Alteration of Boundaries of Pelorus Fire District

WHEREAS by notice published in the Gazette on the 2nd day of November, 1939, at page 3012 (hereinafter referred to as the said notice), a certain area in the Marlborough Land District was declared to be a fire district under section 27 of the Forests Act, 1921–22 (hereinafter referred to as the said Act), and is now known as the “Pelorus Fire District”:

And whereas it is expedient to alter the boundaries of the Pelorus Fire District:

Now, therefore, in pursuance of the said Act, and on the recommendation of the Director of Forestry and of the Land Board of the Marlborough Land District, I hereby revoke the said notice and do declare the area described in the Schedule hereto to be a fire district to be known as the “Pelorus Fire District,” and, with respect to the fire district hereby constituted, I do further specify the period from the 1st day of October in any year to the 30th day of April in the following year, both dates inclusive, as the period during which it shall not be lawful for any person within the said district, except pursuant to the written permit of a Forest Officer, to set on fire or cause to be set on fire any timber (whether standing or not), or any undergrowth, or any debris from forest operations or land-clearing operations, or any grass or other specially inflammable material, without taking such precautions as may be prescribed by a Forest Officer.

SCHEDULE

MARLBOROUGH LAND DISTRICT.—NELSON CONSERVANCY

Pelorus Fire District

ALL that area in the Marlborough Land District, Marlborough County, containing approximately 141,000 acres, situated in Blocks I, II, III, IV, V, VII, VIII, X, and XI, Heringa Survey District, Blocks I, II, III, IV, and VI, Tennyson Survey District, Blocks I, II, III, IV, V, VI, VII, IX, X, XI, XII, XIII, XIV, and XV, Wakamarina Survey District, and Blocks I, II, III, V, and VI, Onamalutu Survey District, and bounded generally as follows: Commencing at a point on the Rai Saddle on the Nelson–Blenheim State Highway, and running in a north-easterly direction along the boundary between the Nelson and Marlborough Land Districts to Trig. Station Editor Hill on the western boundary of Block VI, Tennyson Survey District; thence generally in a southerly direction by the summit of the Opouri Range to a point on the said range, bearing approximately 355° from the northernmost corner of Section 1 of 3, Block VII, Wakamarina Survey District; thence by a right line to the said northernmost corner of Section 1 of 3; thence in a southerly direction by the eastern boundaries of Sections 1 of 3 aforesaid, 2A, 75, and 8, Block VII, Wakamarina Survey District, to the mouth of the Pelorus River; thence in a south-westerly direction by that river to the south-western corner of Section 18, Block XI, Wakamarina Survey District; thence in a westerly direction by the southern boundaries of Sections 90, 89, and 81, Wakamarina Survey District; thence in a northerly direction by the western boundaries of Section 81, Block XI aforesaid, and Section 5, Block VII, Wakamarina Survey District; thence generally in a westerly and south-westerly direction by the southern boundaries of Sections 5, 2, 57, 49, and 1, Block VI, Wakamarina Survey District, Section 52, Block X, Wakamarina Survey District, Sections 47, 25, 28, 21, and 20, Block IX, Wakamarina Survey District; thence generally in a northerly direction by the western boundaries of Sections 20, 13, 27, and 26, Block IX, Wakamarina Survey District, Sections 6, 5, 4, 3, 7, and 8, Block V, Wakamarina Survey District, to the north-eastern corner of Section 34, Block V aforesaid; thence in a westerly direction by the southern boundary of Section 2, Block V aforesaid, to the Rai River; thence in a north-easterly direction generally by that river and by a public road to its intersection with the northern boundary of Section 1, Block V, Wakamarina Survey District; thence by the northern boundaries of Section 1, Block V aforesaid, and Section 8, Block I, Wakamarina Survey District, and by the western boundary of the said Section 8 to its intersection with a public road; thence by that road and the western boundaries of Sections 9 and 55, Block I aforesaid, to and across the Rai River; thence generally in a north-westerly and south-westerly direction by that river to a point in line with the northern boundary of Section 35, Block I, Wakamarina Survey District; thence in an easterly, southerly, and westerly direction by the crossing of the Rai River, and the northern, eastern, and southern boundaries of Section 35, Block I aforesaid, to the south-western corner of that section; thence across a public road to the Rai River, and by the said Rai River to a point due east of the north-western corner of Section 3, Block II, Heringa Survey District; thence across the said Rai River to the north-western corner of Section 3, Block II aforesaid; thence generally in a southerly direction by the eastern side of the Nelson–Blenheim State Highway to a point opposite the south-eastern corner of Section 12, Block II, Heringa Survey District; thence in a westerly direction by the southern boundaries of Sections 12 and 6, Block II aforesaid; thence generally in a southerly direction by the eastern boundaries of Sections 6 and 4, Block II aforesaid, the northern and eastern boundaries of Section 50, Block V, Heringa Survey District, by the northern side of a public road forming the northern boundary of Sections 43 and 42, Block V, Heringa Survey District, and again by the eastern side of the Nelson–Blenheim State Highway to the Rai River; thence by that river to a point in line with the southern boundary of Section 3, Block V, Heringa Survey District; thence westerly across the Nelson–Blenheim State Highway, and by the southern boundaries of Section 3 and part Section 2, Block V, Heringa Survey District, to the north-western corner of Section 30, Block V aforesaid; thence across a public road and in a southerly direction generally by the eastern boundaries of Sections 29 and 25, the northern boundaries of Sections 6 and 19, all of Block V, Heringa Survey District; thence by the eastern side of the Nelson–Blenheim State Highway to a point on the said state highway in line with the northern boundary of Section 68, Block IX, Wakamarina Survey District; thence in a south-easterly direction generally across the said state highway and the Rai River, and by the northern and eastern and southern boundaries of Section 68 and the eastern boundaries of Sections 30 and 64, Block IX aforesaid, across a public road to the Rai River, across that river, and by the eastern boundary of Section 21 of Square 19, Block IX aforesaid, to the Nelson–Blenheim State Highway; thence generally in an easterly direction by the northern side of the Nelson–Blenheim State Highway to a point in line with the eastern boundary of Section 77, Block XI, Wakamarina Survey District; thence by the eastern boundary of the said Section 77, the northern and eastern boundaries of Section 29, and the southern boundary of Section 87, all of Block XI, Wakamarina Survey District, to the easternmost corner of the last-mentioned section; thence by a right line to the northernmost corner of Section 2 of 5, Block XII, Wakamarina Survey District; thence in a southerly direction generally by the north-eastern and the south-eastern boundaries of Section 2 of 5, Block XII aforesaid, and the summit of the main range to Trig. Station Mount Baldy in Block V, Onamalutu Survey District; thence by a right line in a north-westerly direction to the source of Devil’s Creek, and by that creek to the Wakamarina River; thence in a northerly direction generally by the Wakamarina River to a point in line with the southern boundary of Section 4, Block XIII, Wakamarina Survey District; thence across the Wakamarina River and by the southern boundary of the last-mentioned section to its junction with the southern boundary of Section 3, Block XIII, Wakamarina Survey District; thence in a westerly direction by the southern and portion of the western boundaries of Wakamarina Survey District and the southern boundary of Heringa Survey District to the Pelorus River; thence in a northerly direction by that river and the Heringa Stream and by the boundary of the Nelson and Marlborough Land Districts to the point of commencement. As the same is more particularly delineated on plan No. 104/39, deposited in the Head Office of the State Forest Service at Wellington, and thereon bordered red.

