Consenting to the Raising of a Loan of £620 by the Nelson Catchment
Board and prescribing the Conditions thereof

ORDER IN COUNCIL
At the Government Buildings at Wellington, this 19th day of
May, 1948
Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

WHEREAS the Nelson Catchment Board (hereinafter called
the said local authority) proposes, pursuant to the pro-
visions of section thirty of the Soil Conservation and Rivers Control
Act, 1941, to raise a loan of six hundred and twenty pounds (£620)
to be known as “ Works Loan, 1948 ” (hereinafter called the said
loan), for the purpose of carrying out river-protection works in the
Wairoa River :

Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, and in
pursuance and exercise of the powers and authorities conferred on
him by section eleven of the Local Government Loans Board Act,
1926, as set out in section twenty-nine of the Finance Act, 1932
(No. 2), and of all other powers and authorities enabling him in
this behalf, doth hereby consent to the raising by the said local
authority of the said loan for the said purpose up to the amount
of six hundred and twenty pounds (£620), and in giving such consent
doth hereby determine as follows :—

(1) The term for which the said loan or any part thereof may
be raised shall not exceed three (3) years.

(2) The rate of interest that may be paid in respect of the
said loan or any part thereof shall be such as shall not produce to
the lender a rate exceeding three pounds ten shillings (£3 10s.) per
centum per annum.

(3) The said loan or any part thereof, together with interest
thereon, shall be repaid by equal aggregate annual or half-yearly
instalments extending over the term as determined in (1) above.

(4) No moneys shall be borrowed under this consent after
the expiration of two years from the date hereof.

IN pursuance and exercise of the powers conferred by section
forty-four of the Public Reserves, Domains, and National Parks
Act, 1928, His Excellency the Governor-General of the Dominion of
New Zealand, acting by and with the advice and consent of the
Executive Council of the said Dominion, doth hereby appoint

Arthur Philip Alan Nicholls,
James Halligan,
James Robert Daniel Johns,
Alexander Brown,
Samuel George Farquhar,
Albert Edward Clarke,
Benjamin Felix Johns,
Edgar Thomas Wilson, and
Peter William Nicholls

to be the Sheldon Park Domain Board, having control of the land
described in the Schedule hereto ; and doth hereby appoint Monday,
the thirty-first day of May, one thousand nine hundred and forty-
eight, at eight o’clock p.m., as the time when, and the Town Hall,
Belfast, as the place where, the first meeting of the Board shall be
held.

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

WHEREAS the land described in the Schedule hereto has been
duly set apart as a reserve for a site for a kindergarten :
And whereas it is expedient that the control of the said reserve
should be vested in The N. B. Riley Lower Hutt Free Kindergarten
Association (Incorporated) :

Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, and in
exercise of the powers and authorities conferred upon him by section
seventeen of the Public Reserves, Domains, and National Parks
Act, 1928, doth hereby vest the control of the said reserve in
The N. B. Riley Lower Hutt Free Kindergarten Association
(Incorporated).


SCHEDULE

WELLINGTON LAND DISTRICT

ALL that area in the City of Lower Hutt, containing by admeasure-
ment 3 roods 3 perches, more or less, being Lot 2 on S.O. plan 20489,
and being part Section 30, Hall Jones Settlement, situated in
Block XIV, Belmont Survey District. As the same is more parti-
cularly delineated on the plan marked L. and S. 6/6/848, deposited
in the Head Office, Department of Lands and Survey, at Wellington,
and thereon bordered red.

WHEREAS by Order in Council dated the tenth day of May,
one thousand nine hundred and forty-four, and published
in the Gazette of the eighteenth day of the same month at page 575,
the Leyland O’Brien Timber Company, Limited, of Auckland, was
licensed to occupy a part of the foreshore and land below low-
water mark at Awanui, on the Mangetete Stream, as a site for a
landing-stage :

And whereas it is desirable to revoke the hereinbefore-recited
Order in Council :

Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, in pursuance and exercise of the power
and authority vested in him by the Harbours Act, 1923, and of all
other powers and authorities enabling him in that behalf, and
acting by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby revoke the hereinbefore-recited
Order in Council of the tenth day of May, one thousand nine
hundred and forty-four, as from the first day of April, one thousand
nine hundred and forty-eight.

WHEREAS by Order in Council dated the fourth day of April,
one thousand nine hundred and thirty-eight, and published
in the Gazette of the twenty-first day of the same month at
page 993, Phoebe Ethel Buckland, of Auckland, was licensed to
occupy a part of the foreshore and land below low-water mark at
South Head, Kaipara Harbour, as a site for a wharf :

And whereas it is desirable to revoke the hereinbefore-recited
Order in Council :

Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, in pursuance and exercise of the power
and authority vested in him by the Harbours Act, 1923, and of all
other powers and authorities enabling him in that behalf, and acting
by and with the advice and consent of the Executive Council of
the said Dominion, doth hereby revoke the hereinbefore-recited
Order in Council of the fourth day of April, one thousand nine
