Domain Board appointed to have Control of the Mangamingi Domain

At the Government Buildings at Wellington, this 14th day of January, 1948

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

IN pursuance and exercise of the powers conferred by section forty-four of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint Eric Arthur Jones,

Percy Robert Brown,

Wilfred Osborn Hardwick-Smith,

James Alexander Wallace Boddie, and John Harold Nairn

to be the Mangamingi Domain Board, having the control of the land described in the Schedule hereto; and doth hereby appoint Monday, the nineteenth day of January, one thousand nine hundred and forty-eight, at eight o'clock p.m., as the time when, and the Mangamingi Hall, as the place where, the first meeting of the Board shall be held.

PURSUANT to section thirty-five of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct the sale of the land described in the Schedule hereto, such land being no longer required for the purpose for which it was acquired.

SCHEDULE

APPROXIMATE area of the piece of land directed to be sold: 32 acres 2 roods 36 perches. Being part Section 44.

Situated in Block XVI, Cloudy Bay Survey District (Opawa R.D.). (S.O. 3709.)

In the Marlborough Land District; as the same is more particularly delineated on the plan marked P.W.D. 109207, deposited in the office of the Minister of Works at Wellington, and thereon edged red.

PURSUANT to the Harbours Act, 1923, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby license and permit Hugh Sutherland Valentine and Henry Percy Stanaway, both of Dargaville (hereinafter called the licensees, which term shall include their executors, administrators, or assigns, unless the context requires a different construction), to use and occupy a part of the foreshore and land below low-water mark at Dargaville in Kaipara Harbour, as shown on plan marked M.D. 8667 and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining a wharf thereon as shown on the said plan, such licence to be held and enjoyed by the licensees upon and subject to the terms and conditions set forth in the Schedule hereto.

SCHEDULE

  1. This licence is subject to the Foreshore Licence Regulations 1940, and the provisions of those regulations shall, so far as applicable, apply hereto.

  2. The term of the licence shall be fourteen (14) years from the Ist day of January, 1948.

  3. The premium payable by the licensees shall be two pounds ten shillings (£2 10s.), and the annual sum so payable by the licensees shall be three pounds (£3).

Revoking the Reservation over Public Reserves in the City of Christchurch, Canterbury Land District

At the Government House at Wellington, this 21st day of January, 1948

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by subsection one (b) of section seven of the Public Reserves, Domains, and National Parks Act, 1928 (hereinafter referred to as the said Act), it is provided that the Governor-General may, from time to time, by Order in Council, revoke the reservation over any public reserve or part thereof, and thereupon the land comprised therein shall, if vested in the Crown or in any local authority or trustees deriving title from the Crown, become Crown land available for disposal under the Land Act, 1924, and in any other case may, subject to the provisions of subsection five of the said section seven of the said Act, be disposed of in such manner and for such purposes as may be stated in such Order in Council:

And whereas the lands described in the Schedule hereto are public reserves which on the subdivision of private property for residential purposes were conveyed, in trust, for the purpose of public reserves to the body corporate called the Mayor, Councillors, and Citizens of the City of Christchurch:

And whereas it is expedient that the reservation over the said lands be revoked:

And whereas the said body corporate has passed a resolution consenting to such revocation and has in all other respects complied with the provisions of subsections three and four of the said section seven of the said Act:

Now, therefore, in pursuance and exercise of the powers and authorities conferred upon him by subsection one (b) of section seven of the said Act, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the reservation for public reserves over the lands described in the Schedule hereto, and doth hereby declare that the said lands may be disposed of by the said body corporate by way of sale by public auction or private contract at such price and on such terms and conditions as the said body corporate shall determine, but so that the proceeds of any such sale shall be used and applied in or towards the purchase of land for recreation purposes.

CANTERBURY LAND DISTRICT

ALL that area containing by admeasurement 1 rood 37 perches, more or less, being Lot 41 on plan deposited in the Land Registry Office, Christchurch, as No. 8497, and being part of Rural Section 64, situated in the City of Christchurch. As the same is more particularly delineated on the plan marked L. and S. 1/975T, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Also all that area containing by admeasurement 1 rood 18 perches, more or less, being Lot 22 on plan deposited in the Land Registry Office, Christchurch, as No. 8032, and being part of Rural Section 135, situated in the City of Christchurch. As the same is more particularly delineated on the plan marked L. and S. 1/975s, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Setting apart Maori Land as a Maori Reservation

PURSUANT to section five of the Maori Purposes Act, 1937, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby set apart and reserve the Maori freehold land described in the Schedule hereto as a Maori reservation for the common use of the Maori inhabitants of Ngawha as a burial-ground and for the common use of the Maori members of the Church of England residing at Ngawha as a church-site.
