Redefining Boundaries of the Borough of Whakatane, the County of Whakatane, and the Taneatua Riding of the County of Whakatane

PURSUANT to the provisions of section 147 of the Municipal Corporations Act, 1933, the boundaries of the Borough of Whakatane are hereby defined as set out in the First Schedule hereto, the boundaries of the said borough having been altered by Order in Council made under the Municipal Corporations Act, 1933, dated the 15th day of March, 1950, and published in New Zealand Gazette No. 17 of the 23rd day of March, 1950.

And also, in pursuance of the provisions of the said section 147 of the Municipal Corporations Act, 1933, the boundaries of the County of Whakatane affected by the said Order in Council are hereby defined as set out in the Second Schedule hereto.

And, in further pursuance of the provisions of the said section 147 of the Municipal Corporations Act, 1933, the boundaries of the Taneatua Riding of the County of Whakatane affected by the said Order in Council are hereby defined as set out in the Third Schedule hereto.

FIRST SCHEDULE

BOUNDARIES OF THE BOROUGH OF WHAKATANE

ALL that area of approximately 1,539 acres, in the South Auckland Land District, bounded by a line commencing at a point in Block I, Whakatane Survey District, being the intersection of the southern side of Bridge Street with the line of mean high water of the right bank of the Whakatane River, and running northerly generally down the right bank of the said Whakatane River to a point on the northern boundary of Section 9, Block II, Whakatane Survey District (Eivers Beach Domain), distant 43·33 links westerly from its north-eastern corner; thence easterly generally along right lines on the following approximate bearings and distances: 3° 25′ for 155 ft., 108° 45′ for 1,515 ft. to the northern point of Bath Rock; thence 93° 5′ for 850 ft., to the north-western corner of the old wharf and along the said wharf to its north-eastern corner; thence 84° 0′ for 110 ft., 75° 0′ for 315 ft., and 86° 30′ for 570 ft., to the north-western corner of the new wharf, and along the said new wharf to its north-eastern corner; thence 79° 45′ for 460 ft. to the rock training wall; thence along the said training wall, 66° 45′ for 180ft., 59° 45′ for 195 ft., 53° 0′ for 135 ft., 46° 50′ for 275 ft., 37° 0′ for 180 ft., to Irakewa Island; thence along the north-western shore of Irakewa Island aforesaid, to its northernmost point; thence 36° 45′ for 590 ft. along the aforesaid rock training wall to Flat Rock, and along the north-western face of Flat Rock, aforesaid, to its northernmost point; again along the rock training wall 39° 45′ for 230 ft., 31° 30′ for 150 ft., 24° 0′ for 215 ft., to Heads Rock; along the western side of the aforesaid Heads Rock 358° 0′ for 60 ft., 20° 30′ for 500 ft., 92° 0′ for 340 ft., to the line of mean high water of the Whakatane River as defined by the plan numbered 23680, lodged in the office of the Chief Surveyor, at Auckland; thence in a south-westerly direction generally along the aforesaid line of mean high water to the south-western corner of the part of Allotment 245 of the parish of Waimana, as shown on the plan numbered 12340, deposited in the Auckland Land Registry Office; thence along the southern boundary of the aforesaid part of Allotment 245, to and along the eastern boundaries of Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, and 16, as shown on the plan numbered 20477, deposited as aforesaid, being part of Allotment 245 aforesaid, to and along the north-eastern, north-western, and south-western boundaries of Lot 1, as shown on the plan numbered 25400, deposited as aforesaid, to and along the western boundary of part of Allotment 245, as shown on the plan numbered 23787, deposited as aforesaid, to the westernmost corner of the aforesaid part of Allotment 245; thence along a right line to and along the north-western boundary of another part of Allotment 245, as shown on the plan numbered 23747, deposited as aforesaid; and along the north-western boundary of Lot 2, as shown on the plan numbered 27268, deposited as aforesaid, being part of the aforesaid Allotment 245, to the westernmost corner of the aforesaid Lot 2; thence along a right line bearing 186° 34′ across the Wainui Main Highway to its southern side; thence along the southern side of the aforesaid Main Highway to the eastern side of Valley Road; thence along a right line across Valley Road, aforesaid, to the north-eastern corner of Lot 94, as shown on the plan numbered 11056, deposited as aforesaid, being part of Allotment 261 of the aforesaid Parish; thence southerly generally along the western side of Valley Road, aforesaid, to the south-eastern corner of Lot 4, as shown on the plan numbered 11056, aforesaid; thence westerly generally along the southern boundaries of the said Lot 4 and Lot 74, the southern end of Douglas Street, the southern boundary of Lot 48, all the aforesaid lots being as shown on the aforesaid plan numbered 11056, to and along the southern boundary of Lot 3, as shown on the plan numbered 16695, deposited as aforesaid, being Allotment 233 of the aforesaid Parish to its south-western corner; thence along a right line being the production southwards of the eastern side of King Street across a public road to its southern side; thence westerly and southerly generally along the southern side of the aforesaid public road, to and along the western boundary of part Allotment 11, Waimana Parish, aforesaid, along a right line across Allotment 405 of the aforesaid Parish and again along the western boundary of Allotment 11, aforesaid, to a point 250 links distant from the southern side of the aforesaid public road; again westerly generally along a right line 250 links distant from and parallel to the southern side of the aforesaid public road to its intersection with the eastern side of another public road forming the western boundary of part Allotment 8 of the said Parish of Waimana; thence along the eastern side of the said public road, to and along the southern side of Bridge Road to its intersection with the line of mean high water of the right bank of the Whakatane River, aforesaid, being the point of commencement.

