Notification of Approval of Rules of Hawke’s Bay Acclimatization Society

PURSUANT to the provisions of section 25 of the Animals Protection and Game Act, 1921–22, I hereby notify that copies of the amendments to its rules made by the Hawke’s Bay Acclimatization Society on the 18th October, 1949, have been forwarded to me and were approved on the 13th day of September, 1950.

Patents, Designs, and Trade-marks Convention Order 1940
IT is hereby notified for general information that the International Convention for the Protection of Industrial Property, as revised at London in 1934, again applies as between New Zealand and Japan.
Japan is a convention country for the purposes of section 54 of the Patents, Designs, and Trade-marks Amendment Act, 1939, by virtue of the declaration made by regulation 2 of the Patents, Designs, and Trade-marks Convention Order 1940.

Japan—Restoration of Patent and Related Rights (Including Claims for Priority) of New Zealand Nationals
APPLICATIONS may now be made by nationals of states at war with Japan for the restoration in Japan of patents, utility models, and design registrations (including applications) which lapsed or were invalidated or sequestrated after the 7th December, 1941.
If the original grant or registration is restored and no application made for extension of its normal term, the proprietor will be permitted to claim compensation in respect of any use from the 7th December, 1941, to the date of restoration. Alternatively, if the proprietor elects to accept an extension equivalent to the period during which he was unable to exercise his normal rights, he will be required to waive his claim to compensation in respect of any use occurring between the 7th December, 1941, and the date of restoration.
Applications for patents in Japan may also be made claiming priority of date based, in the case of New Zealand nationals, on a first application for a patent made not earlier than the 7th December, 1940. Third parties who have used the subject-matter of a patent granted on such an application between the priority date and the 1st February, 1951, will not be liable to action for infringement in respect of such use, provided they can prove that their knowledge of the invention was independently obtained. They may in such cases continue to use the invention on terms to be arranged with the patentee.
These restoration and application arrangements are covered by Japanese Cabinet Orders, and applications by New Zealand nations under the provisions of the Orders must be made before the 1st February, 1951, to the New Zealand Government Trade Representative, care of Headquarters, British Commonwealth Sub Area, Tokyo, Japan, for transmission to the Japanese authorities.
Copy of the Japanese Cabinet Orders and other relevant documents, together with specimen copies of the forms prescribed for making applications to the Japanese authorities under the Orders, may be consulted at the Patent Office during ordinary office hours.
