The Servicemen’s Settlement and Land Sales Act 1943.—Notice
Declaring Lands Taken for the Settlement of Discharged
Servicemen

WHEREAS, pursuant to section 24 of the Servicemen’s Settlement and Land Sales Act, 1943, notice was given of the intention of the Minister of Lands to take under Part II of the said Act the lands described in the First Schedule hereto, and a copy of the said notice was published in the New Zealand Gazette No. 43 on the 5th day of August, 1948, at page 983 :

And whereas an objection was made by the owner in the manner prescribed by the said Act objecting to the taking of the said lands and claiming the right to retain part of the said lands :

And whereas the Minister of Lands did not revoke his notice of intention to take the said lands :

And whereas the Minister of Lands did not agree to the retention by the owner of the area specified in the said objection :

And whereas the Minister of Lands did make to the owner an offer of an area to be retained :

And whereas the owner did accept the offer of such area to be retained :

And whereas the owner did withdraw his objection to the taking of the lands described in the Second Schedule hereto :

And whereas the Land Valuation Committee did on the 31st day of March, 1949, make an order determining that the lands described in the said Second Schedule are farm lands suitable or adaptable for the settlement of a discharged serviceman or of two or more discharged servicemen :

And whereas no appeal was made from the said Order within the time prescribed by the said Act or within any further time allowed by the Court :

And whereas the owner has agreed to an amended vesting-date :

And whereas the said land is not the land of any serviceman who is for the time being serving outside New Zealand in any of His Majesty’s Forces or in any British ship :

Now, therefore, the Minister of Lands, acting in pursuance of section 27 of the said Act, doth hereby declare that the lands described in the said Second Schedule are taken for the settlement of discharged servicemen, and hereby specifies the 1st day of June, 1949, as the date on which the said lands shall be deemed to be vested in His Majesty the King.

FIRST SCHEDULE

SOUTH AUCKLAND LAND DISTRICT

ALL that parcel of land situated in Block XVI, Onewhero Survey District, containing by admeasurement six hundred and forty-nine (649) acres two (2) roods thirty-eight (38) perches, more or less, being part of Opuatia No. 3 Block, and being all of the land described in certificate of title, Vol. 130, folio 284 (Auckland Registry).

Also all that parcel of land containing by admeasurement three hundred and seven (307) acres, more or less, being Section 6, Block XVI, Onewhero Survey District, and being all of the land described in certificate of title, Vol. 160, folio 152 (Auckland Registry).

Also all that parcel of land containing by admeasurement eight (8) acres, more or less, being all of the land on Deposited Plan 26283, being part of Section 2, Block XVI, Onewhero Survey District, and being all of the land described in certificate of title, Vol. 675, folio 237 (Auckland Registry).

Also all that parcel of land situated in Blocks XII and XVI, Onewhero Survey District, containing by admeasurement seven hundred and sixteen (716) acres one (1) rood fifteen (15) perches, more or less, being part of Section 5, Block XVI, Onewhero Survey District, Lot 1 on Deposited Plan 32023, being part of Opuatia No. 4 Block and part of Lot 1 on Deposited Plan 29992, part of Section 11, Block XII, and part of Section 1, Block XVI, Onewhero Survey District, and being all of the land described in certificate of title, Vol. 884, folio 265 (Auckland Registry).

Also all that parcel of land containing by admeasurement seven (7) acres three (3) roods thirty (30) perches, more or less, being Section 9, Block XVI, Onewhero Survey District, and being all of the land described in certificate of title, Vol. 895, folio 38 (Auckland Registry).

SECOND SCHEDULE

SOUTH AUCKLAND LAND DISTRICT

ALL that parcel of land situated in Block XVI, Onewhero Survey District, containing by admeasurement six hundred and forty-nine (649) acres two (2) roods thirty-eight (38) perches, more or less, being part of Opuatia No. 3 Block, and being all of the land described in certificate of title, Vol. 130, folio 284 (Auckland Registry).

Also all that parcel of land containing by admeasurement eight (8) acres, more or less, being all the land on Deposited Plan 26283, being part of Section 2, Block XVI, Onewhero Survey District, and being all of the land described in certificate of title, Vol. 675, folio 237 (Auckland Registry).

