easterly generally along the said northern side and along a right line, being that side produced to the mean high-water mark of the Waikareao Estuary; thence again southerly generally along the said mean high-water mark, and across the mouth of the Kopuririrua Stream to a point on the Tauranga Borough Boundary as described in New Zealand Gazette No. 51, of the 5th day of July, 1946, page 1022, due east of peg No. IV as shown on the plan numbered 20672, lodged in the office of the Chief Surveyor at Auckland; thence again southerly generally along the borough boundary aforesaid to the southern side of the Paeroa-Whakatane State Highway; thence westerly generally along the said southern side, to and along the south-eastern, south-western, and north-western sides of a public road dedicated by Transfer No. 252228, lodged in the office of the District Land Registrar at Auckland, to and along the southern side of another part of the said Paeroa-Whakatane State Highway, to and along the north-western boundary of the land comprised and described in Certificate of Title, Volume 637, folio 71, being parts of Allotments 368 and 372 aforesaid, to and along the eastern and north-eastern boundaries of Lot 1 as shown on the plan numbered 17807, deposited as aforesaid, being part of Allotment 79, of the said Te Papa Parish, to and along the north-eastern boundary of part Allotment 79, Te Papa Parish aforesaid, as shown on the plan numbered 7410 aforesaid, and along a right line being that boundary produced to the point of commencement.

Altering Boundaries of Counties of Whakatane and Opotiki and Adding Area to Taneatua Riding, County of Whakatane

At the Government House at Wellington, this 29th day of June, 1949
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS, in pursuance of section fourteen of the Counties Act, 1920, a petition was presented to the Governor-General praying that a certain area be excluded from the County of Opotiki and included in the County of Whakatane:
And whereas, in pursuance of section twenty-four of the Local Government Commission Act, 1946, the said petition was referred to the Local Government Commission:
And whereas, in pursuance of the provisions of the Local Government Commission Act, 1946, the Local Government Commission has made inquiry into the proposal and has approved as final a scheme bearing date the tenth day of December, one thousand nine hundred and forty-eight, providing for the exclusion of the area described in the Schedule to the said scheme from the County of Opotiki and the inclusion of such area in the County of Whakatane:
And whereas it is deemed expedient to give effect to the final scheme and to make supplementary provisions for giving full effect to such scheme:
Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the Local Government Commission Act, 1946, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that as on and from the first day of July, one thousand nine hundred and forty-nine, the area described in the First Schedule hereto shall be excluded from the County of Opotiki and included in the County of Whakatane; that the boundaries of the Counties of Whakatane and Opotiki as so altered shall be those set forth under the respective headings in the Second Schedule hereto; that the area added as aforesaid to the County of Whakatane shall be included in the Taneatua Riding of that county; that the boundaries of the Taneatua Riding as so altered shall be those set forth in the Third Schedule hereto; and, with the like advice and consent, doth hereby also declare that the alteration of boundaries of the said counties hereinbefore made shall be deemed to have been effected under the Counties Act, 1920.
FIRST SCHEDULE
AREA EXCLUDED FROM COUNTY OF OPOTIKI AND INCLUDED IN COUNTY OF WHAKATANE
ALL that area containing approximately 4,000 acres, being part of the Opotiki County, and situated in Blocks II, III, V, VI, and VII, Whakatane Survey District, bounded by a line commencing at a point in Block III aforesaid at the eastern end of Ohope Beach, being the westernmost corner of Lot 140 (Recreation Reserve) as shown on the plan numbered 22193, deposited in the office of the District Land Registrar at Auckland, being part of Allotment 246A, No. 2, Waimana Parish, and running easterly along the shore of the Bay of Plenty to the eastern extremity of Ohope Land Spit; thence due south along a right line for a distance of 500 links;
thence due south-west along a right line to its intersection with a right line from the southern extremity of Allotment 249, Waimana Parish (Ohakana Island), passing through a point 100 links due north of the northern extremity of Section 284, Waimana Parish (Uretara Island); thence westerly along the last-mentioned right line to the southern extremity of Allotment 249 aforesaid and a right line to a point distant 1,000 links from and due west of the northern extremity of Allotment 127, Waimana Parish (Whitiwhiti Point); thence south-westerly along a right line to a point, being the intersection of the northern boundary of that part of Lot 2, to the north-west of Wainui Road, as shown on the plan numbered 12843, deposited as aforesaid, with the mean high-water mark of the Ohiwa Harbour aforesaid; thence westerly generally along the said northern boundary and along a right line being the last-mentioned boundary produced across the aforesaid Wainui Road to its western side; thence northerly generally along the boundary of the Whakatane County as described in New Zealand Gazette No. 109 of the 31st day of October, 1940, page 2780, to the point of commencement.
