The South-western and the North-western Sides of Portions of Leck-
hampton Court, in the City of Dunedin, exempted from the
Provisions of Section 128 of the Public Works Act, 1928, subject
to a Condition as to the Building-line

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 5th day of
February, 1947

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

PURSUANT to section one hundred and twenty-eight of the
Public Works Act, 1928, His Excellency the Governor-General
of the Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion, doth
hereby approve of the following resolution passed by the Dunedin
City Council on the seventh day of October, one thousand nine
hundred and forty-six, in so far as it affects the sides and portions
of street described in the Schedule hereto, viz. :—

“ That the Dunedin City Council, being the local authority
having control of the streets in the City of Dunedin, by reso-
lution declares that the provisions of section one hundred
and twenty-eight of the Public Works Act, 1928, shall not
apply to the undermentioned portions of streets, viz. :—

“ (a) The south-eastern side of portion of Reynolds Street
adjoining Lot 55, D.P. 191, being part Section 65,
Block VI, Town District ;

“ (b) The south-western and north-western side of the
portion of Leckhampton Court adjoining Lots 53,
54, and 55, D.P. 191, being part Section 65, Block VI,
Town District ;

such land being comprised and described in Certificate of Title
136/67 ” ;

subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the south-western or
the north-western sides of the portions of Leckhampton Court
(described in the Schedule hereto) within a distance of thirty-three
feet from the centre-lines of the said portions of street.

SCHEDULE

THE south-western and the north-western sides of all those portions
of street situated in the Otago Land District, City of Dunedin,
known as Leckhampton Court, fronting Lots 53, 54, and 55, D.P. 191,
Town District. As the same are more particularly delineated on
the plan marked P.W.D. 124355, deposited in the office of the
Minister of Works at Wellington, and thereon edged red.

in Certificate of Title 314/58 ;

“ (b) The western and south-western side of the portion of
Wairoa Street adjoining Lot 1, D.P. 2260, Village of
Kirkland Hill, being part Section 15, Block IV,
Upper Kaikorai District, such land being comprised
and described in Certificates of Title 314/58 and
166/265 ” ;

subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the south-eastern side
of the portion of Fife Street or the western or south-western side of
the portion of Wairoa Street (described in the Schedule hereto)
within a distance of thirty-three feet from the centre-lines of the
said portions of streets.

SCHEDULE

THE south-eastern side of all that portion of street situated in the
Otago Land District, City of Dunedin, known as Fife Street, fronting
part Section 15, Block IV, Upper Kaikorai District.

Also the western and south-western side of all that portion of
street situated in the said land district and city, known as Wairoa
Street, fronting part Section 15, Block IV, Upper Kaikorai District,
and Lots 7 and 9, D.P. 142, Township of Forbestown, and Lot 1,
D.P. 2260, Village of Kirkland Hill.

As the same are more particularly delineated on the plan
marked P.W.D. 124608, deposited in the office of the Minister of
Works at Wellington, and thereon coloured red.

thousand nine hundred and forty-six, in so far as it affects the side
and portion of street described in the Schedule hereto, viz. :—

“ That the Green Island Borough Council, being the local
authority having control of the streets in the Borough of Green
Island, by resolution declares that the provisions of section
one hundred and twenty-eight of the Public Works Act, 1928,
shall not apply to that portion of Exeter Street fronting Lots 58
and 59, Township of Abbotshill ” ;

subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the western side of the
portion of Exeter Street (described in the Schedule hereto) within
a distance of thirty-three feet from the centre-line of the said portion
of street.

SCHEDULE

THE western side of all that portion of street situated in the Otago
Land District, Borough of Green Island, known as Exeter Street,
fronting Lots 58 and 59, Block I, Deeds Plan 140, Township of
Abbotshill. As the same is more particularly delineated on the
plan marked P.W.D. 124695, deposited in the office of the Minister
of Works at Wellington, and thereon coloured red.

St. Kilda, by resolution declares that the provisions of section
one hundred and twenty-eight of the Public Works Act, 1928,
shall not apply to that portion of High Street fronting part
Lots 26, 27, and 28, Block IV, Township of Musselburgh ” ;

subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the western side of the
portion of High Street (described in the Schedule hereto) within a
distance of thirty-three feet from the centre-line of the said portion
of street.

SCHEDULE

THE western side of all that portion of street situated in the Otago
Land District, Borough of St. Kilda, known as High Street, fronting
parts Lots 26, 27, and 28, Block IV, D.P. 68, Township of Mussel-
burgh. As the same is more particularly delineated on the plan
marked P.W.D. 124641, deposited in the office of the Minister of
Works at Wellington, and thereon edged red.
