Consenting to the Raising of the Balance (£18,910) of the Nelson Catchment Board’s Loan of £25,000 and Prescribing the Conditions Thereof

ORDER IN COUNCIL

At the Government House at Wellington, this 19th day of July, 1950

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by Order in Council made on the 14th day of July, 1948, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising by the Nelson Catchment Board (hereinafter called the said local authority) of a loan of twenty-five thousand pounds (£25,000) to be known as “Plant Loan, 1948” (hereinafter called the said loan):

And whereas the authority conferred by the said Order in Council has lapsed in accordance with the provisions of clause (4) of the said Order in Council, and it is not now lawful or competent for the said local authority to raise the said loan or any portion thereof except in accordance with the provisions of a further Order in Council that may be issued pursuant to section 11 of the Local Government Loans Board Act, 1926, (hereinafter called the said Act):

And whereas an amount of eighteen thousand nine hundred and ten pounds (£18,910) (hereinafter called the said sum) has not yet been raised, and it is expedient to authorize the said local authority to raise the said sum on the conditions hereinafter set out:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section 11 of the said Act, as set out in section 29 of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the said sum up to the amount of eighteen thousand nine hundred and ten pounds (£18,910), for the purpose for which the said loan was authorized, and in giving such consent doth hereby determine as follows:—

(1) The term for which the said sum or any part thereof may be raised shall not exceed eight (8) years.

(2) The rate of interest that may be paid in respect of the said sum or any part thereof shall be such as shall not produce to the lender a rate exceeding three pounds ten shillings (£3 10s.) per centum per annum.

(3) The said sum or any part thereof, together with interest thereon shall be repaid by equal aggregate annual instalments extending over the term as determined in (1) above.

(4) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

Varying the Determinations in Respect of Portion (£15,000) of the Ekatahuna County Council’s Loan of £30,000

At the Government House at Wellington, this 9th day of August, 1950

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by Order in Council made on the 23rd day of March, 1950, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Ekatahuna County Council (hereinafter called the said local authority) of the sum of fifteen thousand pounds (£15,000) (hereinafter called the said sum) being portion of a loan of thirty thousand pounds (£30,000) known as “Bridges Loan, 1945”:

And whereas the authority conferred by the said Order in Council has not yet been exercised and it is expedient to vary certain of the determinations aforesaid in respect of the said sum:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section 11 of the Local Government Loans Board Act, 1926, as set out in section 29 of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said sum by prescribing that in lieu of a term of thirty-five (35) years, as specified in clause 1 of the said Order in Council, the term for which the said sum or any portion thereof may be raised shall not exceed thirty (30) years.

Varying the Determinations in Respect of the Geraldine Borough Council’s Loan of £2,500

At the Government House at Wellington, this 9th day of August, 1950

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by Order in Council made on the 26th day of July, 1950, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Geraldine Borough Council (hereinafter called the said local authority) of a loan of two thousand five hundred pounds (£2,500) to be known as “Town Clerk Housing Loan, 1950” (hereinafter called the said loan):

And whereas the authority conferred by the said Order in Council has not yet been exercised and it is expedient to vary certain of the determinations aforesaid in respect of the said loan:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section 11 of the Local Government Loans Board Act, 1926, as set out in section 29 of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said loan by prescribing that in lieu of a term of thirty (30) years, as specified in clause 1 of the said Order in Council, the term for which the said loan or any portion thereof may be raised shall not exceed twenty-five (25) years.

Delegation to the Rodney County Council of the Power of Appointing Trustees for the Minniesdale Cemetery

At the Government House at Wellington, this 9th day of August, 1950

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 5 of the Cemeteries Act, 1908, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby delegate to the Rodney County Council the powers conferred upon him by section 4 of the said Act, of appointing and removing trustees in respect of the cemetery within the meaning of the said Act, known as the Minniesdale Cemetery, and being the land described in the Schedule hereto.

MINNIESDALE CEMETERY

ALL that area in the Rodney County, situated in Block XIV, Otamatea Survey District, containing by admeasurement 3 roods and 36 perches, more or less, being Lots 1 and 2 as shown on the plan numbered 31499, deposited in the Auckland Land Registry Office, being parts of Allotment 21, Wharehine Parish, and being all the land comprised and described in Certificate of Title, Volume 906, folio 37, and portion of the land comprised and described in Certificate of Title, Volume 767, folio 173, Auckland Land Registry.

Revoking Delegation of Power of Appointing and Removing Trustees for Weedons Cemetery

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Cemeteries Act, 1908, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby revoke, in so far only as it relates to the Weedons Cemetery, an Order in Council delegating powers under the said Act, of appointing and removing trustees, made on the 18th day of September, 1933, and published in the New Zealand Gazette on the 21st day of the same month at page 2429.
