Boundaries of Borough of Huntly and County of Raglan altered

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 19th day of May, 1948

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

WHEREAS, at the request of the Raglan County Council, the Local Government Commission, in pursuance of the provisions of the Local Government Commission Act, 1946, has made inquiry into certain proposals for an alteration of the boundaries of the Borough of Huntly and the County of Raglan:

And whereas, in pursuance of the provisions of the said Act, the Local Government Commission has approved as final a scheme bearing date the fourth day of May, one thousand nine hundred and forty-eight, providing for the exclusion of the area described in the Schedule to the said scheme from the County of Raglan and the inclusion of such area in the Borough of Huntly:

And whereas it is deemed expedient to give effect to the final scheme as hereinafter appearing:

Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the Local Government Commission Act, 1946, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that the area described in the Schedule hereto shall be and is hereby excluded from the County of Raglan and included in the Borough of Huntly, and, with the like advice and consent, doth hereby declare that the alteration of boundaries of the said county and the said borough hereinbefore made shall be deemed to have been effected under the Municipal Corporations Act, 1933.

SCHEDULE

AREA EXCLUDED FROM THE COUNTY OF RAGLAN AND INCLUDED IN THE BOROUGH OF HUNTLY

ALL that area in Block XV, Rangiriri Survey District, bounded by a line commencing at a point in the middle of the Waikato River in line with the northern boundary of the land shown on the plan numbered 3167, deposited in the office of the District Land Registrar at Auckland, being parts of Allotments 9 and 9A of the Parish of Pepepe, and running westerly generally along a right line, to and along the said northern boundary, and the northern boundary of part of Lot 7, shown on the plan numbered 1278, deposited as aforesaid, being parts of the said Allotments 9 and 9A, to the south-eastern corner of that part of Allotment 9 aforesaid, shown on the plan numbered 15829, deposited as aforesaid; thence northerly generally along the eastern boundary of that part of Allotment 9, and along a right line, being that boundary produced across a public road, to and along another part of the eastern boundary of the said allotment, as shown on the said plan numbered 15829, to the southern boundary of part of Allotment 9 of the said parish, as shown on the plan numbered 22511, deposited as aforesaid; thence along a right line to the south-western corner of Lot 68, shown on the plan numbered 7295, deposited as aforesaid, being part of Allotment 9 aforesaid; thence along the western boundaries of Lots 68, 67, 66, 65, and 64, and the western and northern boundaries of Lot 63, to and along the western boundary of Lot 61, the said lots being shown on the aforesaid plan numbered 7295, and being parts of the said Allotment 9, to the north-western corner of the last-mentioned lot; thence along a right line to the northernmost corner of part of Allotment 47 of the said parish, as shown on the plan numbered 10728, deposited as aforesaid; thence along a right line, being the north-eastern boundary of that part of Allotment 47 produced across the Huntly-Awaroa Railway, and a public road to its intersection with another right line through Allotments 46A, 45, 44, and 43 of the said parish, parallel to, and distant 250 links from, the south-eastern boundaries of those allotments; thence north-easterly along the last-mentioned right line, to and along another right line parallel to, and distant 250 links from, the northern side of Punt Road to the western boundary of the Borough of Huntly, as described in New Zealand Gazette No. 69 of the 1st day of November, 1945, page 1373; thence southerly generally along that boundary to the point of commencement.

Authorizing the Laying-off of a Street (Extension of Brasell Street) in the City of Lower Hutt of a Width less than 66 ft. but not less than 40 ft.

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

PURSUANT to the Municipal Corporations Act, 1933, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Lower Hutt City Council to permit the laying-off of the proposed street described in the Schedule hereto of a width less than sixty-six feet but not less than forty feet.

SCHEDULE

THAT proposed street in the Wellington Land District, City of Lower Hutt, being an extension of Brasell Street, containing by admeasurement 1 rood 2·66 perches, more or less, being—first, that area of 11·76 perches, being land marked “Reserve for Road” on D.P. 10622, being part Section 108, Epuni Hamlet, shown coloured sepia on the plan marked P.W.D. 126825, deposited in the office of the Minister of Works at Wellington; secondly, that area of 13·27 perches, being land marked “Reserve for Road” on D.P. 9890, being part Section 33, Hutt District, shown coloured orange on the said plan marked P.W.D. 126825; thirdly, that area of 11·33 perches, being part Section 30, Hutt District, shown coloured blue on the said plan marked P.W.D. 126825; and, fourthly, that area of 6·3 perches, being part Lot 2, D.P. 9313, being part Section 30, Hutt District, shown coloured sepia on the said plan marked P.W.D. 126825.

Authorizing the Laying-off of Mercia Street and Pamir Street, in the City of Christchurch, of a Width less than 66 ft. but not less than 50 ft., subject to a Condition as to the Building-line

At the Government Buildings at Wellington, this 12th day of May, 1948

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

PURSUANT to the Municipal Corporations Act, 1933, and the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Christchurch City Council to permit the laying-off of the proposed streets described in the Schedule hereto of a width less than sixty-six feet but not less than fifty feet, subject to the condition that no building or part of a building shall at any time be erected on Lots 25 and 26, D.P. 13400 (fronting the proposed street first described in the Schedule hereto), within a distance of forty feet from the centre-line of the said street, or on Lots 48, 49, 50, 51, 74, 75, 76, 77, 108, 109, 110, 111, and 112 of a subdivision of the land fronting the proposed street first described in the Schedule hereto (as shown on the plan referred to in the said Schedule) within a distance of forty-eight feet from the centre-line of the said street, or on Lots 141, 142, 143, 144, 145, 146, and 147 of a subdivision of the land fronting the proposed street secondly described in the Schedule hereto (as shown on the plan referred to in the said Schedule) within a distance of forty-eight feet from the centre-line of the said street.

SCHEDULE

THAT proposed street in the Canterbury Land District, City of Christchurch, to be known as Mercia Street, containing by admeasurement 3 roods 12 perches, more or less, being part Lot 3, D.P. 1308, part of Rural Section 699.

Also that proposed street in the said land district and city, to be known as Pamir Street, containing by admeasurement 38 perches, more or less, being part Lot 3, D.P. 1308, part of Rural Sections 699 and 781.

As the same are more particularly delineated on the plan marked P.W.D. 126427, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The Southern Side of Portion of Durie Street, in the City of Wanganui, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 19th day of May, 1948

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

PURSUANT to section one hundred and twenty-eight of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wanganui City Council on the tenth day of February, one thousand nine hundred and forty-eight, in so far as it affects the side and portion of street described in the Schedule hereto, viz.:

“ That the Wanganui City Council, being the local authority having control of the streets in the City of Wanganui, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of the street known as Durie Street adjoining Lot 47 on Deeds Plan No. 41, part Section 43, Left Bank, Wanganui River, a distance of 125 links ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Durie Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
