Price Order No. 1064 (Maize)
PURSUANT to the Control of Prices Act, 1947, the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following Price Order:—
PRELIMINARY

This Order may be cited as Price Order No. 1064, and shall come into force on the 18th day of August, 1949.

(1) Price Order No. 737* is hereby revoked.
(2) The revocation of the said Order shall not affect the liability of any person for any offence in relation thereto committed before the coming into force of this Order. -
In this Order, unless the context otherwise requires—
“Grower”, in relation to maize, means a person engaged in the business of growing maize for sale :
“Grower’s station”, in relation to any grower, means the railway-station that is nearest or most convenient of access to the grower’s premises :
“Distributor”, in relation to maize, means any person who buys maize from a grower for the purposes of resale :
“Retailer”, in relation to maize, means any reseller other than a distributor :
The expression “f.o.b.s.e.” means “free on board, sacks extra”; and the expression “f.o.r.s.e.” means “free on rail, sacks extra”:
The expression “f.o.b.s.i.” means “free on board, sacks included”; and the expression “f.o.r.s.i.” means “free on rail, sacks included”. -
Where any maize to which this Order applies is sold on the basis of “sacks extra”, the maximum price that may be charged or received for the maize shall be computed on the net weight of the maize.

Where any maize to which this Order applies is sold on the basis of “sacks included”, the maximum price that may be charged or received for the maize shall be computed on the gross weight of the maize and the sacks.

Subject to any general or specific directions that may be given by or on behalf of the Tribunal, any expenses that are reasonably incurred by a distributor in undertaking the transport of any maize at his own expense may be regarded for the purposes of this Order as if they were transport charges paid by him, and the maximum price of the maize shall be determined accordingly: provided that transport charges shall not be more in any case than the charges that would have been incurred had delivery been effected at common carrier rates.

The provisions of this Order shall apply notwithstanding that any maize to which this Order is applicable is sold otherwise than by weight.

The maximum prices fixed by this Order apply with respect to sales by auction as well as to other sales.
APPLICATION OF THIS ORDER
- (1) Subject to the following provisions of this clause, this Order applies with respect to all maize sold in New Zealand.
(2) Nothing in this Order shall apply with respect to maize of the varieties Motiti Island, Marigold, 90 Day, Silver Queen, or Early Butler sold during the months of July to October, inclusive, in any year by a grower exclusively for seed for the purposes of producing maize for green feed.
(3) The provisions of this Order fixing growers’ prices shall apply only with respect to maize grown in New Zealand.
FIXING MAXIMUM PRICES OF MAIZE THAT IS SUBJECT TO THIS ORDER
Growers’ Prices
- (1) Subject to the following provisions of this clause, the maximum price that may be charged or received by any grower for any maize to which this Order applies shall be—

(2) The maximum prices fixed as aforesaid are fixed as for—
(a) Delivery f.o.b.s.e. (in the case of maize delivered for shipment at any of the ports of Gisborne, Opotiki, Tolaga Bay, Whakatane, Tokomaru Bay, or Tauranga); and
(b) Delivery f.o.r.s.e. the grower’s station (with respect to all other sales).
(3) Where delivery is effected by a grower on the basis of f.o.r.s.i., the maximum price shall be the appropriate price fixed by subclause (1) hereof for sales on a sacks extra basis reduced by 1½d. per bushel and then increased by the appropriate price of the sacks computed in accordance with the provisions of clause 14 of this Order.
(4) Where any maize to which this Order applies is delivered by the grower elsewhere than at one of the ports referred to in paragraph (a) of subclause (2) hereof, or elsewhere than at the grower’s station, the maximum price that may be charged by the grower shall be the appropriate price fixed in accordance with the foregoing provisions of this clause, increased by the amount of the charges (if any) incurred by the grower in effecting delivery and then reduced by the amount of the transport charges that would have been incurred by him if he had delivered the maize f.o.b.s.e. such one of the aforesaid ports or f.o.r.s.e. such railway station as would have been appropriate in the circumstances of the case.
DISTRIBUTORS’ PRICES
- The maximum price that may be charged or received by any distributor for any maize to which this Order applies shall not exceed the sum of the following amounts:—
(a) The price actually paid or payable to the grower for the maize:
(b) Any transport, branding, dressing, or insurance in transit charges actually and reasonably incurred by the distributor:
(c) An amount not exceeding 1 per cent. of the sum of the amounts calculated in accordance with paragraphs (a) and (b) hereof (to cover the estimated loss due to shrinkage and other causes):
(d) The amount of any through-store charges actually incurred by the distributor, but not more in any case than an amount calculated at the rate of 2½d. per bushel:
(e) An amount calculated at the rate per bushel as follows:—

RETAILERS’ PRICES
- Subject to the following provisions of this clause, the maximum price that may be charged or received by any retailer for any maize to which this Order applies shall be the sum of the following amounts:—
(a) The cost of the maize to the retailer at the point at which he takes delivery, but not more in any case than the cost that would have been incurred had the retailer purchased the maize in lots of ½ ton or more:
(b) The amount of any transport charges incurred by the retailer in obtaining delivery of the maize into his store, being not more in any case than the charges that would have been incurred had delivery been effected at common carrier rates:
(c) An amount calculated at the rate per bushel as follows:—
(i) For maize sold in sack lots: 1s. per bushel;
(ii) For maize sold in lots of ½ bushel or more but less than one sack: 1s. 9d. per bushel;
(iii) For maize sold in lots of less than ½ bushel: 2s. 6d. per bushel.
SALES OF SPECIAL SAMPLES AND VARIETIES
- The Tribunal, on application by any person concerned and subject to such conditions (if any) as it thinks fit, may authorize special prices or margins of profit for special samples and varieties of maize intended to be sold exclusively for seed purposes. Any authority given by the Tribunal under this clause may apply with respect to a specified lot or consignment of maize or may relate generally to all such special samples and varieties sold while the approval remains in force.
PROVISION WITH RESPECT TO SACKS
- The maximum amount by which the price of any maize sold by a grower or distributor shall be increased by reason of the charge imposed for the sacks containing the maize shall be computed as follows:—

PROVISION FOR SPECIAL PRICES WHERE EXTRAORDINARY CHARGES INCURRED
- Notwithstanding anything in the foregoing provisions of this Order, and subject to such conditions, if any, as it thinks fit, the Tribunal, on application by any grower, distributor, or retailer may authorize special maximum prices in respect of any maize to which this Order applies where special circumstances exist or for any reason extraordinary charges (freight or otherwise) are incurred by the grower, distributor, or retailer. Any authority given by the Tribunal under this clause may apply with respect to a specified lot or consignment of maize or may relate generally to all maize to which this Order applies sold by the grower, distributor, or retailer, while the approval remains in force.