Also all that parcel of land containing by admeasurement seven (7) acres three (3) roods thirty (30) perches, more or less, being Section 9, Block XVI, Onewhero Survey District, and being all of the land described in certificate of title, Vol. 895, folio 38 (Auckland Registry).

Also all that parcel of land containing by admeasurement eleven (11) acres two (2) roods seven (7) perches, more or less, being part of Section 6, Block XVI, Onewhero Survey District, and being part of the land described in certificate of title, Vol. 160, folio 152 (Auckland Registry), as the same is more particularly shown on a plan lodged under S.O. 34434 in the Office of the Chief Surveyor, at Auckland, and thereon edged red.

Also all that parcel of land situated in Blocks XII and XVI, Onewhero Survey District, containing by admeasurement four hundred and sixty-two (462) acres one (1) rood twenty-one (21) perches, more or less, being Lot 1 on Deposited Plan 32023, being part of Opuatia No. 4 Block, and that part of Lot 1 on Deposited Plan 29992, comprised in the certificate of title hereinafter mentioned, being part of Section 11, Block XII, and part of Section 1, Block XVI, Onewhero Survey District, and being part of the land described in certificate of title, Vol. 884, folio 265 (Auckland Registry).

of Intention to Take Lands

THE Minister of Lands, acting in pursuance of section 24 of the Servicemen’s Settlement and Land Sales Act, 1943, hereby gives notice of his intention to take the lands described in the Schedule hereto under Part II of the said Act, and specifies the 1st day of August, 1949, as the date on which possession of the land is required, and the 27th day of June, 1949, as the date on or before which objections may be made under section 25 of the said Act.

SCHEDULE

SOUTH AUCKLAND LAND DISTRICT

ALL that parcel of land situated in Block XII, Maungakawa Survey District, containing by admeasurement sixty-nine (69) acres three (3) roods thirty-five (35) perches, more or less, being Lot 2 on Deposited Plan 26398, being part of Section 19s, Pakarau Settlement, and being all of the land described in certificate of title Vol. 806, folio 291 (Auckland Registry).

Also all that parcel of land situated in Block XII, Maungakawa Survey District, containing by admeasurement one hundred and twenty-seven (127) acres and thirty-seven (37) perches, more or less, being Lot 11 on Deposited Plan 11953, being part of Pakarau Pa Block, and being all of the land described in certificate of title, Vol. 806, folio 292 (Auckland Registry).

Also all that parcel of land situated in Block XII, Wairere Survey District, containing by admeasurement two hundred and eleven (211) acres and thirty-four (34) perches, more or less, being Lot 5 on Deposited Plan 8147, being part of Section 7, Block XII, Wairere Survey District, and part of Te-Pae-o-Turawaru No. 2 Block, and being all of the land described in certificate of title, Vol. 220, folio 6 (Auckland Registry), subject to the fencing covenant contained in Transfer No. 78513.

ALL that parcel of land situated in Block II, Southbridge Survey District, containing two hundred and forty-seven (247) acres two (2) roods six (6) perches, more or less, being Lots 1, 2, 3, 5, and 6, on Deposited Plan 3099, being part of Rural Section 5960, and being all the land comprised in certificate of title, Vol. 266, folio 10 (Canterbury Registry).

Also all that parcel of land situated in Blocks I and II, Southbridge Survey District, containing one hundred and forty-five (145) acres and thirty-three (33) perches, more or less, being part of Lot 1 on Deposited Plan 5106, being Rural Sections 5377 and 5660, and parts of Rural Sections 5334 and 5335, and being all the land comprised in certificate of title, Vol. 316, folio 157 (Canterbury Registry).

Also all that parcel of land situated in Block I, Southbridge Survey District, containing thirty-seven (37) acres one (1) rood nineteen (19) perches, more or less, being Lot 2 on Deposited Plan 7408, being part of Rural Section 5206, and being all the land comprised in certificate of title, Vol. 365, folio 174 (Canterbury Registry).

Also all that parcel of land situated in Block I, Southbridge Survey District, containing forty-two (42) acres, more or less, being Part of Lot 1 on Deposited Plan 7408, being part of Rural Section 5206, and being all the land comprised in certificate of title, Vol. 496, folio 292 (Canterbury Registry).