Notice as to an Area in the North Auckland Land District declared to be a Fire District

WHEREAS by section 27 of the Forests Act, 1921–22, as amended by section 6 of the Forests Amendment Act, 1925 (hereinafter referred to as the said Act), it is enacted that the Commissioner of State Forests, on application by any owner or occupier of land, may constitute by notice in the Gazette such land and any other land as a fire district for the purpose of securing the safety from damage by fire of any trees on any private or other lands of an area not less than 200 acres: And whereas the Auckland City Council, being the owner of certain lands in the Manakau and Franklin Counties exceeding the said area, has made application to me dated the 7th day of October, 1946, for the constitution of a fire district:

And whereas it appears expedient to grant the application:

Now, therefore, in pursuance of the said Act, I do hereby notify that on the recommendation of the Director of Forestry and the Land Board of the North Auckland Land District, the area described in the Schedule hereto is hereby declared by me to be a fire district, to be known as the “Hunua Fire District,” for the period of five years from the date hereof (unless previously altered or revoked); and, with respect to the fire district constituted as aforesaid, I do further specify the period from the 1st day of November in any year to the 30th day of April in the following year, inclusive, as the period during which it shall not be lawful for any person save pursuant to the written permit of a Forest Officer, to set on fire or cause to be set on fire any timber (whether standing or not), or any undergrowth, or any debris from forest operations or land-clearing operations, or any grass or other specially inflammable material without taking such precautions as may be prescribed by a Forest Officer.

Hunua Fire District

ALL that area in the North Auckland Land District, Manakau and Franklin Counties, containing approximately 83,000 acres, situated in Blocks VIII, IX, X, XII, XIII, and XIV, Wairoa Survey District, Blocks II, III, IV, and V, Orere Survey District, Blocks II, III, IV, VI, VII, VIII, XI, XII, and XV, Opaheke Survey District, and Blocks I, II, III, IV, and V, Wharekawa Survey District, and bounded generally as follows: Towards the east by the eastern sides of the Matingarahi – New Brighton Road and the New Brighton – Miranda Road to the Mangatangi – New Brighton Road; towards the south-east by the south-eastern side of the Mangatangi – New Brighton Road; towards the south and east by parts of Lots 4 and 5 on D.P. 7211; towards the south generally by Lot 6 on D.P. 7211, Allotment 184, Kohoroa Parish, Allotment 51, Otau Parish, and by the south-eastern side of a public road to the north-western corner of Lot B on D.P. 2697; towards the west generally by Allotment 1A, Otau Parish, Allotment 142, Mangatawhiri Parish, Crown land in Block XI, Opaheke Survey District, and by the western side of a public road to a point opposite the southernmost corner of Allotment 127, Opaheke Parish; thence across the said public road and the Wairoa River to the right bank of that river, and by the right bank of the Wairoa River to the south-western corner of Allotment 25, Otau Parish; towards the north by the said Allotment 25; towards the west by Allotments 25 and 20, Otau Parish, and part of Urungahauhau Block; towards the north