SECOND SCHEDULE
COUNTY OF WHAKATANE
ALL that area in the South Auckland and Gisborne Land Districts bounded by a line commencing at a point in Block IV, Waihi South Survey District, on the shores of the Bay of Plenty, being the north-eastern corner of Waewaehikitia No. 1 Block and running south-easterly generally along the said shores to the eastern extremity of the Ohope Land Spit, being a point on the western shore of the entrance to Ohiwa Harbour; thence due south along a right line for a distance of 500 links; thence due south-west along a right line to its intersection with another right line from the southern extremity of Allotment 249, Waimana Parish (Ohakara Island), and passing through a point 100 links due north of the northern extremity of Section 284, Waimana Parish (Uretara Island); thence westerly generally along the last-mentioned right line to the southern extremity of Allotment 249 aforesaid and along a right line to a point 1000 links distant from and due west of the northern extremity of Allotment 127, Waimana Parish (Whitiwhiti Point); thence along another right line to a point being the intersection of the northern boundary of that part of Lot 2, to the north-east of Wainui Road, as shown on the plan numbered 12843, deposited in the office of the District Land Registrar at Auckland, being part Allotment 245, Parish of Waimana, with the mean high-water mark of Ohiwa Harbour aforesaid; thence westerly generally along the said northern boundary and along a right line, being the last-mentioned boundary produced, across Wainui Road to its western side; thence south-easterly and southerly generally along the said western and south-western sides to the junction with the western side of the Whakatane-Opotiki Main Highway at the north-eastern corner of Allotment 183A, Waimana Parish; thence again southerly generally along the western side of the said main highway to the south-eastern corner of Allotment 223, Waimana Parish; thence easterly and again southerly generally along a right line across the said main highway, to and along the southern boundaries of Allotments 268 and 269, Parish of Waiotahi, to the south-eastern corner of the last-mentioned allotment; thence along the north-eastern and south-eastern boundaries of Sections 6 and 5 of Block IV, Waimana Survey District, to and along the south-eastern boundaries of Waimana Nos. 1c No. 1b, 1c 1c No. 2, 1c 1c No. 3, 1c 1c No. 4A, 1c 1c 4B No. 3, 1d No. 2B 1, parts 1d 2d No. 1, 1d 2d No. 2, 1d No. 3, part 1d No. 5A, and 1d No. 5B Blocks to Trig. Station D, Paitaua in Block VIII, Waimana Survey District; thence north-westerly generally along the south-western boundary of the last-mentioned block to the middle of the Waimana River; thence again southerly generally up the middle of the said river to and up the middle of the Tauranga River to a point, being the intersection near the source of that river with a right line from Maungatapere Trig. Station to Maungapohatu Trig. Station; thence south-westerly generally along a right line to the last-mentioned trig. station; thence south-easterly generally along a right line running in the direction of Puketapu Trig. Station to a point in line with the north-western boundary line of the Waipaoa Block; thence south-westerly along a right line to and along the north-western boundaries of the last-mentioned block and of a forest reserve, and southerly along the western boundary of the said forest reserve to its intersection with a right line running between Puketapu Trig. Station aforesaid and the most northern point of Lake Waikaremoana; thence south-westerly along the last-mentioned line to the said northern corner of Lake Waikaremoana aforesaid; thence along a right line passing through a point in Block X, Tuatawhata Survey District, 180 chains due north of Maungataniwha Trig. Station, to the intersection of the said line with a right line running from Trig. Station 69, Tataroakino in Block VIII, Tarawera Survey District (Hawkes Bay Land District), to Trig. Station 76A, Tawhiwhau, in Block XIV, Galatea Survey District; thence along a right line to Te Taumutu Trig Station in Block XVI, Heruiwi Survey District; thence along a right line to Pukeroa Trig Station in Block XI of the aforesaid Heruiwi Survey District; thence along a right line to Trig Station F, Tiritiri, in Block III, Heruiwi Survey District aforesaid; thence along a right line to Trig Station No. 76, Taupiri, in Block XII, Weao Survey District; thence along a right line to Trig Station No. 78, Pekepeke in Block III, Weao Survey District; thence along a right line to a point, being the intersection of a right line between Trig Station 31, Paeroa in Block V, Paeroa Survey District, and Trig Station 76A, Tawhiwhau aforesaid, with the production of a right line between Trig Station 18, Maungawhakamana in Block III, Ruawahia Survey District, and Trig Station 38, Ahiwhakamura in Block X, Kaingaroa Survey District; thence northerly along the last-mentioned right line to Maungawhakamana Trig Station aforesaid, in Block III, Ruawahia Survey District;
