Varying the Determinations in Respect of the Hawkes Bay Electric-
power Board's Loan of £30,000

THE RIGHT HON. W. NASH PRESIDING IN COUNCIL
WHEREAS by Order in Council made on the first day of December, one thousand nine hundred and forty-eight (hereinafter referred to as the said Order in Council) and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Hawkes Bay Electric-power Board (hereinafter referred to as the said local authority) of a loan of thirty thousand pounds (£30,000), to be known as Reticulation Renewal Loan, 1949 (hereinafter referred to as the said loan):
And whereas the authority conferred by the said Order in Council has not yet been exercised, and it is expedient to vary certain of the determinations aforesaid in respect of the said loan:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary certain of the determinations aforesaid in respect of the said loan by prescribing that in lieu of repayment by equal aggregate annual or half-yearly instalments of principal and interest, as specified in clause (3) of the said Order in Council, the said local authority shall, before raising the said loan or any part thereof, make provision for the repayment thereof by establishing a sinking fund under the Local Bodies' Loans Act, 1926, or under such other statutory enactment as may be applicable, and shall thereafter make payments to such sinking fund at intervals of not more than one year at a rate or rates per centum which shall be not less than eight pounds fourteen shillings and sixpence (£8 14s. 6d.), such payments to be made in respect of every part of the said loan for the time being so borrowed and not repaid, the first such payment to be made not later than one year after the first day from which interest to the lender or lenders is computed on the said loan or any part thereof so raised.

IN pursuance and exercise of the powers conferred by section forty-four of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

Charles Vincent Higgins,
Charles William Gardiner, and
Robert Catley Bryant
to be the Brightwater Domain Board, having control of the land described in the Schedule hereto : and doth hereby appoint Tuesday, the third day of May, one thousand nine-hundred and forty-nine, at eight o'clock p.m., as the time when, and the Public Hall, Brightwater, as the place where, the first meeting of the Board shall be held.
SCHEDULE
NELSON LAND DISTRICT.—BRIGHTWATER DOMAIN
ALL that area containing by estimation 6 acres 3 roods 35 perches, more or less, being part of Section 18 of Waimea South Original District, and situated in Block IX, Waimea Survey District : Bounded towards the north-west by a road, 165 links ; towards the north-east by a part of the before-mentioned Section 18, 1276·6 links (or thereabouts) ; towards the south-east by a right-of-way and other parts of the said Section 18 ; towards the south by a line 100 links distant from and parallel to the railway reserve ; towards the south-west by another part of the said Section 18 ; and again towards the north-west and south-west by parts of the said Section 18, 541 links and 377·2 links respectively : be all the aforesaid linkages more or less. As the same is delineated on the plan marked L. and S. 1/471, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.
Also all that area containing by admeasurement 1 acre 3 roods 35 perches, more or less being part of Section 18, District of Waimea South, Block IX, Waimea Survey District : Bounded towards the north-east by a public road, 720·2 links : towards the south-east, south-west, and north-west by other parts of Section 18 aforesaid, 274 links, 721·4 links, and 271·6 links respectively. As the same is more particularly delineated on the plan marked L. and S. 1/471B, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.
