Boundaries of Borough of Whakatane and County of Whakatane Altered

THE HON. K. J. HOLYOAKE PRESIDING IN COUNCIL
WHEREAS, at the request of the Whakatane Borough Council, the Local Government Commission, in pursuance of the provisions of the Local Government Commission Act, 1946, has considered a proposal for an alteration of the boundaries of the Borough of Whakatane and the County of Whakatane:
And whereas, in pursuance of the provisions of the said Act, the Local Government Commission has approved as final a scheme bearing date the twenty-eighth day of October, one thousand nine hundred and forty-nine, providing for the exclusion of the area described in the schedule to the said scheme from the County of Whakatane and for the inclusion of such area in the Borough of Whakatane:
And whereas it is deemed expedient to give effect to the final scheme as hereinafter appearing:
Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the Local Government Commission Act, 1946, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that as on and from the first day of April, one thousand nine hundred and fifty, the area described in the Schedule hereto shall be excluded from the County of Whakatane and included in the Borough of Whakatane, and with the like advice and consent doth hereby declare that the alteration of boundaries of the said county and the said borough hereinbefore made shall be deemed to have been effected under the Municipal Corporations Act, 1933.

SCHEDULE
AREA EXCLUDED FROM THE COUNTY OF WHAKATANE AND INCLUDED IN THE BOROUGH OF WHAKATANE
ALL that area in the South Auckland Land District of approximately 14 acres, situated in Block I, Whakatane Survey District, bounded by a line commencing at a point on the boundary of the Whakatane Borough, being the south-western corner of Allotment 233, Waimana Parish, and running southerly generally along a right line being the production southwards of the eastern side of King Street across a public road to its southern side; thence westerly and southerly generally along the southern side of the aforesaid public road, to and along the western boundary of part Allotment 11, Waimana Parish, aforesaid, along a right line across Allotment 405 of the aforesaid Waimana Parish, and again along the western boundary of Allotment 11 aforesaid to a point 250·00 links distant from the southern side of the aforesaid public road; thence again westerly generally along a right line 250·00 links distant from and parallel to the southern side of the aforesaid public road to its intersection with the eastern side of a public road forming the western boundary of part of Allotment 8 of the said Waimana Parish; thence northerly generally along the eastern side of the said public road and along a right line across another public road to the south-western corner of part Allotment 8, Waimana Parish, aforesaid, as shown on the plan numbered 22007, deposited in the office of the District Land Registrar at Auckland, and being a point on the boundary of the Borough of Whakatane, as described in New Zealand Gazette No. 109 of the 31st day of October, 1940, page 2781; thence easterly generally along the aforesaid borough boundary to the point of commencement.

WHEREAS, in pursuance of section three of the River Boards Amendment Act, 1913, a petition was presented to the Governor-General praying for the extension of the boundaries of the Kaikoura River District by the inclusion therein of a certain area of land:
And whereas, in pursuance of section twenty-four of the Local Government Commission Act, 1946, the said petition was referred to the Local Government Commission:
And whereas, in pursuance of the provisions of the Local Government Commission Act, 1946, the Local Government Commission has approved as final a scheme bearing date the twentieth day of December, one thousand nine hundred and forty-nine, providing for the inclusion of the area described in the Schedule to the said scheme in the Kaikoura River District:
And whereas it is deemed expedient to give effect to the final scheme as hereinafter appearing:
Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the Local Government Commission Act, 1946, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that as on and from the first day of April, one thousand nine hundred and fifty, the area described in the First Schedule hereto shall be included in the Kaikoura River District, and that the boundaries of the said district as so altered shall be those set forth in the Second Schedule hereto.