SECOND SCHEDULE

BOUNDARIES OF THE COUNTY OF WHAKATANE

ALL that area in the South Auckland and Gisborne Land Districts bounded by a line commencing at a point in Block IV, Waihi South Survey District, on the shores of the Bay of Plenty, being the north-eastern corner of Waewaehikitia No. 1 Block, and running south-easterly generally along the said shores to the eastern extremity of the Ohope Land Spit, being a point on the western shore of the entrance to Ohiwa Harbour; thence due south along a right line for a distance of 500 links; thence due south-west along a right line to its intersection with another right line from the southern extremity of Allotment 249, Waimana Parish (Ohakara Island), and passing through a point 100 links due north of the northern extremity of Section 284, Waimana Parish (Uretara Island); thence westerly generally along the last-mentioned right line to the southern extremity of Allotment 249, aforesaid, and along a right line to a point 1,000 links distant from and due west of the northern extremity of Allotment 127, Waimana Parish (Whitiwhiti Point); thence along another right line to a point being the intersection of the northern boundary of that part of Lot 2, to the north-east of Wainui Road, as shown on the plan numbered 12843, deposited in the Office of the District Land Registrar at Auckland, being part Allotment 245, Parish of Waimana, with the mean high water mark of Ohiwa Harbour aforesaid; thence westerly generally along the said northern boundary and along a right line being the last-mentioned boundary produced across Wainui Road to its western side; thence south-easterly and southerly generally along the said western and south-western sides to the junction with the western side of the Whakatane-Opotiki Main Highway at the north-eastern corner of Allotment 183A, Waimana Parish; thence again southerly generally along the western side of the said Main Highway to the south-eastern corner of Allotment 223, Waimana Parish; thence easterly and again southerly generally along a right line across the said Main Highway to and along the southern boundaries of Allotments 268 and 269, Parish of Waiotahi, to the south-eastern corner of the last-mentioned allotment; thence along the north-eastern and south-eastern boundaries of Sections 6 and 5, of Block IV, Waimana Survey District, to and along the south-eastern boundaries of Waimana Nos. 1c No. 1b, 1c 1c No. 2, 1c 1c No. 3, 1c 1c No. 4A, 1c 1c 4B No. 3, 1d No. 2b 1, Parts 1d 2d No. 1, 1d 2d No. 2, 1d No. 3, part 1d No. 5A and 1d No. 5B Blocks, to Trig. Station D, Paitaua, in Block VIII, Waimana Survey District; thence north-westerly generally along the south-western boundary of the last-mentioned Block to the middle of the Waimana River; thence again southerly generally up the middle of the said river to and up the middle of the Tauranga River to a point being the intersection near the source of that river with a right line from Maungatapere Trig. Station to Maungapohatu Trig. Station; thence south-westerly generally along a right line to the last-mentioned Trig. Station; thence south-easterly generally along a right line running in the direction of Puketapu Trig. Station to a point in line with the north-western boundary line of the Waipaoa Block; thence south-westerly along a right line to and along the north-western boundaries of the last-mentioned block and a forest reserve, and southerly along the western boundary of the said forest reserve to its intersection with a right line running between Puketapu Trig. Station, aforesaid, and the most northern point of Lake Waikaremoana; thence south-westerly along the last-mentioned line to the said northern corner of Lake Waikaremoana, aforesaid; thence along a right line passing through a point in Block X, Tuatawhata Survey District, 180 chains due north of Maungataniwha Trig. Station, to the intersection of the said line with a right line running from Trig. Station 69, Tataroa-kino, in Block VIII, Tarawera Survey District (Hawke’s Bay Land District), to Trig. Station 76A, Tawhiwhau, in Block XIV, Galatea Survey District; thence along a right line to Te Taumutu Trig. Station in Block XVI, Heruwi Survey District; thence along a right line to Pukeroa Trig. Station in Block XI of the aforesaid Heruwi Survey District; thence along a right line to Trig. Station F, Tiritiri, in Block III, Heruwi Survey District, aforesaid; thence along a right line to Trig. Station No. 76, Taupiri, in Block XII, Weao Survey District; thence along a right line to Trig. Station
