Consenting to the Raising of Loans by Certain Local Authorities and Prescribing the Conditions Thereof

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 22nd day of February, 1950

Present:

THE HON. S. G. HOLLAND PRESIDING IN COUNCIL

WHEREAS the several local authorities enumerated in the Schedule hereto, being desirous of raising the respective loans stated opposite their names therein, have respectively complied with the provisions of the Local Government Loans Board Act, 1926 (hereinafter called the said Act), and it is expedient that the precedent consent of the Governor-General in Council, as required by the said Act, should be given to the raising of the said loans:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the said Act, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the respective local authorities mentioned in the first column of the said Schedule of the respective loans set out in the second column of the said Schedule up to the respective amounts specified in the third column of the said Schedule, and in giving such consent doth hereby determine as follows:—

(1) The terms for which the said loans or any parts thereof may be raised shall be the respective terms (in years) stated in the fourth column of the said Schedule.

(2) The rates of interest that may be paid in respect of the said loans or any parts thereof shall be such as shall not produce to the lender or lenders a rate or rates exceeding the respective rates per centum per annum stated in the fifth column of the said Schedule.

(3) The said respective loans or any parts thereof, together with interest thereon, shall be repaid by equal aggregate annual or half-yearly instalments extending over the respective terms as determined in (1) above.

(4) The payment of such instalments shall be made in New Zealand, and no such instalment shall be paid out of loan-moneys.

(5) The rate payable for brokerage, underwriting, and procurement fees in respect of the raising of the said respective loans or any parts thereof shall not in the aggregate exceed one-half per centum of any amount raised.

(6) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

Constitution of Rural Fire District

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 22nd day of February, 1950

Present:

THE HON. S. G. HOLLAND PRESIDING IN COUNCIL

PURSUANT to the Forest and Rural Fires Act, 1947, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby constitute and declare the area described in the Schedule hereto to be a rural fire district, to be known as the “Puketitiri Rural Fire District”; and doth hereby specify the trees and other plants on the Puketitiri Scenic Reserve and the Hutchinson Domain in the said area as the property for the protection of which the district is constituted; and doth hereby specify the period between the first day of October in any one year and the thirtieth day of April in the following year (both days inclusive) as a closed fire season in the said district; and doth hereby declare that this Order in Council shall come into force and that the Puketitiri Rural Fire District shall become a rural fire district on the day following publication of this Order in Council in the Gazette; and doth hereby prescribe that the said Puketitiri Rural Fire District shall be administered for the purposes of the said Act by the Minister of Forests.

SCHEDULE

HAWKE’S BAY LAND DISTRICT.—WELLINGTON CONSERVANCY

Puketitiri Rural Fire District

ALL that area in the Hawke’s Bay Land District, Hawke’s Bay County, containing approximately 7,950 acres, situated in Blocks XIII and XIV, Pohui Survey District, and Blocks I and II, Patoka Survey District, and bounded generally as follows: Towards the north by Block 101, Patoka Crown Grant District, by the land shown on D.P. 1776, the crossing of Turner’s Road, by part of Block 95, Patoka Crown Grant District, Section 24, Block XIV, Pohui Survey District, and again by part of Block 95 aforesaid; towards the north-east by Lot 1 on D.P. 1355; towards the south-east by Sections 20 and 8, Block XV, Pohui Survey District, the eastern side of Carswell’s Road, by part of Rural Section 7 and Rural Section 6, Puketitiri Reserve on D.P. 2148, by Lot 10, on D.P. 6529, the crossing of a public road and again by the aforesaid Rural Section 6, Puketitiri Reserve; thence by part of Section 11, Block II, Patoka Survey District, the crossing of a public road and by the south-eastern side of a public road; towards the south-west by Section 91, Block II, aforesaid and Block 27, Patoka Crown Grant District; and towards the north-west by Block 93, Patoka Crown Grant District. As the same is more particularly delineated on plan No. 64/10, deposited in the Head Office of the New Zealand Forest Service at Wellington, and thereon bordered red.

WELLINGTON LAND DISTRICT.—WELLINGTON CONSERVANCY

Ngaumu Rural Fire District

ALL those areas in the Wellington Land District, Masterton County, containing approximately 9,600 acres and described generally as follows:—

All that area containing approximately 3,500 acres, situated in Blocks XII and XVI, Otahoua Survey District, and Blocks IX and XIII, Rewa Survey District, and bounded generally as follows: Towards the north generally by the northern side of the Fernyhurst Road; towards the east by the crossing of the aforementioned road and by part of Section 71 and by Section 78 of the Whareama Block; towards the south-east and north-east by Section 394 of the Whareama Block to Trig. Station “Piripi”; towards the south-east by a right line to Trig. Station “Manuka”; towards the south-west by right lines to Trig. Stations “Dispute” and “Kaitutai N”; towards the north-west by a right line from the last-mentioned Trig. Station to the south-eastern corner of part of Section 82, of the Pahaoa Block and by that Section to the Whakatahine River; and towards the west generally by the Whakatahini River, Section 65 of the Whareama Block and the crossing of the Fernyhurst Road.
