Varying the Determinations in Respect of the Balance (£10,000) of the Dunedin City Council’s Loan of £100,000 by Extending the Term Within Which the Said Sum May be Borrowed

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 10th day of August, 1949

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

WHEREAS by Order in Council made on the ninth day of June, one thousand nine hundred and thirty-nine, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Dunedin City Council (hereinafter called the said local authority) of a loan of one hundred thousand pounds (£100,000), to be known as “Public Works Loan, 1938” (hereinafter called the said loan):

And whereas by Order in Council made on the twenty-seventh day of August, one thousand nine hundred and forty-seven, the determinations aforesaid were varied in respect of a portion of the said loan amounting to thirty thousand pounds (£30,000) by extending the period within which such sum of thirty thousand pounds (£30,000) or any portion thereof might be raised to the twenty-seventh day of August, one thousand nine hundred and forty-nine:

And whereas the sum of ten thousand pounds (£10,000) (hereinafter called the said sum) has still not yet been raised, and it is expedient to again vary the determinations aforesaid in respect of the said sum by further extending the period within which the said sum or any portion thereof may be raised:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said sum by prescribing that no moneys shall be borrowed under the consent given by the Order in Council made on the ninth day of June, one thousand nine hundred and thirty-nine, after the twenty-seventh day of August, one thousand nine hundred and fifty-one.

Authorizing the Laying-off of a Street (Brentwood Avenue Extension) in the Borough of Mount Eden

ORDER IN COUNCIL

At the Government House at Wellington, this 24th day of August, 1949

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section thirty-one of the Municipal Corporations Amendment Act, 1948, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby authorize the Mount Eden Borough Council to lay-off the proposed street described in the Schedule hereto at a width for the whole of its length of less than sixty-six feet, but not less than fifty feet.

SCHEDULE

THAT proposed street in the North Auckland Land District, Borough of Mount Eden, containing by admeasurement 22·9 perches, more or less, being portion of Allotment 10, Section 10, Suburbs of Auckland, and Lot 2, D.P. 3818, being portion of the said Allotment 10. As the same is more particularly delineated on the plan marked P.W.D. 127909, deposited in the office of the Minister of Works, at Wellington, and thereon coloured red.

Authorizing the Laying-off of a Street off Awakino Road, in the Borough of Te Kuiti, Subject to a Condition as to the Building-line

ORDER IN COUNCIL

At the Government House at Wellington, this 24th day of August, 1949

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section thirty-one of the Municipal Corporations Amendment Act, 1948, and section one hundred and twenty-five of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby authorize the Te Kuiti Borough Council to permit the laying-off of the proposed street described in the Schedule hereto at a width for part of its length of less than sixty-six feet, but not less than forty feet, subject to the condition that no building or part of a building shall at any time be erected on the part of Lot 6, D.P. 4581, being portion of Pukenui 2d No. 7B Section 1 Block, fronting the southern side of portion of the proposed street, within a distance of forty-eight feet from the centre-line of the said street.

SCHEDULE

THE proposed street in the South Auckland Land District, Borough of Te Kuiti, containing by admeasurement 1 rood 11·6 perches, more or less, being part Lot 6, D.P. 4581, being portion of Pukenui 2d No. 7B Section 1 Block. As the same is more particularly delineated on the plan marked P.W.D. 129436, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Consenting to Land Being Taken for Housing Purposes in the City of Wanganui

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for housing purposes.

SCHEDULE

APPROXIMATE area of the piece of land permitted to be taken:
2 roods.

Being Lots 21 and 22 of Block V, on D.P. 2224, being part Section 30, Right Bank, Wanganui River, and being the whole of the land comprised and described in Certificate of Title, Volume 398, folio 111 (Wellington Land Registry).

PURSUANT to section one hundred and forty-nine of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the Raglan County Council stopping the portions of road described in the Schedule hereto.
