Varying the Determinations in Respect of the Napier Borough Council's Loan of £27,000

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS by Order in Council made on the fourth day of December, one thousand nine hundred and forty-six (hereinafter called the said Order in Council), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Napier Borough Council (hereinafter called the said local authority) of a loan of twenty-seven thousand pounds (£27,000), to be known as “Marewa Sewerage Loan, 1946” (hereinafter called the said loan):
And whereas the authority conferred by the said Order in Council has been exercised only to the extent of nine thousand pounds (£9,000):
And whereas by clause three of the said Order in Council it is provided (inter alia) that the said local authority shall make payments to the sinking fund established pursuant to the said clause three at intervals of not more than one year at a rate or rates per centum which shall not be less than two pounds thirteen shillings and one penny (£2 13s. 1d.), such payments to be made in respect of every part of the said loan for the time being so borrowed and not repaid:
And whereas the said local authority paid into the sinking fund on the first day of March, one thousand nine hundred and forty-eight, an instalment calculated on the amount of twenty-seven thousand pounds (£27,000) instead of on the amount of nine thousand pounds (£9,000), being the amount of the said loan then raised:
And whereas it is expedient to prescribe for the repayment of the unraised balance of the loan amounting to eighteen thousand pounds (£18,000) by equal aggregate annual or half-yearly instalments of principal and interest, and the extension of the period within which the said unraised balance may be raised and for the adjustment of the payments to the sinking fund in respect of the said sum of nine thousand pounds (£9,000):
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid by prescribing as follows:—
(1) In lieu of repayment by the establishment of a sinking fund, as specified in clause three of the said Order in Council, the said sum of eighteen thousand pounds (£18,000) or any part thereof, together with interest thereon, shall be repaid by equal aggregate annual or half-yearly instalments extending over the term of twenty-five (25) years, as specified in clause one of the said Order in Council.
(2) No moneys shall be borrowed under the consent given by the said Order in Council after the expiration of four (4) years from the date thereof.
(3) No further payments shall be required to be made to the sinking fund in accordance with the requirements of clause three of the said Order in Council in respect of the said sum of nine thousand pounds (£9,000) until the first day of March, one thousand nine hundred and fifty-one.

IN pursuance and exercise of the powers conferred by section forty-four of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

Jesse Maisey Crutchley,
Alexander Mann,
Arthur Ivan Mathias,
Vincent Patrick Sarsfield O'Neill, and
Alexander Ferguson Pearson
to be the Taieri Lake Domain Board, having control of the land described in the Schedule hereto; and doth hereby appoint Thursday, the ninth day of December, one thousand nine hundred and forty-eight, at eight o'clock p.m., as the time when, and the Domain Board Pavilion, Waipiata, as the place where, the first meeting of the Board shall be held.
