Price Order No. 1066 (Amendment No. 1 of Price Order No. 1007)
(Imported Goods—Apparel and Fabrics)

PURSUANT to the Control of Prices Act, 1947, the Price Tribunal,
acting with the authority of the Minister of Industries and
Commerce, doth hereby make the following amending Price Order:—

  1. This Order may be cited as Price Order No. 1066, and shall
    be read together with and deemed part of Price Order No. 1007*
    (hereinafter referred to as the principal order).

  2. This Order shall come into force on the 19th day of August,

  3. The principal Order is hereby amended by omitting from
    paragraph (b) of the Schedule thereto the word “related.”

Price Order No. 1065 (Maize Sold for Seed for Green-feed Purposes)

PURSUANT to the Control of Prices Act, 1947, the Price Tribunal,
acting with the authority of the Minister of Industries and
Commerce, doth hereby make the following Price Order :—

  1. This Order may be cited as Price Order No. 1065, and shall
    come into force on the 18th day of August, 1949.

  2. (1) Price Order No. 925* is hereby revoked.

(2) The revocation of the said Order shall not affect the
liability of any person for any offence in relation thereto
committed before the coming into force of this Order.

  1. (1) In this Order—

“Grower”, in relation to maize, means a person engaged in
the business of growing maize for sale ;

“Grower’s station”, in relation to any grower, means the
railway-station that is nearest or most convenient of
access to the grower’s premises ;

The expression “f.o.b.s.e.” means “free on board, sacks or
other containers extra”, and the expression “f.o.r.s.e.”
means “free on rail, sacks or other containers extra”.

(2) The provisions of this Order shall apply notwithstanding
that any maize to which the Order applies is sold otherwise than by
weight.

APPLICATION OF THIS ORDER

  1. This Order applies only to maize of the following varieties :—
    Motiti Island, Marigold, 90 Day, Silver Queen, and Early
    Butler when sold by a grower exclusively for seed for the
    purposes of producing maize for green feed.

FIXING MAXIMUM PRICES OF MAIZE TO WHICH THIS ORDER APPLIES

  1. (1) Subject to the following provisions of this clause, the
    maximum price that may be charged or received by any grower for
    any maize to which this Order applies when sold to any person other
    than a wholesale distributor shall be—

Per Bushel.

For maize sold for delivery during the month of July s. d.
in any year 9 6
For maize sold for delivery during the month of August
in any year 9 8
For maize sold for delivery during the month of Sep-
tember in any year 9 9
For maize sold for delivery during the month of
October in any year 9 10

(2) The maximum prices fixed as aforesaid are fixed as for—

(a) Delivery f.o.b.s.e. (in the case of maize delivered for ship-
ment at any of the ports of Gisborne, Opotiki, Whakatane,
Tolaga Bay, Tokomaru Bay, and Tauranga) ; and

(b) Delivery f.o.r.s.e. the growers’ station (with respect to all
other sales).

(3) Where any maize to which this Order applies is delivered
by the grower elsewhere than at one of the aforesaid ports, or else-
where than at the grower’s station, the maximum price that may be
charged by the grower shall be the appropriate price in terms of
subclause (1) hereof increased by the amount of the charges (if any)
incurred by the grower in effecting delivery and then reduced by
the amount of the charges that would have been incurred by him
if he had delivered the maize f.o.b.s.e. such one of the aforesaid
ports, or f.o.r.s.e. such railway-station as would have been appropriate
in the circumstances of the case.

(4) The maximum price that may be charged or received by
any grower for any maize sold by him to a wholesale distributor
shall be the price in accordance with the foregoing provisions of
this clause with respect to other sales reduced by an amount equal
to 5 per cent. of the said price.

Price Order No. 1063 (Cream Sold to Cream-vendors)

PURSUANT to the Control of Prices Act, 1947, the Price
Tribunal, acting with the authority of the Minister of Industries
and Commerce, doth hereby make the following Price Order :—

PRELIMINARY

  1. This Order may be cited as Price Order No. 1063, and shall
    come into force on the 1st day of September, 1949.

  2. (1) Price Orders No. 680,* 763†, 938‡, and 988§ are hereby
    revoked.

(2) The revocation of the said Orders shall not affect the liability
of any person for any offence in relation thereto committed before
the coming into force of this Order.

  1. (1) In this Order, unless the context otherwise requires—

“Cream” has the same meaning as in regulations made
under the Sale of Food and Drugs Act, 1908 :

“Cream-vendor” means a person who sells cream by way
of retail sale, but does not include—

(a) A person occupying a shop where cream is sold
for consumption or use off the premises and not other-
wise and where the cream is sold in the form in which
it is received into the shop; or

(b) A person who sells cream for consumption on
his premises (whether in the form in which it is received
by him or otherwise and whether separately or in
combination with any other substance or substances) :

“Gallon” when used with reference to cream, means 9-95 lb.
by weight or 160 fluid ounces by measure.

“Ounce” means fluid ounce as defined in the Weights and
Measures Proclamation, 1946||.

(2) References in this Order to milk price districts are references
to the following milk price districts :—

Akaroa, Amberley, Arapuni, Ashburton, Balclutha, Bay of
Islands, Bluff, Bulls-Sanson, Cambridge, Christchurch
Metropolitan, Clyde, Cromwell, Culverden, Dannevirke,
Dargaville, Dunedin Metropolitan, Edendale, Eketahuna,
Eltham, Fairlie, Fielding, Foxton, Geraldine, Gisborne,
Gore, Hamden, Hawarden, Hawera, Helensville, Hokitika,
Huntly, Inglewood, Invercargill, Kaiapoi-Rangiora,
Kaikohe, Kaikoura, Kaitaia, Kaponga, Katikati, Kurow,
Lawrence, Levin, Lumsden, Manaia, Marton, Matamata,
Mataura, Methven, Middlemarch, Milton, Morrinsville,
Motueka, Mount Maunganui, Murchison, Napier-Hastings,

Puke, Thames, Timaru, Tuatapere, Waihi, Waikouaiti,
Waimate, Waipawa, Waipukurau, Wairoa, Waitara,
Wakefield-Brightwater, Wanganui, Warkworth, Waverley,
Wellsford, Westport, Whakatane, Whangarei, Winton,
Woodville, and Wyndham (being the districts defined in
Price Order No. 1058)¶, Auckland Metropolitan and
Hamilton (being the districts defined in Price Order No.
1059),** Blenheim, Greymouth, and Lyttelton (being the
districts defined in Price Order No. 1062)††, Hutt Valley
and Bays Metropolitan and Wellington (West Coast)
(being the district defined in Price Order No. 1061)‡‡,
and Taumarunui (being the district defined in Price Order
No. 1060)§§.

APPLICATION OF THIS ORDER

  1. This Order applies only with respect to cream sold to a
    cream-vendor for sale by way of retail in any milk price district to
    which this Order applies during the months of January to December
    (inclusive) in any year.

FIXING MAXIMUM PRICES OF CREAM TO WHICH THIS ORDER APPLIES

  1. The maximum price that may be charged or received for
    any cream to which this Order applies shall be—

For ¼ pint bottles, or 4 oz. cartons: 6d. each.
For ½ pint bottles, or 8 oz. cartons: 1s. each.
For 1 pint bottles, or 16 oz. cartons: 2s. each.
For loose cream in a quantity of less than 2 pints: At the
rate of 2s. per pint.
For loose cream in a quantity of 2 pints or more: At the rate
of 15s. 8d. per gallon.
