Setting apart Maori Land as a Maori Reservation

ORDER IN COUNCIL
At the Government Buildings at Wellington, this 2nd day of June, 1948
Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
PURSUANT to section five of the Maori Purposes Act, 1937, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby set apart and reserve the Maori freehold land described in the Schedule hereto as a Maori reservation for the common use of the Ngaitamarauwaho hapu of the Ngati-Ranginui Tribe as a bathing-place.
SCHEDULE
ALL that piece of land containing 5·25 perches, more or less, situate in Block X, Tauranga Survey District, being that part of Lot 452 No. 7, Parish of Te Papa, lying to the east of the Meeting-house Reserve and bounded to the north by the Meeting-house Reserve, 41·5 links; to the west by the Meeting-house Reserve, 77·8 links; to the south by a line in continuation of the southern boundary of the Meeting-house Reserve; and to the east by a 16 ft. road-line.

PURSUANT to section five of the Maori Purposes Act, 1937, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby set apart and reserve the Maori freehold land described in the Schedule hereto as a Maori reservation for the common use of the descendants of Tupe as a marae and meeting-place.

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
PURSUANT to section sixty-three of the Maori Purposes Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby revoke the Order in Council referred to in Part I of the Schedule hereto, in so far as it affects the land mentioned in Part II of the said Schedule.

ORDER in Council under section 32 of the Maori Land Amendment and Maori Land Claims Adjustment Act, 1928, made on the 5th day of December, 1929, and published in the Gazette on the 12th day of December, 1929, at page 3230.

doth hereby approve of the following resolution passed by the Franklin County Council on the twenty-third day of February, one thousand nine hundred and forty-eight, viz.:-
"That the Franklin County Council, being the local authority having control of the roads in the County of Franklin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, shall not apply to the north-western side of the road fronting subdivision of Lot 4 on D.P. 12987, being portion of Allotment 40, Parish of Karaka";
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of unnamed road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.
SCHEDULE
THE north-western side of all that portion of unnamed road situated in the North Auckland Land District, County of Franklin, fronting Lot 4, D.P. 12987, being portion of Allotment 40, Parish of Karaka. As the same is more particularly delineated on the plan marked P.W.D. 127199, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL
PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Riccarton Borough Council on the twelfth day of April, one thousand nine hundred and forty-eight, viz.:-
"The Riccarton Borough Council, being the local authority having control of the streets in the Borough of Riccarton, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-west side of the portion of Stratford Street and to the south side of the portion of Warwick Street adjoining part Lots 96, 97, and 100 of D.P. 359, being part C.T. 220/25, part R.S. 118";
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of Stratford Street or the southern side of the portion of Warwick Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.
SCHEDULE
THE south-western side of all that portion of street situated in the Canterbury Land District, Borough of Riccarton, known as Stratford Street, fronting part Lots 96 and 97, D.P. 359, part Rural Section 118, Block XI, Christchurch Survey District.
Also the southern side of all that portion of street situated in the said land district and borough, known as Warwick Street, fronting part Lot 100, D.P. 359, part Rural Section 118, Block XI, Christchurch Survey District.
As the same are more particularly delineated on the plan marked P.W.D. 126748, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
