The Southern Side of Portion of Duke Street, in the Borough of Gore,
exempted from the Provisions of Section 128 of the Public Works
Act, 1928, subject to a Condition as to the Building-line

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 5th day of
February, 1947

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

PURSUANT to section one hundred and twenty-eight of the
Public Works Act, 1928, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and with the
advice and consent of the Executive Council of the said Dominion,
doth hereby approve of the following resolution passed by the
Gore Borough Council on the thirtieth day of September, one
thousand nine hundred and forty-six, viz. :—

“ That the Gore Borough Council, being the local authority
having control of the streets in the Borough of Gore, by reso-
lution declares that the provisions of section one hundred
and twenty-eight of the Public Works Act, 1928, shall not
apply to the southern side of the portion of Duke Street adjoining
Lots 7, 8, D.P. 29, being part Section 35, Block XVI, Town
of Gore, and comprised in Certificate of Title, Volume 65,
flio 181 ” ;

subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the southern side of
the portion of Duke Street (described in the Schedule hereto) within
a distance of thirty-three feet from the centre-line of the said portion
of street.

SCHEDULE

THE southern side of all that portion of street situated in the South-
land Land District, Borough of Gore, known as Duke Street, fronting
Lot 7, Plan 29, being part Section 35, Block XVI, Town of Gore.
As the same is more particularly delineated on the plan marked
P.W.D. 124567, deposited in the office of the Minister of Works
at Wellington, and thereon coloured red.

The Southern and Western Sides of Portions of an Unnamed Road,
in the County of Tuapeka, exempted from the Provisions of
Section 128 of the Public Works Act, 1928, subject to a Condition
as to the Building-line

At the Government Buildings at Wellington, this 11th day of
February, 1947

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL

PURSUANT to section one hundred and twenty-eight of the
Public Works Act, 1928, His Excellency the Governor-General
of the Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion, doth
hereby approve of the following resolution passed by the Tuapeka
County Council on the fourteenth day of October, one thousand
nine hundred and forty-six, in so far as it affects the sides and
portions of road described in the Schedule hereto, viz. :—

“ That the Tuapeka County Council, being the local
authority having control of the roads in the County of Tuapeka,
by resolution declares that the provisions of section one hundred
and twenty-eight of the Public Works Act, 1928, shall not
apply to the road on the northern and eastern sides of
Section 20, Block I, Benger Survey District ” ;

subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the southern or western
sides of the portions of the unnamed road (described in the Schedule
hereto) within a distance of thirty-three feet from the centre-line
of the said portions of road.

SCHEDULE

THE southern and western sides of all those portions of an unnamed
road situated in the Otago Land District, County of Tuapeka,
fronting Section 20, Block I, Benger District. As the same
are more particularly delineated on the plan marked P.W.D. 124477,
deposited in the office of the Minister of Works at Wellington, and
thereon coloured red.

of Christchurch, exempted from the Provisions of Section 128 of
the Public Works Act, 1928, subject to a Condition as to the
Building-line

February, 1947

PURSUANT to section one hundred and twenty-eight of the
Public Works Act, 1928, His Excellency the Governor-General
of the Dominion of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion, doth hereby
approve of the following resolution passed by the Christchurch City
Council on the sixteenth day of December, one thousand nine
hundred and forty-six, viz. :—

“ The Christchurch City Council, being the local authority
having control of the streets in the City of Christchurch,
hereby by resolution declares that the provisions of section
one hundred and twenty-eight of the Public Works Act, 1928,
shall not apply to that portion of the south-western side of
Galbraith Avenue adjoining the land contained in Certificate
of Title, Volume 480, folio 96 ” ;

subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the south-western
side of the portion of Galbraith Avenue (described in the Schedule
hereto) within a distance of forty-eight feet from the centre-line
of the said portion of street.

SCHEDULE

THE south-western side of all that portion of street in the Canterbury
Land District, City of Christchurch, known as Galbraith Avenue,
fronting Lot 7, D.P. 12017, part Rural Section 87. As the same is
more particularly delineated on the plan marked P.W.D. 124775,
deposited in the office of the Minister of Works at Wellington, and
thereon coloured red.

of Dunedin, exempted from the Provisions of Section 128 of the
Public Works Act, 1928, subject to a Condition as to the Building-
line

PURSUANT to section one hundred and twenty-eight of the
Public Works Act, 1928, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and with the
advice and consent of the Executive Council of the said Dominion,

Dunedin City Council on the eighteenth day of November, one
thousand nine hundred and forty-six, viz. :—

“ That the Dunedin City Council, being the local authority
having control of the streets in the City of Dunedin, by reso-
lution declares that the provisions of section one hundred
and twenty-eight of the Public Works Act, 1928, shall not
apply to the south-western side of the portion of Rutherford
Street adjoining Lots 15, 16, 17, and part 44, Township of
St. Andrew’s Extension, such land being comprised and described
in Certificate of Title 209/170 ” ;

subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the south-western side
of the portion of Rutherford Street (described in the Schedule hereto)
within a distance of thirty-three feet from the centre-line of the
said portion of street.

SCHEDULE

THE south-western side of all that portion of street situated in the
Otago Land District, City of Dunedin, known as Rutherford Street,
fronting Lots 15, 16, and 17, and part Lot 44, D.P. 96, Township
of St. Andrew’s. As the same is more particularly delineated on
the plan marked P.W.D. 124607, deposited in the office of the
Minister of Works at Wellington, and thereon edged red.
