Consenting to the Raising of a Loan of £15,600 by the Murchison County Council and Prescribing the Conditions Thereof

ORDER IN COUNCIL

At the Government House at Wellington, this 2nd day of February, 1949

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS the Murchison County Council (hereinafter called the said local authority), being desirous of raising a loan of fifteen thousand six hundred pounds (£15,600), to be known as “Maruia Hydro Development Loan, 1948” (hereinafter called the said loan), for the purpose of developing a hydro-electric plant on the Maruia River and constructing a transmission-line from the proposed power-house to Murchison Township, has complied with the provisions of the Local Government Loans Board Act, 1926 (hereinafter called the said Act), and it is expedient that the precedent consent of the Governor-General in Council, as required by the said Act, should be given to the raising of the said loan:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the said Act, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the said loan for the said purpose up to the amount of fifteen thousand six hundred pounds (£15,600), and in giving such consent doth hereby determine as follows:—

(1) The term for which the said loan or any part thereof may be raised shall not exceed twenty (20) years.

(2) The rate of interest that may be paid in respect of the said loan or any part thereof shall be such as shall not produce to the lender or lenders a rate or rates exceeding three pounds five shillings (£3 5s.) per centum per annum.

(3) The said loan shall be free of principal repayments during the first year from the date of the borrowing thereof.

(4) Thereafter the said loan, together with interest thereon, shall be repaid by equal aggregate annual or half-yearly instalments extending over the balance of the term amounting to nineteen (19) years.

(5) The payment of interest for the first year and thereafter the payment of the instalments of principal and interest shall be made in New Zealand.

(6) No interest after the first year and no instalments of principal and interest shall be paid out of loan-moneys.

(7) The rate payable for brokerage, underwriting, and procurement fees in respect of the raising of the said loan or any part thereof shall not in the aggregate exceed one-half per centum of any amount raised.

(8) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

Varying the Determinations in Respect of Portion (£4,000) of the Thames Valley Electric-power Board’s Loan of £10,000

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by Order in Council made on the fifteenth day of September, one thousand nine hundred and forty-eight, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Thames Valley Electric-power Board (hereinafter called the said local authority) of a loan of ten thousand pounds (£10,000), to be known as “Workers’ Dwellings Loan, 1948” (hereinafter called the said loan):

And whereas the authority conferred by the said Order in Council has not yet been exercised, and it is expedient to vary certain of the determinations aforesaid in respect of portion of the said loan amounting to four thousand pounds (£4,000) (hereinafter called the said sum):

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said sum by prescribing that in lieu of a term of twenty-five (25) years, as specified in clause one of the said Order in Council, the term for which the said sum or any part thereof may be raised shall not exceed twenty (20) years.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for broadcasting purposes.

SCHEDULE

APPROXIMATE area of the piece of land permitted to be taken: 28 acres 2 roods 24 perches.

Being part Allotment 2, Whangarei Parish.

Situated in Block VIII, Purua Survey District, and Block V, Whangarei Survey District (Auckland R.D.). (S.O. 35455.)

In the North Auckland Land District; as the same is more particularly delineated on the plan marked P.W.D. 128455, deposited in the office of the Minister of Works at Wellington, and thereon coloured yellow.

Declaring Portion of the Kaimatarau Farm Settlement Road in the Manawatu County to be County Road

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section one hundred and twelve of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become county road.

SCHEDULE

ALL that portion of road in the Wellington Land District, Manawatu County, situated in Block VIII, Te Kawau Survey District, known as Kaimatarau Farm Settlement Road, commencing at its junction with Kaimatarau Road and proceeding thence in a southerly direction adjoining Rural Sections 591, 592, 594, 595, and 596, Township of Carnarvon (Kaimatarau Farm Settlement), and Lot 3, D.P. 14081, being part of Rural Section 384, Township of Carnarvon, and terminating at the north-west boundary of Rural Section 596, Township of Carnarvon (Kaimatarau Farm Settlement), being a distance of approximately 34 chains. As the same is more particularly delineated on the plan marked P.W.D. 128342, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
