ALL that area in the County of Whangarei situated in Block XVI, Hukerenui Survey District, containing by admeasurement 1 rood 17 perches, more or less, being Lot 1 as shown on Deeds Plan numbered 860, lodged in the office of the District Land Registrar at Auckland, being part Allotment 77, Parish of Hikurangi. As the same is more particularly delineated on the plan marked L. and S. 9/3546, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red.

Vesting a Reserve in the Mount Herbert County Council

At the Government Buildings at Wellington, this 13th day of April, 1949

THE RIGHT HON. W. NASH PRESIDING IN COUNCIL
WHEREAS the land described in the Schedule hereto has been duly set apart as a reserve for a site for county buildings: And whereas, in the opinion of the Governor-General, it is expedient to vest the said reserve in the Chairman, Councillors, and Inhabitants in the County of Mount Herbert:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section nine of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that from and after the day of the date hereof the reserve described in the Schedule hereto shall become vested in the Chairman, Councillors, and Inhabitants of the County of Mount Herbert, in trust for a site for county buildings.

WHEREAS the lands described in the Schedule hereto have been duly set apart as reserves for river-conservation purposes: And whereas it is expedient that the control of the said reserves should be vested in the North Canterbury Catchment Board:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section seventeen of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby vest the control of the said reserves in the North Canterbury Catchment Board.

ORDER IN COUNCIL
At the Government Buildings at Wellington, this 13th day of April, 1949
Present:
THE RIGHT HON. W. NASH PRESIDING IN COUNCIL
PURSUANT to the Harbours Act, 1923, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby permit Wilfred Thomas McManaway, of Plimmerton (hereinafter called the licensee, which term shall include his executors, administrators, and assigns, unless the context requires a different construction), to use and occupy a part of the foreshore and land below low-water mark in Porirua Harbour as shown on plan marked M.D. 8867 and deposited in the office of the Marine Department at Wellington, for the purpose of erecting and maintaining a slipway thereon as shown on the said plan, such licence to be held and enjoyed by the licensee upon and subject to the terms and conditions set forth in the First Schedule hereto, and doth hereby prescribe that the dues and rates set forth in the Second Schedule hereto shall be charged and taken by the licensee for the use of the said slipway.
FIRST SCHEDULE
CONDITIONS

This licence is subject to the Foreshore Licence Regulations 1940, and the provisions of those regulations shall, so far as applicable, apply hereto.

The terms of the licence shall be fourteen years from the 1st day of April, 1949.

The premium payable by the licensee shall be two pounds ten shillings (£2 10s.) and the annual sum so payable by the licensee shall be two pounds (£2).
SECOND SCHEDULE
DUES AND RATES
- Every person using the said slip shall pay to the licensee for the use of the said slip dues and rates in accordance with the following scale of charges:—
For hauling up of vessel and for the first twenty-four £ s. d.
hours or part thereof for each vessel .. .. 2 0 0
For each succeeding day or part thereof for each vessel 0 10 0

Every person applying to the licensee for use of the said slip shall pay the charge aforesaid to the licensee before launching his vessel from the said slip.

No unauthorized person shall haul up or launch a vessel from the said slip.

Any person committing a breach of these regulations shall be liable to a penalty not exceeding twenty pounds (£20).

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Alexandra Borough Council on the seventh day of February, one thousand nine hundred and forty-nine, viz.:—
“The Alexandra Borough Council, being the local authority having control of the streets in the Borough of Alexandra, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the west side of the portion of Mullingar Street adjoining Sections 1, 2, 3, and 4, Block XV, Town of Alexandra, being all of the land in Certificates of Title, 24/185, 6/150, 97/266, 209/53, 209/52 (Otago Land Registry).”
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Mullingar Street (described in the Schedule hereto) within a distance of twenty-five feet from the centre-line of the said portion of street.
SCHEDULE
THE western side of all that portion of street situated in the Otago Land District, Borough of Alexandra, known as Mullingar Street, fronting Sections 1, 2, 3, and 4, Block XV, Town of Alexandra. As the same is more particularly delineated on the plan marked P.W.D. 128856, deposited in the office of the Minister of Works at Wellington, and thereon edged red.
