A PROCLAMATION

PURSUANT to the Public Works Act, 1928, I, Lieutenant-General Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby proclaim and declare that the portions of public reserve described in the Schedule hereto are hereby taken for housing purposes; and I do also declare that this Proclamation shall take effect on and after the thirty-first day of October, one thousand nine hundred and forty-nine.

In the South Auckland Land District; as the same are more particularly delineated on the plans marked as above mentioned, deposited in the office of the Minister of Works at Wellington, and thereon coloured sepia.

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 19th day of October, 1949.

Defining the Middle-line of a Portion of the Auckland-Hamilton Motor-way in Blocks VI, X, and XI, Otahuhu Survey District

A PROCLAMATION

PURSUANT to section four of the Public Works Amendment Act, 1947, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby proclaim and declare that the middle-line of a motor-way desired to be constructed in Blocks VI, X, and XI, Otahuhu Survey District—viz., a portion of the Auckland-Hamilton motor-way—shall be that defined and set forth in the Schedule hereto; and I do also declare that this Proclamation shall affect only that land situated within the limits coloured red on the plan marked P.W.D. 130083, referred to in the Schedule hereto.

SCHEDULE

COMMENCING at a point on the south-eastern side of Luke Street near the south-western corner of part Allotment 3, Small Farms near Otahuhu, and proceeding thence in a south-easterly direction generally for a distance of approximately 4 miles 31·5 chains, and passing in, into, through, or over the following lands, &c., viz.—part Allotment 3; Lot 1, D.P. 33105, being part Allotment 8; Allotment 19; Lot 1, D.P. 18216, being part Allotment 26; Allotment 30; Allotment 34, and part Allotment 35 on D.P. 25406, Small Farms near Otahuhu; Lot 6, D.P. 33172, and Lot 14, D.P. 33172, being parts Fairburn’s Old Land Claim No. 269A; Tamaki River; Lot 4, D.P. 9819, being part Allotment 2; Lots 5 and 6, D.P. 9819, being part Allotments 2 and 3; Lot 8, D.P. 9819, being part Allotment 3 in Proclamation 11891; Lot 1, D.P. 27223, being part Allotment 11; Lot 20, D.P. 6873, Lot 19, D.P. 6873, and Lot 1, D.P. 10065, being parts Allotment 12; Lot 8, D.P. 30135, part Lot 2, D.P. 18845, and Lot 2, D.P. 31934, being parts Allotment 18; part Allotments 18 and 19, part Allotment 19, part Allotments 19 and 20 on D.P. 4510; part Lot 2, D.P. 11457, being part Allotment 20; part Allotment 20; Lot 14, D.P. 20412, Lot 13, D.P. 20412, and Lot 7, D.P. 20412, being parts Allotment 40, Parish of Manurewa; part Clendon’s Grant on D.P. 24323; Lot 1, D.P. 5201, being part Clendon’s Grant; part Clendon’s Grant, and Lots 2 and 3, D.P. 9254, being parts Clendon’s Grant in the Parish of Papakura; and terminating at a point on the southern side of Redoubt Road approximately 8·5 chains eastwards of its intersection with the Auckland-Hamilton Main Highway No. 7, including all adjoining and intervening places, lands, reserves, roads, tracks, lakes, rivers, streams, and water-courses; all in the North Auckland Land District. As the same is delineated on the plan marked P.W.D. 130083, deposited in the office of the Minister of Works at Wellington.

COMMENCING at a point on the south-eastern side of Commissariat Road forming the western boundary of Lot 5, D.P. 20687, approximately 18·5 chains eastwards of its intersection with the Auckland-Hamilton Main Highway No. 7, being the southern terminal point of the middle-line of a motor-way described in New Zealand Gazette 1949, page 1002, and proceeding thence in a south-easterly and southerly direction generally for a distance of approximately 2 miles 17·5 chains and passing in, into, through or over the following lands, &c., viz.—part Lot 5, D.P. 20687, being part Allotment 29 of Section 12, Suburbs of Auckland; part Lot 2 of a subdivision of part Hamlin’s Grant; part Hamlin’s Grant; part Hamlin’s Grant on D.P. 6564; part Hamlin’s Grant in Proclamation 11632; part Hamlin’s Grant in Proclamation 11695; Railway Land in Proclamations 5712 and 6376; Section 3, Block II, Otahuhu Survey District; part Hamlin’s Grant; Lots 68 and 69, D.P. 10490; Lot 86, D.P. 10490; Lot 87, D.P. 8491, Lots 1, 2 and 3, D.P. 28217, and Lot 98, D.P. 8491, being parts Hamlin’s Grant; part Hamlin’s Grant on D.P. 16881; Otahuhu Creek; Lot 1, D.P. 30403 and Lot 2, D.P. 28645, being parts Allotment 47, Small Farms near Otahuhu; and terminating at a point on the south-eastern side of Luke Street, including all adjoining and intervening places, lands, reserves, roads, tracks, lakes, rivers, streams, and water-courses; all in the North Auckland Land District. Amending the Constitution of a Rural Fire District

ORDER IN COUNCIL

At the Government House at Wellington, this 19th day of October, 1949

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Forests and Rural Fires Act, 1947, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby make the following Order:—

  1. The Order in Council dated the seventeenth day of November, one thousand nine hundred and forty-eight, and published in the Gazette on the eighteenth day of the same month at page 1398 (hereinafter referred to as the said Order in Council), is hereby amended as follows:—

(a) By omitting from the second column of the Second Schedule the number “1,970”, and substituting the number “1,050”;

(b) By omitting from the second column of the Second Schedule the number “1,050”, and substituting the number “1,970”.

  1. The regulations made by the said Order in Council are hereby amended by repealing Regulation 2, and substituting the following regulation:—

“2. The Rural Fire Committee Regulations 1949, so far as they are applicable and with the necessary modifications, shall apply to the district, and these regulations shall be deemed to be special regulations for the purpose of those regulations.”

  1. The regulations made by the said Order in Council are hereby further amended by revoking subclause (2) of Regulation 3, subclauses (2), (3), and (4) of Regulation 4, and Regulations 5 to 19.
