarrant, of Wellington, Solicitor, being the re-
gistered proprietors of an area of approximately 14.5 perches, being
Lot 7, D.P. 63, being part Section 940, Town of Wellington, have
agreed to grant to His Majesty the King an easement in perpetuity
(the right to lay and maintain cables) over part of the said Lot 7:

And whereas the said Thomas McDonald and Thomas Ambrose
Tarrant are entitled to receive compensation for the granting of
the said easement:

And whereas the Minister of Works has agreed to grant to the
the said Thomas McDonald and Thomas Ambrose Tarrant in full
satisfaction of the compensation aforesaid, an easement to provide
for the encroachment of two dwellings, for the life of the said dwel-
lings, over portions of Lot 8, D.P. 63, being part Section 940, Town
of Wellington, held by His Majesty the King for an automatic-
telephone exchange:

And whereas the said Thomas McDonald and Thomas Ambrose
Tarrant have agreed to accept such easement in full satisfaction of
the said compensation:

Now, therefore, the Minister of Works doth hereby give notice
in pursuance of section 97 of the Public Works Act, 1928, that he
assents to the agreement hereinbefore referred to.

His Excellency the Governor-General has been pleased to
approve of the following appointments, promotions, trans-
fers, resignations, and retirements of officers of the New Zealand
Military Forces:—

THE ROYAL N.Z. ARTILLERY

Territorial Force—

Major J. W. Moodie, E.D., 3rd Field Regiment, R.N.Z.A.,
is posted to Army Headquarters, Wellington, on Special Duty.
Dated 23rd August, 1950.

Captain J. M. McDermott, 13th Composite Anti-aircraft
Regiment, R.N.Z.A., is transferred to the Reserve of Officers,
General List, The Royal N.Z. Artillery, with the rank of Captain,
with seniority from 1st August, 1948. Dated 12th September,
1950.

Gordon Hedley Hewitt, late Flying Officer, R.N.Z.A.F., to
be Lieutenant, with seniority from 8th November, 1948, and is
posted to the 9th Coast Regiment, R.N.Z.A. Dated 12th June,
1950.

THE ROYAL N.Z. INFANTRY CORPS

Territorial Force—

The Hauraki Regiment—

Bernard Charles Wanty to be 2nd Lieutenant (on prob.) and
is seconded to the Tauranga College Cadets. Dated 1st June,
1950.

The Wellington Regiment (City of Wellington's Own)—

The appointment of 2nd Lieutenant (on prob.) L. J. Ingham,
seconded to the Wairarapa College Cadets, is confirmed.

The appointment of 2nd Lieutenant (on prob.) O. A. C. Smith,
seconded to the Wairarapa College Cadets, is confirmed.

The Wellington West Coast and Taranaki Regiment—

Lieutenant B. Seccombe, 1st Battalion, to be Captain. Dated
1st July, 1950.

The appointment of 2nd Lieutenant (on prob.) R. T. Wood-
field, seconded to the Horowhenua College Cadets, is confirmed.

The appointment of 2nd Lieutenant (on prob.) T. C. Edmond,
seconded to the Ohakune District High School Cadets, lapses.
Dated 21st September, 1950.

The Canterbury Regiment—

Lieutenant V. P. O'Connell, 1st Battalion, to be Captain.
Dated 1st April, 1950.

The Otago and Southland Regiment—

Captain H. R. Cameron, 1st Battalion, is transferred to the
Reserve of Officers, Regimental List, The Otago and Southland
Regiment, with the rank of Captain, with seniority from 3rd August,
1946. Dated 6th September, 1950.

THE ROYAL N.Z. ARMY SERVICE CORPS

Territorial Force—

Lieutenant I. M. Ferguson, from the Reserve of Officers,
Supplementary List, to be Lieutenant, with seniority from 26th
October, 1947, and is posted to the 6th Company, R.N.Z.A.S.C.
Dated 1st September, 1950.