FIRST SCHEDULE
AREA INCLUDED IN KAIKOURA RIVER DISTRICT
ALL that parcel of land in the Marlborough Land District bounded as follows: Commencing at a point on the north bank of the Kahutara River where the Picton-Christchurch Main Highway crosses the river in Block IX, Mount Fyffe Survey District; thence to the mouth of the said river; thence in a northerly direction by the sea to the north bank of the Kowhai River taking in Sections 260, 259, 265, 286, and that portion of Section 123, Block IX, Mount Fyffe Survey District, not already included in the Kaikoura River District; thence following up the southern bank of the Kowhai River to the point at the northern corner of Block I, Greenburn Survey District; thence in a southerly direction to the western corner of the Fernleigh Settlement; thence following along the southern boundary of the Fernleigh Settlement to the northern corner of Section 96, Block V, Greenburn Survey District; thence following along the north-eastern boundaries of Sections 96, 97, 98, 99, and 100, Block V, Greenburn Survey District, to the eastern corner of Section 100, Block V, Greenburn Survey District; thence in a south-westerly direction along the south-eastern boundaries of Sections 100, 101, and 102, Block V, Greenburn Survey District, and the north-western boundary of the Kahutara Maori Block to the northern bank of the Kahutara River; thence in a southerly direction to the point of commencement.

SECOND SCHEDULE
BOUNDARIES OF KAIKOURA RIVER DISTRICT
ALL that area in the Marlborough Land District, situated in Greenburn and Mount Fyffe Survey Districts, and bounded as follows: Commencing at a point on the left bank of the Kowhai River at the westernmost corner of Section 1, Block VI, Mount Fyffe Survey District; thence proceeding in a northerly direction for a distance of 5 chains along the bank of the aforesaid river; thence westerly by a right line across the Kowhai River and north-westerly by the right bank of the said river to a point at the northernmost corner of Block I, Greenburn Survey District; thence southerly by a right line to the westernmost corner of the Fernleigh Settlement; thence by the western, south-western, and southern boundaries of the Fernleigh Settlement to the northern corner of Section 96, Block V, Greenburn Survey District; thence south-easterly by the north-eastern boundaries of Sections 96, 97, 98, 99, and 100, Block V, Greenburn Survey District, to the eastern corner of the said Section 100; thence south-westerly by the south-eastern boundaries of Sections 100, 101, and 102, Block V, Greenburn Survey District, and the north-western boundary of the Kahutara Maori Block to the left bank of the Kahutara River; thence by the left bank of the said river to the sea; thence easterly by the sea to the left bank of the Kowhai River at a point in line with the southern boundary of Section 286, Block IX, Mount Fyffe Survey District; thence easterly to and along the south boundary of the said Section 286, across a road and by the south boundary of Section 265, Block X, Mount Fyffe Survey District, to the easternmost corner of the said Section 265; thence westerly by the northern boundary of the said Section 265 to the south-eastern corner of Section 259, Block X, Mount Fyffe Survey District; thence northerly by the eastern boundary of the said Section 259 to a road and across that road; thence easterly by the northern side of the said road along the southern boundaries of Sections 127, 128, 132, 133, 197, 291, and 223, Block X, Mount Fyffe Survey District, to a point in line with the western boundary of Section 263, Block X, Mount Fyffe Survey District; thence southerly across the aforesaid road and by the western boundary of the said Section 263 to the south-western corner of the said Section 263; thence easterly by the southern boundary of Section 263 and a continuation of that boundary to Lyell Creek; thence down that creek to the sea and northerly by the sea to a point in line with the southern boundary of Section 161, Block VIII, Mount Fyffe Survey District; thence westerly to and along the south boundaries of the said Section 161, Sections 11R, 10R, 9R, 6R, 3R, 2R, and 1R, Rainford Settlement, Sections 167, 1 of 168, 169, and 2 of 170, Block VIII, Mount Fyffe Survey District, to a road and across that road to the south-east corner of Section 74, Block VII, Mount Fyffe Survey District; thence northerly along the said road to the north-eastern corner of the said Section 74; thence westerly by the southern boundaries of Sections 1 of 73, 72, 71, 70, 69, 68, and 67, Block VII, Mount Fyffe Survey District, to a road and across that road to the south-eastern corner of Section 66, Block VI, Mount Fyffe Survey District; thence northerly by the eastern boundary of the said Section 66 to a road and westerly by that road along the northern boundaries of Sections 66, 65, 64, 63, 62, and 61 to a point in line with the western boundary of Section 52, Block VI, aforesaid; thence northerly across the said road and by the western boundary of the said Section 52 to a road and across that road; thence westerly by the southern boundaries of Sections 5, 4, 3, and 2, Block VI, aforesaid, northerly by the western boundary of the said Section 2, and westerly across a road and by the northern boundary of Section 1, Block VI, Mount Fyffe Survey District, to the point of commencement.
