The Servicemen’s Settlement and Land Sales Act, 1943.—Notice of Intention to Take Land

THE Minister of Lands, acting in pursuance of section 24 of the Servicemen’s Settlement and Land Sales Act, 1943, hereby gives notice of his intention to take the land described in the Schedule hereto under Part II of the said Act, and specifies the 28th February, 1950, as the date on which possession of the land is required, and the 10th January, 1950, as the date on or before which objections may be made under section 25 of the said Act.

SCHEDULE

NORTH AUCKLAND LAND DISTRICT

ALL that parcel of land situated in Block XV, Kaihu Survey District, containing by admeasurement twenty-six (26) acres, more or less, being all of the land on Deposited Plan 3709, being part of Kaihu No. 1 Block, and being all of the land described in certificate of title, Vol. 133, folio 35 (Auckland Registry), appurtenant thereto being drainage rights created in and by Transfer No. 227098.

Also all that parcel of land situated in Block XV, Kaihu Survey District, containing by admeasurement twenty-seven (27) acres three (3) roods eight (8) perches, more or less, being all of the land on Deposited Plan 9886, being part of Kaihu No. 1 Block, and being all of the land described in certificate of title, Vol. 257, folio 163 (Auckland Registry), subject to a fencing covenant created in and by Transfer No. 75632, and appurtenant thereto being drainage rights created in and by Transfer No. 227098.

Also all that parcel of land situated in Block XV, Kaihu Survey District, containing by admeasurement one hundred and eleven (111) acres three (3) roods five (5) perches, being Lot 13 and part Lot 12 on Deposited Plan 911, being part of Aoroa Block, and being all of the land described in certificate of title, Vol. 873, folio 44 (Auckland Registry), appurtenant thereto being drainage rights created in and by Transfer No. 227098.

The Servicemen’s Settlement and Land Sales Act, 1943.—Notice Declaring Land Taken for the Settlement of Ex-servicemen

WHEREAS pursuant to section 24 of the Servicemen’s Settlement and Land Sales Act, 1943, notice was given of the intention of the Minister of Lands to take under Part II of the of the said Act the lands described in the First Schedule hereto, and a copy of the said notice was published in the New Zealand Gazette No. 46 on the 21st day of August, 1947, at page 1022 :

And whereas objections were made in the manner prescribed by the said Act by the owner of part of the said lands and by another person having an interest in part of the said lands ; objecting to the taking of the said lands :

And whereas the Minister of Lands did not revoke his notice of intention to take the said lands :

And whereas the Land Sales Committee to which such objections were referred did on the 10th day of February, 1948, make an order allowing such objections subject to the Crown being allowed to take a limited area of the said lands :

And whereas appeals were made against the said order by the owner of part of the said lands and by the Crown in the manner prescribed by the said Act :

And whereas the Land Valuation Court did further limit the area of the said lands which the Crown is allowed to take to the lands described in the Second Schedule hereto :

And whereas the owners have agreed to an amended vesting date :

And whereas the lands described in the said Second Schedule are not the lands of any serviceman, who is for the time being serving outside New Zealand in any of His Majesty’s Forces or in any British ship :

Now, therefore, the Minister of Lands, acting in pursuance of section 27 of the said Act doth hereby declare that the lands described in the said Second Schedule are taken for the settlement of discharged servicemen and hereby specifies the 2nd day of December, 1949, as the date on which the said lands shall be deemed to be vested in His Majesty the King.

FIRST SCHEDULE

WELLINGTON LAND DISTRICT

ALL that area situate in Block V, Kairanga Survey District, containing by admeasurement one hundred and three (103) acres three (3) roods six decimal two (6·2) perches, more or less, being part of Rural Section 346, Township of Carnarvon, and being also Lots 2, 3, and 4 on Deposited Plan No. 6360, and being all the land comprised and described in certificate of title, Vol. 488, folio 225 (Wellington Registry).

Also all that area situate in Blocks I and V, Kairanga Survey District, containing by admeasurement fifty-nine (59) acres eleven (11) perches, more or less, being part of Rural Section 346, Township of Carnarvon, and being also Lot 7 on Deposited Plan No. 1417, and being all the land comprised and described in certificate of title, Vol. 310, folio 239 (Wellington Registry).

Also all that area situate in Blocks I and V, Kairanga Survey District, containing by admeasurement fifty-nine (59) acres two (2) roods, more or less, being part of Rural Section 346, Township of Carnarvon, and being also Lot 8 on Deposited Plan No. 1417, and being all the land comprised and described in certificate of title, Vol. 137, folio 136 (Wellington Registry).

Also all that area situate in Block V, Kairanga Survey District, containing by admeasurement one hundred and thirty-five (135) acres three (3) roods twenty-seven (27) perches, more or less, being part of Rural Section 346, Township of Carnarvon, and being also Lots 10 and 11 on Deposited Plan No. 1417, and being all the land comprised and described in certificate of title, Vol. 138, folio 195 (Wellington Registry).

Also all that area situate in Block V, Kairanga Survey District, containing by admeasurement fifty-six (56) acres, more or less, being part of Rural Section 346, Township of Carnarvon, and being also Lot 9 on Deposited Plan No. 1417, and being part of the land comprised and described in certificate of title, Vol. 143, folio 181 (Wellington Registry).

SECOND SCHEDULE

WELLINGTON LAND DISTRICT

ALL that area situated in Blocks I and V, Kairanga Survey District, containing by admeasurement seventy-two (72) acres one (1) rood thirty-five (35) perches, more or less, being Lot 7 and part Lot 8 on the plan numbered 1417, deposited in the Land Registry Office at Wellington, being part Section 346, Township of Carnarvon, and being the whole of the land comprised and described in certificate of title, Vol. 310, folio 239, and part of the land comprised and described in certificate of title Vol. 137, folio 136 (Wellington Registry).

Also all that area situated in Block V, Kairanga Survey District, containing by admeasurement one hundred and fifty-four (154) acres three (3) roods twenty-five (25) perches, more or less, being Lot 11 and part Lots 9 and 10 on the plan numbered 1417, deposited in the Land Registry Office at Wellington, being part Section 346, Township of Carnarvon, and being part of the land comprised and described in certificate of title, Vol. 138, folio 195, and part of the land comprised and described in certificate of title, Vol. 530, folio 221 (Wellington Registry).

As the same are more particularly delineated on the plan lodged in the office of the Chief Surveyor at Wellington under No. S.O. 21905, and thereon edged orange.

Details : A submarine telephone cable has been laid commencing at a point 213° 2·5 cables from the above light, thence 112° to the eastern shore. Mariners are warned not to anchor in the vicinity of the above cable.
