Licensing William Henry Saies to Use and Occupy a Part of the Foreshore at Totara North, Whangaroa Harbour, as a Site for Buildings for Storing Purposes

At the Government Buildings at Wellington, this 29th day of March, 1950

Present:
THE HON S. G. HOLLAND PRESIDING IN COUNCIL

PURSUANT to the Harbours Act, 1923, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby licence and permit William Henry Saies, of Saies (hereinafter called the licensee, which term shall include his executors, administrators and assigns, unless the context requires a different construction), to use and occupy a part of the foreshore at Totara North, Whangaroa Harbour, as shown on plan marked M.D. 1930 and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining buildings for storing purposes thereon, as shown on the said plan, such licence to be held and enjoyed by the licensee upon and subject to the terms and conditions set forth in the Schedule hereto.

SCHEDULE
CONDITIONS

(1) THIS licence is subject to the Foreshore Licence Regulations 1940, and the provisions of those regulations shall, so far as applicable, apply hereto.
(2) The term of licence shall be fourteen years from the 1st day of April, 1950.
(3) The premium payable by the licensee shall be one pound (£1) and the annual sum so payable by the licensee shall be two pounds ten shillings (£2 10s.).

Authorizing the Laying-off of a Street (Easther Crescent Extension) off Middleton Road in the City of Dunedin Subject to a Condition as to the Building-line

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section thirty-one of the Municipal Corporations Amendment Act, 1948, and section one hundred and twenty-five of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council doth hereby authorize the Dunedin City Council to permit the laying-off of the proposed street described in the Schedule hereto at a width for parts of its length of less than 66 feet but not less than 52·8 feet, subject to the condition that no building or part of a building shall at any time be erected on the land shown edged green on the plan marked P.W.D. 129648, referred to in the said Schedule, within a distance of 48 feet from the centre-line of the said street.

SCHEDULE

THAT proposed street in the Otago Land District, City of Dunedin, containing by admeasurement 2 acres 3 roods 3 perches, more or less, being part Sections 46 and 291B, Block VII, Town District, part Section 10, Ocean Beach District, and part Section 47, Block VII, Town District, and Lot 24, Deposited Plan 4300, Township of Middleton Park. As the same is more particularly delineated on the plan marked P.W.D. 129648, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Partially Cancelling a Condition as to Setting-back the Building-line of Avon Street in the City of Wellington, Imposed by Order in Council Under Section 117 of the Public Works Act, 1905

PURSUANT to section one hundred and thirty-one of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend the Order in Council dated the twenty-third day of September, one thousand nine hundred and seven, and published in New Zealand Gazette No. 85 of the twenty-seventh day of the same month, and deposited in the Land Registry Office at Wellington under No. 326, exempting Avon Street in the City of Wellington from the provisions of section one hundred and seventeen of the Public Works Act, 1905, subject to a condition as to the building-line, by cancelling the building-line condition imposed by the said Order in Council in so far as it affects part Lot 2, D.P. 6578, being part Section 6, Town District, being the land comprised and described in Certificate of Title, Volume 310, folio 152, Wellington Land Registry, and being part of the land adjoining the northern side of the said street.

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for an electric substation.

SCHEDULE

APPROXIMATE area of the piece of land permitted to be taken: 1 rood 0·5 perches.
Being Lot 14, D.P. 3805, part Rural Section 163, Block X, Christchurch Survey District, and being the whole of the land comprised and described in Certificate of Title, Volume 374, folio 110 (Canterbury Registry).
