Widths less than 66 ft., but not less than 40 ft. 3 in., subject to Conditions as to the Building-line

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 14th day of January, 1948

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

PURSUANT to the Municipal Corporations Act, 1933, and the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Lyttelton Borough Council to permit the laying-off of the proposed streets as described in the Schedule hereto (and named on the plan referred to in such Schedule as Foster Terrace and Gilmour Terrace respectively) of widths less than sixty-six feet, but not less than forty feet three inches, subject to the condition that no building or part of a building shall at any time be erected on Lots 4, 5, 6, 7, 8, and 10 on Plan 13405, part of Reserve 68, Borough of Lyttelton, or on parts of Reserve 68, Borough of Lyttelton, or on Lot 10, D.P. 9983, part of Reserve 68, Borough of Lyttelton, fronting the said Gilmour Terrace, within a distance of thirty-five feet from the centre-line of the said Gilmour Terrace, and subject further to the condition that no building or part of a building shall at any time be erected on the said Lot 6, Plan 13405, within a distance of sixty-eight feet from the north-western boundary of the said Foster Terrace.

SCHEDULE

ALL those proposed streets in the Canterbury Land District, Borough of Lyttelton, to be known as Foster Terrace and Gilmour Terrace, together containing by admeasurement 2 acres 1 rood 5·7 perches, more or less, being part of Reserve 68, and Lots 9 and 11 on Plan 13405, being part of Reserve 68. As the same are more particularly delineated on the plan marked P.W.D. 126015, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Balclutha Borough Council on the twenty-ninth day of October, one thousand nine hundred and forty-seven, viz.:-

"Resolved, that the Balclutha Borough Council, being the local authority having control of the streets in the Borough of Balclutha, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-western side of the portion of Breadalbine Street, adjoining Lots 12, 13, 14, and 15, Block I, Township of Helensborough, D.P. 58, being part Section 27, Block XVII, Town of Balclutha, contained in Certificate of Title, Volume 246, folio 62 (Otago Land Registry)";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portion of Breadalbine Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE

THE north-western side of all that portion of street situated in the Otago Land District, Borough of Balclutha, known as Breadalbine Street, fronting Lots 12, 13, 14, and 15, Block I, D.P. 58, Township of Helensborough. As the same is more particularly delineated on the plan marked P.W.D. 126157, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The South-eastern Side of Portion of Caldervan Street, in the Borough of Balclutha, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Balclutha Borough Council on the twenty-ninth day of October, one thousand nine hundred and forty-seven, viz.:-

"Resolved, that the Balclutha Borough Council, being the local authority having control of the streets in the Borough of Balclutha, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-eastern side of the portion of Caldervan Street adjoining Lots 4, 5, and 6, Block A, D.P. 89, being part Sections 6 and 7, Block XXXV, Clutha Survey District, contained in Certificate of Title, Volume 267, folio 203 (Otago Land Registry)";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Caldervan Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE

THE south-eastern side of all that portion of street situated in the Otago Land District, Borough of Balclutha, know as Caldervan Street, fronting Lots 4, 5, and 6, Block A, Deeds Plan 89, Clutha District. As the same is more particularly delineated on the plan marked P.W.D. 126158, deposited in the office of the Minister of Works at Wellington, and thereon edged red.
