Crown Land Set Apart as a Permanent State Forest

A PROCLAMATION
BY virtue and in exercise of the powers and authorities conferred upon me by section eighteen of the Forests Act, 1921–22, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby set apart the Crown land described in the Schedule hereto as a permanent State forest.
SCHEDULE
OTAGO LAND DISTRICT.—SOUTHLAND CONSERVANCY
ALL those areas in the Otago Land District, Bruce County, containing by admeasurement 32 acres 3 roods 16 perches, more or less, and being parts of Sections 29 and 30, Block VIII, Akatore Survey District. As the same are more particularly delineated on plan No. 215/12, deposited in the Head Office of the State Forest Service at Wellington, and thereon bordered red. (Otago plan S.O. 9667.)
Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 4th day of May, 1949.

ALL that area in the Auckland Land District, Tauranga County, containing by admeasurement 3,734 acres 3 roods 22·5 perches, more or less, being Sections 6, 8, 9, and 13, Block IV, Section 24, Block V, and Sections 4, 12, 18, 30, and 31, Block VIII, Aongatete Survey District. As the same is more particularly delineated on plan No. 29/10, deposited in the Head Office of the State Forest Service at Wellington, and thereon bordered red. (Auckland plan S.O. 33440.)

PURSUANT to paragraph (h) of section forty-seven of the Maori Trustee Act, 1930, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby authorize the investment of moneys in the Maori Trustee's account in an advance upon the security of the leasehold interest of Frank Whittaker, of Okaihau, Farmer, in the lands described in the Schedule hereto, to an amount not exceeding three-fifths of the estimated value of such security according to a valuation approved by the Board of Maori Affairs.

THE RIGHT HON. W. NASH PRESIDING IN COUNCIL
WHEREAS by Order in Council made on the third day of November, one thousand nine hundred and forty-eight, the Right Honourable Sir Humphrey Francis O'Leary, K.C.M.G., Chief Justice, was appointed a member of the Second Division of the Court of Appeal, and the then Honourable Robert Kennedy, Judge, was appointed a member of the First Division of the said Court:
And whereas it is expedient for the purposes of the business of both Divisions of the said Court to revoke the particular appointments referred to herein and to appoint another Judge as a member of each of the respective Divisions as aforesaid:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice of the Executive Council of that Dominion, and in exercise of the authority conferred upon him by the Judicature Amendment Act, 1913, and in pursuance of the recommendation of the Right Honourable the Chief Justice, the Honourable Mr. Justice Kennedy, and the Honourable Mr. Justice Northcroft, doth revoke the respective appointments of the Right Honourable Sir Humphrey Francis O'Leary, K.C.M.G., Chief Justice, as a member of the Second Division of the said Court and the then Honourable Robert Kennedy, Judge (now the Honourable Sir Robert Kennedy, Kt., Judge) as a member of the First Division of the said Court as and from the seventh day of June, one thousand nine hundred and forty-nine, and doth appoint as and from the latter day aforesaid the Honourable John Bartholomew Callan, Judge, to be a member of the Second Division of the Court of Appeal and the Honourable Ernst Peterson Hay, Judge, to be a member of the First Division of the said Court.

Consenting to the Raising of a Loan of £3,600 by the Pohangina County Council and Prescribing the Conditions Thereof

THE RIGHT HON. W. NASH PRESIDING IN COUNCIL
WHEREAS the Pohangina County Council (hereinafter called the said local authority) proposes, pursuant to the provisions of section three of the Main Highways Amendment Act, 1928, to borrow the sum of three thousand six hundred pounds (£3,600) by a loan to be known as “Main Highways Bridges Loan, 1948” (hereinafter called the said loan), for the purpose of providing the Council’s share of the cost of erecting the Oroua River Bridge on the Kimbolton–Apiti Main Highway and the Roberts’ Bridge on the Pohangina Valley – Apiti Main Highway:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising by the said local authority of the said loan for the said purpose up to the amount of three thousand six hundred pounds (£3,600), and in giving such consent doth hereby determine as follows:
(1) The term for which the said loan or any part thereof may be raised shall be ten (10) years.
(2) The rate of interest that may be paid in respect of the said loan or any part thereof shall be such as shall not produce to the lender a rate exceeding three pounds ten shillings (£3 10s.) per centum per annum.
(3) The said loan or any part thereof, together with interest thereon, shall be repaid by equal aggregate annual instalments extending over the term as determined in (1) above.
(4) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.
