At the Government House at Wellington, this 7th day of June, 1950
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS by Order in Council made on the 27th day of April, 1949, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Te Kuiti Borough Council (hereinafter called the said local authority) of the sum of twenty-two thousand two hundred and fifty pounds (£22,250) by a loan to be known as “Waterworks Improvement Loan, 1949” (hereinafter called the said loan):
And whereas the authority conferred by the said Order in Council has not yet been exercised and it is expedient to vary certain of the determinations aforesaid in respect of portion of the said loan, being the sum of twelve thousand pounds (£12,000) (hereinafter called the said sum):
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section 11 of the Local Government Loans Board Act, 1926, as set out in section 29 of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary certain of the determinations aforesaid in respect of the said sum by prescribing that in lieu of provision being made for the repayment of the said sum by the establishment of a sinking fund in respect thereof, as specified in clause 3 of the said Order in Council, the said sum or any part thereof shall be repaid by equal aggregate annual or half-yearly instalments of principal and interest extending over the term of thirty (30) years, as specified in clause 1 of the said Order in Council.

Authorising the Laying-off of a Street off Queen Street in the Borough of New Lynn, Subject to a Condition as to the Building-line

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 31 of the Municipal Corporations Amendment Act, 1948, and section 125 of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby authorize the New Lynn Borough Council to permit the laying-off of the proposed street described in the Schedule hereto at a width for part of its length of less than 66 ft., but not less than 50 ft., subject to the condition that no building or part of a building shall at any time be erected on the land shown edged green on the plan referred to in the said Schedule, within a distance of 33 ft. from the centre-line of the said street.
SCHEDULE
THAT proposed street in the North Auckland Land District, Borough of New Lynn, containing, by admeasurement, 2 roods 6 perches, more or less, being part of Allotment 257, Waikomiti Parish. As the same is more particularly delineated on the plan marked P.W.D. 131543, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Varying a Condition as to Setting-back the Building-line of a Street (David Crescent—formerly Kirkcaldie Street), in the City of Wellington, Imposed by Order in Council Under the Municipal Corporations Act, 1933, and the Public Works Act, 1928

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to section 27 of the Public Works Amendment Act, 1948, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby amend the Order in Council dated the 5th day of December, 1945, and published in New Zealand Gazette No. 76 of the 6th day of the same month, at page 1514, and deposited in the Land Registry Office at Wellington, under No. 2009, authorizing the Wellington City Council to permit the laying-off of a street (David Crescent—formerly Kirkcaldie Street) in the City of Wellington, of a width less than 66 ft., but not less than 50 ft., subject to a condition as to the building-line, by varying the building-line condition imposed by the said Order in Council so that no building or part of a building shall at any time be erected on Lot 5, D.P. 13446, being part Section 37, Karori District, and being all the land comprised and described in certificate of title, Volume 552, folio 26 (Wellington Land Registry), within a distance of 40 ft. from the centre-line of the portion of David Crescent fronting the said Lot 5, D.P. 13446.

PURSUANT to section 149 of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the Waipawa County Council stopping the portion of road described in the Schedule hereto.

PURSUANT to section 112 of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become county road.
SCHEDULE
ALL that portion of road in the Southland Land District, Southland County, known as Kenilworth Road, in Block II, Toetoes Survey District, commencing at its intersection with a public road forming the northern boundary of Section 14, Block II, Toetoes Survey District, and passing through Sections 19, 20, and 21, Block II, Toetoes Survey District, in a north-easterly direction for a distance of 29½ chains, more or less, and thence in an easterly direction generally for a distance of 107 chains, more or less. As the same is more particularly delineated on the plan marked P.W.D. 131393, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
