At the Government Buildings at Wellington, this 23rd day of March, 1950
Present:
THE HON. S. G. HOLLAND PRESIDING IN COUNCIL
PURSUANT to the Hospitals Act, 1926, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby order as follows:-
- This Order may be cited as the Northland Hospital District Order 1950.
- The hospital districts of Mangonui, Whangaroa, Hokianga, Bay of Islands, Whangarei, and Kaipara are hereby abolished as from the thirty-first day of March, one thousand nine hundred and fifty.
- As from the said thirty-first day of March, one thousand nine hundred and fifty, there is hereby constituted a new hospital district under the name of "The Northland Hospital District" and comprising the whole of the area included in the said hospital districts abolished by this Order.
NORTHLAND HOSPITAL BOARD
4. (1) For the purpose of the election or appointment of representatives on the Hospital Board (hereinafter referred to as the said Hospital Board) of the Northland Hospital District, those contributory districts named in the second column of the First Schedule hereto and therein bracketed together are hereby respectively combined into combined districts as indicated by such brackets, the remainder of such contributory districts being treated as separate contributory districts for the purposes of this clause.
(2) Each contributory local authority whose district is distinguished in the second column of the said First Schedule by the letter "p" is hereby respectively selected and appointed the principal local authority for the combined district in which it is included.
(3) The number of members to be elected as the representatives on the said Hospital Board of each of the said separate contributory districts or combined districts, as the case may be, specified in the second column of the said First Schedule shall be that respectively set out in the third column thereof opposite to such separate contributory district or such combined district.
5. The first election of representatives as aforesaid on the said Hospital Board of the said separate contributory districts, or of the said combined districts, as the case may be, shall be held simultaneously with the next ordinary election of the contributory local authorities of the Northland Hospital District: Provided that nothing contained in this clause or elsewhere in this Order shall prevent the prior exercise of the power to appoint members of the said Hospital Board conferred on the Governor-General by section ten of the Hospitals Act, 1926, as amended by section forty-three of the Finance Act, 1931 (No. 2).
6. The first meeting of the said Hospital Board shall be held at the Whangarei Hospital on the third day of April, one thousand nine hundred and fifty, at a quarter past two o'clock p.m.
7. The regulations made by Order in Council dated the thirteenth day of April, one thousand nine hundred and twenty-seven, and published in the Gazette on the twenty-first day of the same month, at page 1096, shall as far as applicable, and with any necessary modifications, be deemed to apply to the said Hospital Board and the Northland Health District as fully and effectively as if the said regulations had been incorporated in this Order.
COMMITTEES OF MANAGEMENT ESTABLISHED
8. (1) The committees of management named in the second column of the Second Schedule hereto are hereby established for the management of the various institutions in the hospital districts abolished by this Order. Each such committee of management shall respectively assume the management in accordance with the provisions of this Order of any institution or institutions situate in the hospital district abolished by this Order appearing opposite to its name in the first column of the said Second Schedule.
(2) Each of the said committees of management shall respectively consist of the number of members set out opposite to its name in the third column of the said Second Schedule.
(3) Of the total number of members set out as aforesaid in the third column of the said Second Schedule each of the local authorities, the names of which appear opposite to such numbers in the fourth column thereof, shall respectively appoint the number of members appearing opposite to the names of such local authorities in the fifth column thereof: Provided always that for the purpose of this clause the Kamo Town Board and the Hikurangi Town Board shall combine to appoint one member of the Whangarei Hospital Committee.
9. Every appointment to a committee of management by a local authority other than the Kamo Town Board and the Hikurangi Town Board shall be made at a meeting of the local authority in respect of which reasonable notice of the intention to make such appointment has been given to the members of the local authority.
- The combined appointment by the Kamo Town Board and the Hikurangi Town Board of a member of the Whangarei Hospital Committee shall be made at a joint meeting for that purpose of members of both local authorities held at a time and place to be agreed on by these local authorities or, failing agreement by them, at such time and place as may be determined by the said Hospital Board, in which event the said Hospital Board shall cause reasonable notice of such meeting and of the time and place thereof to be sent to all members of both local authorities.
- (1) For the purpose of the first appointments to the said committees of management the meetings of the respective local authorities shall be held on dates as near as may be to the date from which the Northland Hospital District is constituted.
(2) For the purpose of subsequent appointments to the said committees of management the meetings of the respective local authorities shall be held as soon as may be after the date of the general election of members of such local authorities. - Every member of a committee of management appointed by a local authority shall, unless his office sooner becomes vacant, hold office up to and including the date of the general election of members of the said local authority.
- (1) Notwithstanding the foregoing provisions of this Order the office of any member of a committee of management who has been appointed by a local authority or by combined local authorities shall become vacant in any of the cases in which the office of a member of a Hospital Board becomes vacant pursuant to section 24 of the Hospitals Act, 1926.
(2) If any such vacancy shall occur the local authority or combined local authorities, as the case may be, by which the member whose office has become vacant was appointed shall forthwith appoint a qualified person to fill the vacancy. - (1) The first meeting of every committee of management shall be held at such time and place as may be determined by the said Hospital Board which shall give members of the committee concerned at least seven days' notice of the said meeting and the time and place thereof.
(2) Any subsequent meeting shall be held at such time and place as the committee concerned may from time to time appoint: Provided that the Chairman of a committee or a majority of the members thereof may at any time call a special meeting of the committee. - Every committee of management established pursuant to the provisions of this Order shall, subject to the direction of the said Hospital Board, have the general management and supervision of every institution in the district for which it is appointed and in particular shall in respect of every such institution have the following powers of the said Hospital Board-
(a) The power to inquire into complaints on behalf of patients and to deal with any such complaint or determine whether it shall be referred to the said Hospital Board :
(b) The power to appoint and dismiss hospital domestic staff, laundry staff, porters, gardeners, and such other staff as the said Hospital Board may authorize the committee to appoint and dismiss: Provided that, except with the prior approval of the Minister, the said Hospital Board shall not authorize the committee to appoint and dismiss medical, nursing, laboratory, pharmaceutical, x-ray, physiotherapy, or other professional or technical staff directly employed in the treatment of patients :
(c) The power to suspend any employee for misconduct, provided that the circumstances of such suspension are forthwith reported to the said Hospital Board and further action reserved to the said Hospital Board unless in the particular case the Board authorizes the committee to deal with the question of dismissal :
(d) Such other powers as the said Hospital Board may with the approval of the Minister authorize the committee to exercise :
Provided always that, in the exercise of any of its powers, the committee shall observe and comply with any statutory conditions or restrictions for the time being applicable to similar powers when exercised by a hospital board. - (1) At every meeting of a committee of management the Chairman, if present, shall preside.
(2) If the Chairman is absent from any meeting, or if for the time being there is no Chairman, the members present shall appoint one of their number to act as Chairman of the meeting, and the member so appointed shall have the same powers at that meeting as if he were Chairman of the committee:
Provided always that if there are one or more members of the committee present who are also members of the said Hospital Board, then he or one of them shall be appointed to act as Chairman. - (1) Every question coming before a committee of management shall be decided by the votes of a majority of the members present.
(2) The Chairman shall have a deliberative vote, and in any case in which the votes are equal, a casting-vote also.
(3) No business shall be transacted at any meeting unless at least a quorum of members is present at such meeting during the whole of the time when the business is being transacted.
(4) A quorum shall consist of a majority of the total number of the members of the Committee (irrespective of any extraordinary vacancies). - Except as provided in this Order the proceedings of every committee of management shall be governed and determined by regulations to be made from time to time by the said Hospital Board.
