Crown Land Set Apart as a Permanent State Forest

A PROCLAMATION

BY virtue and in exercise of the powers and authorities conferred upon me by section eighteen of the Forests Act, 1921–22, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby set apart the Crown land described in the Schedule hereto as a permanent State forest.

SCHEDULE

NELSON LAND DISTRICT.—NELSON CONSERVANCY

ALL that area in the Nelson Land District, Waimea County, containing by admeasurement 188 acres, more or less, being Section 5, Block VIII, Wakapuaka Survey District, and being the land formerly described in Renewable Lease No. 116, Vol. 35, folio 81 (Nelson Registry). As the same is delineated on plan No. 103/21, deposited in the Head Office of the State Forest Service at Wellington, and thereon bordered green.

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 4th day of November, 1948.

Authorizing the Acquisition of Land Notwithstanding the Provisions as to Limitation of Area

At the Government House at Wellington, this 10th day of November, 1948

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section two hundred and forty-six of the Maori Land Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby authorize the disposition to and acquisition by Timberlands Woodpulp Extended, Limited, of the land mentioned in the Schedule hereto or any portion thereof, notwithstanding the provisions of Part XII of the said Act.

SCHEDULE

First, all that piece of land containing 25 acres 2 roods 35·2 perches, more or less, situate in Block I, Whakatane Survey District, being part of the land known as Allotments 28B 5B and 28B 5C, Parish of Rangitaiki, and being the whole of the land comprised and described in Certificate of Title, Volume 727, folio 207 (Auckland Registry).

Secondly, all that piece of land containing 1 rod 24 perches, more of less, situate in Block I, Whakatane Survey District, being Lots 1 and 2, D.P. 28326 (Town of Whakatane Extension No. 3), being also part of the land known as Allotment 28B 5B, Parish of Rangitaiki, and being the whole of the land comprised and described in Certificate of Title, Volume 715, folio 48 (Auckland Registry).

At the Government House at Wellington, this 17th day of November, 1948

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Rabbit Nuisance Act, 1928, and to section twenty-nine of the Rabbit Nuisance Amendment Act, 1947, His Excellency the Governor-General, at the request of the Minister of Agriculture, made on the recommendation of the Rabbit Destruction Council, and acting by and with the advice and consent of the Executive Council, doth hereby constitute and declare the area of land the boundaries of which are described in the Schedule hereto, being an area to which subsection one of section thirty of the Rabbit Nuisance Act, 1928, applies, a rabbit district, and doth appoint that the name of the said rabbit district shall be the Linnburn-Puketoi Rabbit District, and doth order that the basis on which the Rabbit Board to be established for the said district shall first levy its general rate shall be the acreage of land occupied by the ratepayer.

SCHEDULE

DESCRIPTION OF BOUNDARIES OF THE LINNBURN-PUKETOI RABBIT DISTRICT

ALL that area in the Gimmerburn, Upper Taieri, Long Valley, Manorside, Serpentine, and Upper Taieriside Survey Districts, containing approximately 80,800 acres, more or less, bounded as follows: Commencing at the north-western corner of Section 2, Block XI, Gimmerburn Survey District; thence easterly along the northern boundaries of Section 2 aforesaid and Section 21, Block III; thence southerly along the eastern boundaries of Section 21 aforesaid and Section 22, Block III; thence easterly along the southern boundaries of Sections 16 and 17, Block III, to the Puketoi–Highfield Road; thence southerly along that road to the northern boundary of Section 6, Block XII; thence easterly along that boundary and north-easterly along Gibson Road to the eastern boundary of Section 3, Block XII; thence southerly along the eastern boundaries of Section 3, Block XII, Gimmerburn Survey District, and Run 619 to a road; thence easterly along that road forming the northern boundaries of Section 11, Block XII, and Sections 7 and 4, Block VI, Gimmerburn Survey District, to the Taieri River; thence generally southerly up the centre of the main stream of the Taieri River to a point in line with the northern boundary of Run 308D, Upper Taieri Survey District; thence south-westerly, southerly, and south-easterly along the northern, western, and southern boundaries of Run 308D to a point on the Dunstan Road opposite the eastern boundary of Section 4, Block VII, Upper Taieriside Survey District; thence southerly along the eastern boundary of Section 4 aforesaid; thence westerly and north-westerly along the southern and south-western boundaries of Section 4 aforesaid to the south-eastern boundary of Run 308C; thence generally south-westerly, north-westerly, and north-easterly along the south-eastern, southern, and north-eastern boundaries of Run 308C to the south-western boundary of Run 308L; thence north-westerly along the western boundaries of Runs 308L, 308M, and 624; thence northerly along the western boundaries of Runs 624, 623, 622, 621, and 620, to a road reserve; thence generally north-westerly and north-easterly along that road forming the western boundary of Section 3, the northern boundary of Section 4, and the north-western boundary of Section 2, Block XI, Gimmerburn Survey District, to the point of commencement.

ORDER IN COUNCIL

At the Government House at Wellington, this 17th day of November, 1948

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by section thirty of the Rabbit Nuisance Act, 1928, it is enacted that the Governor-General may, by Order in Council, on petition in that behalf signed by a majority of the persons qualified to be enrolled on the ratepayers' list for any proposed district, constitute and declare any area of land of not less than one thousand acres a rabbit district under and for the purposes of Part II of the said Act:

And whereas, in pursuance of the provisions of the said section thirty of the said Act, a petition has been received praying that the area of land described in the Schedule hereto be constituted and declared a rabbit district under and for the purposes of Part II of the said Act:

And whereas the said petition is signed by a majority of the persons in the said area of land qualified to be enrolled on the ratepayers' list for the said proposed district, and it is deemed expedient to give effect to the prayers of the petitioners accordingly:

Now, therefore, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby constitute by the specific name of the “Conway Rabbit District” and declare that area of land defined in the Schedule hereto to be a rabbit district under and for the purposes of Part II of the said Act; and doth hereby further declare that the basis on which the Board to be established for the said district shall first levy its general rate shall be on the basis of the acreage of the rateable property in the said district.

SCHEDULE

BOUNDARIES OF THE CONWAY RABBIT DISTRICT

ALL that parcel of land in the Marlborough Land District, containing approximately 166,600 acres, and bounded as follows: Commencing at the north bank at the mouth of the Conway River in Block XXI, Hundalee Survey District; thence proceeding in a northerly direction by the sea to the southern bank of the Kowhai River in Block VI, Mount Fyffe Survey District; thence northerly generally by that bank to its intersection with the south-western boundary of Run 128 in Block XIII, Greenburn Survey District; thence by that boundary in a north-westerly direction to a point known as Snowflake on the Seaward Kaikoura Range in Block IX, Greenburn Survey District; thence south-westerly generally by the summit of the aforementioned range to Palmer Saddle in Block XI, Acheron Survey District; thence by a right line to the eastern bank of the Conway River; thence by that bank in a southerly direction generally to the point of commencement.
