ORDER IN COUNCIL
At the Government House at Wellington, this 10th day of November, 1948
Present:

  • His Excellency The Governor-General in Council
    Pursuant to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Taranaki County Council on the fourth day of October, one thousand nine hundred and forty-eight, viz.:—
    "That the Taranaki County Council, being the local authority having control of the roads in the County of Taranaki, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the western side of the portion of the Paraite Road fronting part Lot 2 on Deposited Plan No. 5401, and being part Section 22 on the public map of Bell District and part of the land in Certificate of Title, Volume 137, folio 279 (Taranaki Registry)";
    subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Paraite Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.

Appointing a Non-elective Member of the Southland Catchment Board

WHEREAS by Warrant dated the second day of February, one thousand nine hundred and forty-eight, and published in the New Zealand Gazette No. 8 of the twelfth day of the same month, Joseph Frederick Field was appointed a non-elective member of the Southland Catchment Board in terms of section forty-four of the Soil Conservation and Rivers Control Act, 1941:
And whereas the said Joseph Frederick Field has resigned from membership of the said Board, and it is considered expedient to appoint another non-elective member in lieu of the said Joseph Frederick Field :
Now, therefore, pursuant to section forty-four of the Soil Conservation and Rivers Control Act, 1941, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby cancel the appointment of the said Joseph Frederick Field to be a non-elective member of the Southland Catchment Board, and do hereby appoint
Allan Drummond McKinnon, B.For.Sc., Conservator of Forests, State Forest Service, Invercargill,
to be a non-elective member of the Southland Catchment Board for a term commencing on the eleventh day of November, one thousand nine hundred and forty-eight, and terminating on the thirtieth day of November, one thousand nine hundred and fifty.
As witness the hand of His Excellency the Governor-General, this 3rd day of November, 1948.

Royal Warrant.—The New Zealand War Service Medal
GEORGE THE SIXTH, by the Grace of God, of Great Britain, Ireland, and the British Dominions beyond the Seas King, Defender of the Faith; To all to whom these presents shall come. GREETING:
WHEREAS We in Our Government of New Zealand have taken into Our Royal consideration the services rendered during the war of 1939 to 1945 by all members of the New Zealand Armed Forces and Merchant Navy and by aircrews of New Zealand registered Civil Air Services which operated outside New Zealand, who, when their country was in danger, answered the call and saw service at home or abroad in their country's defence:
And whereas We are desirous of recognizing this service to New Zealand:
We do by these presents, for Us, Our Heirs, and Successors institute and create a new medal.

  1. The medal shall be designated and styled “The New Zealand War Service Medal.”
  2. The medal shall be circular in form and of cupro-nickel, and shall on the obverse bear the uncrowned effigy of the Sovereign, and on the reverse the inscription “For Service to New Zealand 1939–45,” with the representation of a frond of fern below.
  3. The persons eligible for the medal shall be those of Our faithful subjects and others, male and female, who, between the 3rd September, 1939, and the 2nd September, 1945, rendered the required service in the New Zealand Armed Forces, including the Naval Auxiliary Patrol Service, the New Zealand Territorial Force, the New Zealand National Military Reserve, the Home Guard, or the commissioned ranks of the Air Training Corps, or rendered the required service in the New Zealand Merchant Navy, or as members of the crew of an aircraft operated by a Civil Air Line registered in New Zealand.
  4. In the case of service in the Armed Forces an aggregate of at least twenty-eight days' full-time service must have been rendered, whether within New Zealand or abroad, or six months' part-time service. The part-time service in the Home Guard, which may be reckoned towards the period of six months, shall be restricted to service between 16th August, 1940, and 1st January, 1944. The part-time service in the Naval Auxiliary Patrol Service, which may be reckoned towards the period of six months, shall be restricted to service between the 31st December, 1941, and 31st July, 1944.
  5. In the case of service in the New Zealand Merchant Navy an aggregate of at least twenty-eight days' service must have been rendered at sea.
  6. In the case of service as a member of the crew of an aircraft operated by a Civil Air Line registered in New Zealand, an aggregate of at least twenty-eight days' service, involving not less than forty-eight flying hours, must have been rendered outside New Zealand territorial waters.
  7. The medal shall not be awarded to any person who does not qualify by full-time or part-time service performed in the New Zealand Armed Forces or in the Merchant Navy of New Zealand, or as a member of the crew of an aircraft operated by a Civil Air Line registered in New Zealand.
  8. Service brought to an end by death on duty, or due to wounds or injuries sustained on duty, or honourable discharge as a direct result of injuries sustained while on duty, shall qualify for the award of the medal even though the service may not amount to twenty-eight days or six months, as the case may be.
  9. Full-time uniformed civilians who served as members of the New Zealand Armed Forces shall qualify in the same way as full-time members of such Forces.
  10. It shall be a condition of award that a recipient, not still serving in the New Zealand Forces or the Merchant Navy of New Zealand, or in a Civil Air Line registered in New Zealand, shall have been honourably discharged. Where service was ended by capture by the enemy, it shall be a condition that the recipient of the award shall have been free from blame.
  11. “Part-time” service is service rendered by a member of the Armed Forces who was not fully mobilized but was liable to render service by the performance, from time to time, of short periods of training or other duties and did in fact carry out such training or duties.
  12. Qualifying service in different sections of the New Zealand Armed Forces or Merchant Navy, or as a member of the crew of an aircraft operated by a Civil Air Line registered in New Zealand, may be aggregated for the purpose of determining the qualifying service of an individual under clauses 4 to 6. In making this aggregation, seven days' part-time service shall be taken as equivalent to one day of full-time service, and vice versa.
  13. The medal shall be worn on the left breast suspended by a ribbon one-and-a-quarter inches in width, of black, watered, and edged with white stripes, each three-sixteenths of an inch in width.
  14. The medal shall be worn immediately after the war medal issued by Us in recognition of service during the second World War.
  15. It shall be competent for Our Governor-General for the time being to cancel and annul the award to any person of the above medal, and thereupon the name of such person in the register shall be erased, but it shall be competent for Our Governor-General to restore any medal which may have been so forfeited.
  16. It is ordained that it shall be competent for Our Governor-General for the time being to make regulations to carry out the purposes of this Warrant.
    Given at Our Court at St. James's on the thirtieth day of September, one thousand nine hundred and forty-eight, in the twelfth year of Our Reign.
