Special Order Made by the Te Rapa Drainage Board Altering Subdivision Boundaries and Adjusting Representation

THE following Special Order made by the Te Rapa Drainage Board is published in accordance with the provisions of the Land Drainage Act, 1908, and amendments.

SPECIAL ORDER
IN pursuance and exercise of the powers vested in it by section 16 of the Land Drainage Act, 1908, the Te Rapa Drainage Board hereby resolves by way of Special Order as follows :—
“1. That the Horotiu Subdivision of the Te Rapa Drainage District be abolished.
“2. That all that area described in the First Schedule hereto be constituted a new subdivision to be known as the Horotiu North subdivision and to elect one trustee.
“3. That all that area described in the Second Schedule hereto be constituted a new subdivision to be known as the Horotiu South Subdivision and to elect one trustee.”
FIRST SCHEDULE
Horotiu North Subdivision
ALL that area in the South Auckland Land District, situated in Blocks VII, VIII, XI, and XII, Newcastle Survey District, bounded by a line commencing at a point on the right bank of the Waipa River, being the southernmost corner of Section 109A, Suburbs of Newcastle South, and running south-easterly generally along the southern boundaries of the Borough of Ngaruawahia, as described in the New Zealand Gazette No. 18 of the 17th day of February, 1921, page 501, to and along the left bank of the Waikato River to the northernmost corner of Lot 1, as shown on the plan numbered 25302, deposited in the Auckland Land Registry Office, being portion of Allotment 101, Parish of Horotiu ; thence south-westerly generally along the north-western boundary of Lot 1 aforesaid, along a right line across the Great South Road, part Allotment 165 of the aforesaid parish, as shown on the plan numbered 10108, deposited as aforesaid, and the North Island Main Trunk Railway to the northernmost corner of Lot 21, as shown on the plan numbered 11096, deposited as aforesaid, being part of Allotment 165 aforesaid ; thence along the north-western boundary of Lot 21 aforesaid, along a right line crossing Park Road diagonally, to and along the north-western boundary of Lot 38, as shown on the plan numbered 11096 aforesaid, to the westernmost corner of the last-mentioned lot ; thence along a right line across Lots 1 and 2, as shown on the plan numbered 25814, deposited as aforesaid, being parts of the Allotment 165, aforesaid, and parts Allotment 159 of the aforesaid parish to the north-eastern corner of part Lot 2, as shown on the plan numbered 7831, deposited aforesaid, being part of Allotment 159 aforesaid ; thence along portion of the eastern boundary of part of Lot 2 aforesaid, and along a right line being that boundary produced to the north-eastern boundary of Allotment 158 of the aforesaid Horotiu Parish ; thence along the aforesaid north-eastern boundary and along a right line being that boundary produced to the middle of the Te Kowhai–Horotiu Main Road ; thence westerly generally along the middle of that road, to and along the middle of Crawford Road, to and along the middle of a public road through Allotment 161 of the aforesaid Parish of Horotiu and the public road forming the eastern and northern boundaries of Tangirau No. 2B 2E Block, and the public road forming the northern boundary of Tangirau No. 1 Block, to the right bank of the Waipa River ; thence northerly generally along the right bank of the aforesaid river to the point of commencement.
SECOND SCHEDULE
Horotiu South Subdivision
ALL that area in the South Auckland Land District situated in Blocks VIII and XII, Newcastle Survey District, bounded by a line commencing at a point on the left bank of the Waikato River, being the northernmost corner of Lot 1, as shown on the plan numbered 25302, deposited in the Auckland Land Registry Office, being portion of Allotment 101, Parish of Horotiu, and running south-easterly generally along the left bank of the Waikato River aforesaid, to the northernmost corner of Allotment 105, Parish of Horotiu, aforesaid ; thence south-westerly generally along the north-western boundary of Allotment 105 aforesaid, and along a right line being that boundary produced to the middle of the Great South Road ; thence along the middle of that road, to and along the middle of the public road forming the north-western boundaries of Allotments 118, 121, and 122 of the aforesaid parish to the middle of Young Road ; thence north-westerly generally along the middle of Young Road aforesaid, to and along the middle of the Te Kowhai – Horotiu Main Road to the southern corner of the Horotiu North Subdivision ; thence north-easterly generally along the south-eastern boundary of the Horotiu North Subdivision, as hereinbefore described, to the point of commencement.

