Japan—Restoration of Trade-mark Rights (Including Claims for Priority) of New Zealand Nationals

APPLICATIONS may now be made by nationals of states at war with Japan for the restoration and reinstatement in Japan of trade-mark registrations (including applications, demands for trials and appeals against rejection of claims for registration) which have been cancelled or invalidated or have lapsed by circumstances arising out of the war.
Upon restoration these rights will remain in force for a period equivalent to the period of protection to which they were entitled at the outbreak of hostilities.
Applicants for the registration of trade-marks in Japan may claim priority of date based on the first application for a trade-mark registration made not earlier than the 8th June, 1941.
Application may also be made for the cancellation of the registration of trade-marks in Japan, if the registered marks are so similar to the marks or names of nationals of states at war with Japan as to cause confusion. In the case of New Zealand nationals such applications must come within the scope of the following conditions :—
(a) That the registration is so similar to the trade-mark or trade name of the New Zealand national as to cause confusion to the public.
(b) That the registered trade-mark is used on merchandise which is identical with or similar to that on which the New Zealand national uses his trade-mark or trade name.
(c) That the trade-mark or trade name of the New Zealand national is well-known in Japan.
(d) That the trade-mark or trade name of the New Zealand national was used by him in any country prior to the date of application for registration in Japan of the trade-mark sought to be cancelled.
These arrangements are covered by a Japanese Cabinet Order, and applications by New Zealand nationals under the provisions of the Order must be made by the 1st February, 1951, to the New Zealand Government Trade Representative, care of Headquarters, British Commonwealth Sub Area, Tokyo, Japan, for transmission to the Japanese authorities.
A copy of the Japanese Cabinet Order and other relevant documents, together with specimen copies of the forms prescribed for making applications to the Japanese authorities under the Order, may be consulted at the Patent Office during ordinary office hours.

Registered Medical Practitioner Prohibited From Dealing in or Issuing Prescriptions for Dangerous Drugs

PURSUANT to the provisions of the Dangerous Drugs Regulations 1928, I, Jack Thomas Watts, Minister of Health, being satisfied that Ian Lawrie Oliver, of No. 2 Victoria Street, Cambridge, a registered medical practitioner, has committed a breach of the terms of the licence deemed to be held by him under the said regulations, and acting on the recommendation of the Medical Council, do hereby revoke the licence deemed to be held by the said Ian Lawrie Oliver under the said regulations and do hereby prohibit the said Ian Lawrie Oliver from issuing prescriptions for the dispensing of dangerous drugs.

Declaring Area to be a Closely Populated Locality for the Purposes of Section 36 of the Transport Act, 1949

IN terms of section 36 of the Transport Act, 1949, the Minister of Transport doth hereby declare the area described in the Schedule hereto to be closely populated locality for the purposes of the said section, to the intent that a person driving any motor-vehicle on any road therein shall be subject to the maximum speed limit of thirty miles an hour fixed by the said section.

SITUATED within Tuapeka County—
All that area at Heriot consisting of those portions of the Willowbank – Matheson's Corner Main Highway No. 153 and the Roxburgh Street Main Highway No. 683, commencing at a point 20 chains measured along the Willowbank – Matheson's Corner Main Highway in a south-westerly direction from the junction of the two said main highways, proceeding thence generally in a north-easterly direction by way of the said main highways, and terminating at a point 66 chains measured along the Roxburgh Street Main Highway in a north-easterly direction from the said junction.

Classification of Roads in Huntly Borough

PURSUANT to regulation 3 (5) of the Heavy Motor-vehicle Regulations 1950, the Minister of Transport doth hereby alter the Huntly Borough Council's proposed classification of the roads described in the Schedule hereto and situated in the Huntly Borough and doth hereby approve such altered classification as described in the said Schedule.

THAT area commencing at the mouth of the Takomairiro River at a point at latitude 46° 14′ S., longitude 170° 07′ E., the base line extending to a point at latitude 46° 18′ S., longitude 170° 02′ E., and extending at all points seawards from this base line for a distance of ten statute miles on a bearing of 138° T.

Fixing the Rates of Levy on Wool Produced in New Zealand
—
PURSUANT to section 12 (3) of the Wool Industry Act, 1944, the New Zealand Wool Board doth hereby fix the rates of the levy to be charged in accordance with the provisions of the said Act on wool as defined in that Act for the season commencing the 1st day of October, 1950, as follows :—
(a) For each bale, 2s. 6d.
(b) For each fadge, 1s. 3d.
(c) For each bag or sack, 5d.
