Land Subject to the Housing Act, 1919, Declared Crown Land Available for Reservation under the Land Act, 1948

A PROCLAMATION

IN pursuance and exercise of the power and authority conferred upon me by subsection one of section eight of the Housing Amendment Act, 1940, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby proclaim and declare the land described in the Schedule hereto, being land subject to the Housing Act, 1919, to be Crown land available for reservation under the Land Act, 1948.

SCHEDULE

NORTH AUCKLAND LAND DISTRICT

ALL that area in the Borough of Mount Eden, situated in Block IV, Titirangi Survey District, containing by admeasurement 1 acre and 14.3 perches, more or less, being part Allotment 115 of Section 10, Suburbs of Auckland. As the same is more particularly delineated on the plan marked L. and S. 1/1107/1, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. (North Auckland plan S.O. 34993.)

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 12th day of April, 1949.

Crown Land Set Apart as a Permanent State Forest

A PROCLAMATION

BY virtue and in exercise of the powers and authorities conferred upon me by section eighteen of the Forests Act, 1921-22, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby set apart the Crown land described in the Schedule hereto as a permanent State forest.

SCHEDULE

OTAGO LAND DISTRICT.—SOUTHLAND CONSERVANCY

ALL that area in the Otago Land District, Tuapeka County, containing by admeasurement 29 acres 0 roods 8 perches, more or less, and being Section 1612R, Block XI, Glenkenich Survey District. As the same is more particularly delineated on plan No. 204/62, deposited in the Head Office of the State Forest Service at Wellington, and thereon bordered red. (Otago plan S.O. 9616.)

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 7th day of April, 1949.

Constitution of Rural Fire District

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 6th day of April, 1949
Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
PURSUANT to the Forest and Rural Fires Act, 1947, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby constitute and declare the area described in the First Schedule hereto to be a rural fire district, to be known as the “Matahina Rural Fire District”; and doth hereby specify the trees and other plants situated on the lands described in the Second Schedule hereto as the property for the protection of which the district is constituted; and doth hereby further specify the period between the first day of October in any one year and the thirtieth day of April in the following year (both days inclusive) as a closed fire season in the said district; and doth hereby declare that this Order in Council shall come into force, and that the Matahina Rural Fire District shall become a rural fire district, on the day following publication of this Order in Council in the Gazette; and doth hereby prescribe that the said district shall be administered for the purposes of the said Act by a rural fire committee, which shall be known as the “Matahina Rural Fire Committee,” and, with respect to the said Rural Fire Committee, doth hereby make the following regulations.

REGULATIONS

  1. In these regulations, unless the context otherwise requires,—“Act” means the Forest and Rural Fires Act, 1947 : “Committee” means the Matahina Rural Fire Committee constituted by these regulations : “District” means the Matahina Rural Fire District : “Farmer” means the occupier of land within the district, the whole or substantially the whole of which is used by him for farming purposes : “Minister” means the Commissioner of State Forests.

  2. The Rural Fire Committee Regulations 1949, shall, so far as they are applicable, and with the necessary modifications, apply to the Matahina Rural Fire Committee constituted by these regulations and these regulations shall be deemed to be special regulations for the purpose of those regulations.

MEMBERS

  1. The Committee shall consist of five members, who shall be appointed in the following manner :—(a) Two members shall be appointed by Whakatane Board Mills, Limited, as agent for Timberlands Woodpulp Extended, Limited, Timberlands Woodpulp Development, Limited, and Timberlands Woodpulp Estates, Limited, by writing signed on behalf of that company by one director and the secretary thereof. In the event of any member of the Committee appointed as aforesaid ceasing to hold office, the said company shall be entitled to fill up the vacancy, subject, nevertheless, to the provisions of the Rural Fire Committee Regulations 1949 : (b) One member (herein referred to as the remaining forest owners’ representative) shall be appointed either by a resolution passed by a majority of those present at a meeting of owners of forests on lands described in the Second Schedule hereto, or by a majority vote by ballot of those present at such a meeting, as those so present by resolution determine : (c) One member (herein referred to as the sawmillers’ representative) shall be appointed either by a resolution passed by a majority of those present at a meeting of sawmill or logging proprietors carrying on business as such within the district, or by a majority vote by ballot of those present at such a meeting, as those so present by resolution determine : (d) One member (herein referred to as the farmers’ representative) shall be appointed either by a resolution passed by a majority of farmers present at a meeting of farmers, or by a majority vote by ballot of those present at such a meeting as those so present by resolution determine.

  2. The General Manager, Whakatane Board Mills, Limited, shall be the Returning Officer for the first appointment of the remaining forest owners’ representative, and the sawmillers’ representative, and shall convene such meetings, conduct such ballots, and take such other steps as may be required for the first appointments, and shall also convene the first meeting of the Committee. Thereafter, the Secretary of the Committee shall be the Returning Officer.

FIRST SCHEDULE

AUCKLAND LAND DISTRICT.—ROTORUA CONSERVANCY

Matahina Rural Fire District

ALL that area in the Auckland Land District, Whakatane County, containing approximately 52,700 acres, situated in Blocks X, XI, XIII, XIV, and XV, Rangitaiki Upper Survey District, Block VIII, Ruawahia Survey District, and Blocks I, II, III, V, VI, VII, IX, X, XI, XIV, and XV, Rangitaiki Lower Survey District, and bounded generally as follows : Towards the east by the eastern side of the Te Teko – Galatea Road ; towards the south-west by the Mangapapa Stream, and by a right line to a point on the left bank of the Rangitaiki River 10 chains south of the north-eastern corner of Matahina A No. 1c Block ; thence by a line 10 chains distant from and parallel to the north-eastern boundaries of Matahina A No. 1c and D Blocks and that line produced to a point 10 chains westwards of the north-western corner of the last-mentioned block ; towards the north-west by a line 10 chains distant from and parallel to the south-eastern boundaries of Pokohu E and D Blocks, and Putauaki part No. 2, No. 1, and part No. 2 Blocks ; towards the north-east by Lot 1 and part Lot 2A of Allotment 59B, Matata Parish ; towards the north-west by Lots 2A, 2C, and 2D 1 of Allotment 59B, Matata Parish, and towards the north by Allotments 117, 116, 115, and 114, Matata Parish, and by the south-eastern boundary of the last-mentioned allotment produced to and across the Rangitaiki River to the eastern side of the Te Teko – Galatea Road. As the same is more particularly delineated on plan No. 39/5, deposited in the Head Office of the State Forest Service at Wellington, and thereon bordered red.
