The South-eastern Side of Portion of Emano Street, in the City of Nelson, Exempted from the Provisions of Section 128 of the Public Works Act, 1928, Subject to a Condition as to the Building-line

ORDER IN COUNCIL

At the Government House at Wellington, this 27th day of October, 1948

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Nelson City Council on the nineteenth day of August, one thousand nine hundred and forty-eight, viz:--

"That the Nelson City Council, being the local authority having control of the streets in the City of Nelson, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-eastern side of the portion of Emano Street adjoining Lot 4 on the plan deposited in the Land Transfer Office at Nelson as No. 1493, being part of Sections 832 and 833, City of Nelson, and being part of the land comprised and described in Certificate of Title, Volume 74, folio 125 (Nelson Registry) " ; subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Emano Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE

THE south-eastern side of all that portion of street situated in the Nelson Land District, City of Nelson, known as Emano Street, fronting part Sections 832 and 833. As the same is more particularly delineated on the plan marked P.W.D. 127829, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

PURSUANT to section one hundred and sixty-seven of the Maori Land Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby vary an Order in Council made on the fourth day of April, one thousand nine hundred and thirty-two, and published in the Gazette on the seventh day of April, one thousand nine hundred and thirty-two, at page 735, and affecting Hauturu East B 2 Section 2A 1A and other blocks, by excluding therefrom the lands described in the Schedule hereto.

PURSUANT to section eighteen of the Rehabilitation Amendment Act, 1944, and pursuant to a request made to me by the Rehabilitation Board in this behalf, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby authorize the officer of the Public Service whose name is set out in the Schedule hereto to execute, on behalf of the Rehabilitation Board, deeds and other documents being agreements relating to the hire and purchase of tools of trade and other chattels supplied to persons undergoing training at a rehabilitation trade-training centre.

PURSUANT to the authority conferred upon me by the Land Act, 1924, and section forty of the Statutes Amendment Act, 1945, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby notify and declare that the undermentioned land is available for disposal as a site for commercial or industrial purposes.

SCHEDULE

CANTERBURY LAND DISTRICT

ALL that parcel of land in the Canterbury Land District, containing by admeasurement five (5) acres three (3) roods and fourteen (14) perches, more or less, being Rural Section 37449 (formerly part of Lot 3, D.P. 1924, being part of Rural Sections 3611 and 3611w), situated in Block III, Otaio Survey District. As the same is more particularly delineated on the plan marked L. and S. 36/1562A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red. (Cant. S.O. plan 7870.)
