seventy-four pounds (£674), and in giving such consent doth hereby
determine as follows :—

(1) The term for which the said loan or any part thereof may
be raised shall be seven (7) years.

(2) The rate of interest that may be paid in respect of the said
loan or any part thereof shall be such as shall not produce to the
lender a rate exceeding three pounds ten shillings (£3 10s.) per
centum per annum.

(3) The said loan or any part thereof, together with interest
thereon, shall be repaid by equal aggregate annual instalments
extending over the term as determined in (1) above.

(4) No moneys shall be borrowed under this consent after the
expiration of two years from the date hereof.

Consenting to the Raising of a Loan of £41,850 by the Birkenhead Borough Council and prescribing the Conditions thereof

ORDER IN COUNCIL

At the Government House at Wellington, this 14th day of
April, 1948

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS the Birkenhead Borough Council (hereinafter
called the said local authority), being desirous of raising a
loan of forty-one thousand eight hundred and fifty pounds (£41,850),
to be known as “ Roads and Water Reticulation Loan, 1947 ”
( hereinafter called the said loan), for the purpose of sealing the
Birkdale bus route and side roads, concreting footpaths, kerbing,
and channelling (£30,000), and enlarging existing water-mains and
extending the water-supply reticulation first to the Aerovue Estate
roads and secondly to other roads (£11,850), has complied with the
provisions of the Local Government Loans Board Act, 1926 (herein-
after called the said Act), and it is expedient that the precedent
consent of the Governor-General in Council, as required by the said
Act, should be given to the raising of the said loan :

Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, and in
pursuance and exercise of the powers and authorities conferred on
him by section eleven of the said Act, as set out in section twenty-
nine of the Finance Act, 1932 (No. 2), and of all other powers and
authorities enabling him in this behalf, doth hereby consent to the
raising in New Zealand by the said local authority of the said loan
for the said purpose up to the amount of forty-one thousand eight
hundred and fifty pounds (£41,850), and in giving such consent
doth hereby determine as follows :—

(1) The term for which the said loan or any part thereof may
be raised shall not exceed twenty-five (25) years.

(2) The rate of interest that may be paid in respect of the said
loan or any part thereof shall be such as shall not produce to the
lender or lenders a rate or rates exceeding three pounds five shillings
(£3 5s.) per centum per annum.

(3) The said loan or any part thereof, together with interest
thereon, shall be repaid by equal aggregate annual or half-yearly
instalments extending over the term as determined in (1) above.

(4) The payment of such instalments shall be made in New
Zealand, and no instalments shall be paid out of loan-moneys.

(5) The rate payable for brokerage, underwriting, and procura-
tion fees in respect of the raising of the said loan or any part thereof
shall not in the aggregate exceed one-half per centum of any amount
raised.

(6) No moneys shall be borrowed under this consent after the
expiration of two years from the date hereof.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Harbours Act, 1923, His Excellency the
Governor-General, acting by and with the advice and consent
of the Executive Council, doth hereby amend, as set forth in the
Schedule hereto, the Order in Council dated the twenty-sixth day
of September, one thousand nine hundred and forty-five, and
published in the Gazette of the fourth day of the following month
at page 1230, licensing and permitting the Tinopai Sawmills, Limited,
to use and occupy a part of the foreshore and land below low-water
mark at Tinopai, Komiti Creek, Otamatea River, Kaipara Harbour,
as a site for the purpose of storing timber thereon.


SCHEDULE

CLause 2 to the Schedule of the hereinbefore-recited Order in
Council dated the 26th day of September, 1945, is revoked, and
the following clause substituted as from the 1st day of April, 1947 :—

“ (2) The annual sum payable by the company shall be two
pounds ten shillings (£2 10s.). ”

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Harbours Act, 1923, His Excellency the
Governor-General, acting by and with the advice and consent
of the Executive Council, doth hereby license and permit the Picton
Borough Council (hereinafter called the Council, which term shall
include its successors or assigns, unless the context requires a
different construction), to use and occupy a part of the foreshore
and land below low-water mark at Picton, as shown on approved
plans marked M.D. 2927 and 3023, and deposited in the office of
the Marine Department at Wellington, for the purpose of maintaining
a footbridge over the head of Picton Harbour from Perano's site
to the Domain for the use and benefit of the public, and the main-
taining of a boat-shed and boat-slip in front of Section 199, Picton, as
shown on the said plan, such licence to be held and enjoyed by the
Council upon and subject to the terms and conditions set forth
in the Schedule hereto.


SCHEDULE

CONDITIONS

  1. This licence is subject to the Foreshore Licence Regulations
    1940, and the provisions of those regulations shall, so far as appli-
    cable, apply hereto.

  2. The term of the licence shall be fourteen (14) years from the
    6th day of April, 1948.

  3. The footbridge shall be for the use and benefit of the public.

  4. The Council may make such charge for the use of the foot-
    bridge as may be approved by the Minister of Marine.

  5. The Council shall be liable for any injury which any person
    may sustain through the construction of the footbridge.

WHEREAS by Order in Council dated the twenty-ninth day
of November, one thousand nine hundred and forty-four,
and published in the Gazette of the seventh day of the following
month at page 1483, the Tinopai Sawmills, Limited, of Hamilton,
was licensed to occupy a part of the foreshore and land below
low-water mark at Tinopai, Komiti Creek, Otamatea River, Kaipara
Harbour, as a site for a wharf :

And whereas it is desirable to revoke the hereinbefore-recited
Order in Council :

Now, therefore, His Excellency the Governor-General of the
Dominion of New Zealand, in pursuance and exercise of the power
and authority vested in him by the Harbours Act, 1923, and of all
other powers and authorities enabling him in that behalf, and acting
by and with the advice and consent of the Executive Council of
the said Dominion, doth hereby revoke the hereinbefore-recited
Order in Council of the twenty-ninth day of November, one thousand
nine hundred and forty-four, as from the first day of April, one
thousand nine hundred and forty-seven.

Member of Island Council of Niue appointed

PURSUANT to the authority vested in me by section sixty-five
of the Cook Islands Act, 1915, and by an Order in Council
of the twenty-first day of March, one thousand nine hundred and
sixteen, providing for the constitution of Island Councils in the
Cook Islands, I, Bernard Cyril Freyberg, the Governor-General of
the Dominion of New Zealand, do hereby nominate and appoint

to be a member of the Island Council of Niue, to hold office during
my pleasure as from the nineteenth day of January, one thousand
nine hundred and forty-eight, vice Togati, resigned.

As witness the hand of His Excellency the Governor-General
of the Dominion of New Zealand, this 9th day of April,