I hereby certify that the above Special Order was duly passed at a special meeting of the Te Rapa Drainage Board held on the 11th day of November, 1949, and confirmed at a meeting of the said Board held on the 9th day of December, 1949.

The Servicemen’s Settlement and Land Sales Act, 1943.—Notice of Intention to Take Land
THE Minister of Lands, acting in pursuance of section 24 of the Servicemen’s Settlement and Land Sales Act, 1943, as extended by the provisions of section 2 of the Servicemen’s Settlement and Land Sales Amendment Act, 1948, hereby gives notice of his intention to take, under Part II of the said Act, the interest of the lessee or licensee in the land described in the Schedule hereto, and specifies the 15th day of February, 1951, as the date on which possession of the lands described in the said Schedule is required, and the 5th day of May, 1950, as the date on or before which objections may be made under section 25 of the said Act.
SCHEDULE
SOUTH AUCKLAND LAND DISTRICT
ALL that parcel of land containing by admeasurement eight thousand five hundred and thirty-four (8,534) acres one (1) rood thirty-one (31) perches, more or less, being Section 4, Block XI, Section 22, Block XII, Section 2, Block XV, and Section 1, Block XVI, Maketu Survey District, Section 1, Block III, and Section 1, Block IV, Rotoiti Survey District (otherwise known as Run No. 4, Parish of Matata), and being all of the land described in deferred-payment licence comprised in register-book, Vol. 627, folio 3 (Auckland Registry).
As witness my hand, this 3rd day of April, 1950.

Agreement for Grant of Drainage Easement and Incidental Rights Thereto in Favour of Richard Matthew Fitzgerald, of Palmerston North, Farmer, Over Land Situated in Block X, Kairanga Survey District, Taken for Broadcasting Purposes (Transmitting Station), Assented to
WHEREAS by an agreement dated the 17th day of June, 1948, Richard Matthew Fitzgerald, of Palmerston North, Farmer, agreed to His Majesty the King taking, under the Public Works Act, 1928, an area of land containing approximately 23 acres 2 roods 28·9 perches, situate in Block X, Kairanga Survey District, being part Lots 1 and 2, D.P. 7073, and being parts Section 1564, City of Palmerston North, for Broadcasting Purposes (Transmitting Station) :
And whereas the said Richard Matthew Fitzgerald is entitled to receive compensation for his freehold interest in the said area :
And whereas the Minister of Works has agreed to grant to the said Richard Matthew Fitzgerald a drainage easement and incidental rights thereto over the aforesaid area in addition to the granting of a lease, the undertaking of certain work, and the payment of a sum of money in full satisfaction of the compensation aforesaid :
And whereas the said Richard Matthew Fitzgerald has agreed to accept such Grant of Easement in addition to the said lease, undertaking of work, and sum of money in full satisfaction of the said compensation :
Now, therefore, the Minister of Works doth hereby give notice, in pursuance of section 97 of the Public Works Act, 1928, that he assents to the agreement hereinbefore referred to.

Notice of Intention to Take Land in the City of Timaru for Housing Purposes
NOTICE is hereby given that it is proposed, under the provisions of the Public Works Act, 1928, to take the land described in the Schedule hereto for housing purposes : And notice is hereby further given that the plan of the land so required to be taken is deposited in the post-office at Timaru and is there open for inspection ; and that all persons affected by the taking of the said land should, if they have any well-grounded objections to the taking of such land, set forth the same in writing, and send such writing, within forty days from the first publication of this notice, to the Minister of Works at Wellington.
SCHEDULE
APPROXIMATE area of the piece of land required to be taken : 3 roods 20·4 perches.
Being Lots 22 and 23, D.P. 3430, part Rural Section 2282, Block X, Arowhenua Survey District, City of Timaru, and being all the land comprised in certificate of title, Vol. 439, folio 252 (Canterbury Land Registry).
As the same is more particularly delineated on the plan marked P.W.D. 130905, deposited in the office of the Minister of Works at Wellington, and thereon edged red.
