Varying the Determinations in Respect of the Balance (£43,500) of
the Palmerston North City Council’s Loan of £58,500

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 16th day of
November, 1949

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

WHEREAS by Order in Council made on the twenty-second
day of June, one thousand nine hundred and forty-nine
(hereinafter called the said Order in Council) and subject to the
determinations as to borrowing and repayment therein set out,
consent was given to the raising in New Zealand by the Palmerston
North City Council (hereinafter called the said local authority) of
the sum of forty-three thousand five hundred pounds (£43,500)
(hereinafter called the said sum), being the balance of a loan of
fifty-eight thousand five hundred pounds (£58,500):

And whereas the authority conferred by the said Order in
Council has not yet been exercised and it is expedient to vary
certain of the determinations aforesaid in respect of the said sum:

Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and consent
of the Executive Council of the said Dominion, and in pursuance
and exercise of the powers and authorities conferred on him by
section eleven of the Local Government Loans Board Act, 1926,
as set out in section twenty-nine of the Finance Act, 1932 (No. 2),
and of all other powers and authorities enabling him in this behalf,
doth hereby vary certain of the determinations aforesaid in respect
of the said sum by prescribing that in lieu of provision being made
for the repayment of the said sum by the establishment of a sinking
fund in respect thereof, as specified in clause three of the said Order
in Council, the said sum or any part thereof, together with interest
thereon, shall be repaid by equal aggregate annual or half-yearly
instalments extending over the term of twenty-five (25) years as
specified in clause one of the said Order in Council.

the Christchurch Drainage Board’s Loan of £60,000

November, 1949

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

WHEREAS by Order in Council made on the nineteenth day of
November, one thousand nine hundred and forty-seven
(hereinafter called the said Order in Council), and subject to the
determinations as to borrowing and repayment therein set out, con-
sent was given to the raising in New Zealand by the Christchurch
Drainage Board (hereinafter called the said local authority) of a
loan of sixty thousand pounds (£60,000) to be known as “Sewerage
Loan No. 1, 1947” (hereinafter called the said loan):

And whereas the sum of four thousand pounds (£4,000) has
been raised and it is expedient to vary certain of the determinations
aforesaid in respect of balance of the said loan amounting to fifty-six
thousand pounds (£56,000) (hereinafter called the said sum):

Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, and in
pursuance and exercise of the powers and authorities conferred
on him by section eleven of the Local Government Loans Board
Act, 1926, as set out in section twenty-nine of the Finance Act,
1932 (No. 2), and of all other powers and authorities enabling him
in this behalf, doth hereby vary certain of the determinations
aforesaid in respect of the said sum by prescribing as follows:—

(1) In lieu of payment to sinking fund at a rate not less than
two pounds and fourpence (£2 0s. 4d.) as specified in clause three
of the said Order in Council, the rate of payment shall be not less
than two pounds two shillings (£2 2s.).

(2) No moneys shall be borrowed under the consent given by
the said Order in Council after the expiration of four (4) years from
the date thereof.

the Christchurch Drainage Board’s Loan of £172,000

November, 1949

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

WHEREAS by Order in Council made on the nineteenth day
of November, one thousand nine hundred and forty-seven
(hereinafter called the said Order in Council) and subject to the
determinations as to borrowing and repayment therein set out,
consent was given to the raising in New Zealand by the Christchurch
Drainage Board (hereinafter called the said local authority) of a
loan of one hundred and seventy-two thousand pounds (£172,000)
to be known as “New Brighton Sewerage Loan, 1947” (hereinafter
called the said loan):

And whereas the sum of eight thousand four hundred pounds
(£8,400) has been raised, and it is expedient to vary certain of the
determinations aforesaid in respect of balance of the said loan
amounting to one hundred and sixty-three thousand six hundred
pounds (£163,600) (hereinafter called the said sum):

Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and con-
sent of the Executive Council of the said Dominion, and in pursuance
and exercise of the powers and authorities conferred on him by
section eleven of the Local Government Loans Board Act, 1926,
as set out in section twenty-nine of the Finance Act, 1932 (No. 2),
and of all other powers and authorities enabling him in this behalf,
doth hereby vary certain of the determinations aforesaid in respect
of the said sum by prescribing as follows:—

(1) In lieu of payment to sinking fund at a rate not less than
one pound eleven shillings and sixpence (£1 11s. 6d.) as specified
in clause three of the said Order in Council, the rate of payment
shall be not less than one pound thirteen shillings and one penny
(£1 13s. 1d.).

(2) No moneys shall be borrowed under the consent given by
the said Order in Council after the expiration of four (4) years from
the date thereof.

Rotorua Borough Council Declared a Leasing Authority Under the
Public Bodies Leases Act, 1908

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 16th day of
November, 1949

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

WHEREAS the Rotorua Borough Council is a body of persons
having power to lease lands held in trust, reserved, or set
apart for public purposes, and has requested the Governor-General
in Council to declare it to be a leasing authority within the meaning
of the Public Bodies Leases Act, 1908:

Now, therefore, in compliance with such request and in exer-
cise of the powers in this behalf conferred by the above-mentioned
Act, His Excellency the Governor-General, acting by and with the
advice and consent of the Executive Council, doth hereby order and
declare that the Rotorua Borough Council is a leasing authority
within the meaning of the Public Bodies Leases Act, 1908.

Government Railways Appeal Board: Appointment of Chairman

PURSUANT to section ninety-one of the Government Railways
Act, 1949, I, Lieutenant-General, Sir Bernard Cyril Freyberg,
the Governor-General of the Dominion of New Zealand, hereby
appoint as a member and as Chairman of the Government Railways
Appeal Board, James Alexander Gilmour, of Wellington, Stipendiary
Magistrate, to hold office from and including the first day of
January, one thousand nine hundred and fifty, to and including
the thirty-first day of December, one thousand nine hundred and
fifty-two.

As witness the hand of His Excellency the Governor-General,
this 17th day of November, 1949.

Trustees for the Raurimu Public Cemetery Appointed

PURSUANT to section four of the Cemeteries Act, 1908, I,
Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-
General of the Dominion of New Zealand, do hereby appoint

Lionel Cecil Valentine, and
Robert Henry Wheeler

to be trustees to have the maintenance and care of the cemetery
under the said Act known as the Raurimu Public Cemetery in
conjunction with such of the other persons heretofore so appointed
as are still in office and in the place of

Walter Francis Johnston, and
Herbert John King

whose seats have become vacant by resignation.

As witness the hand of His Excellency the Governor-General
this 11th day of November, 1949.
