ORDER IN COUNCIL
At the Government House at Wellington, this 27th day of
November, 1947
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
P URSUANT to section one hundred and twenty-eight of the
Public Works Act, 1928, His Excellency the Governor-General
of the Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion, doth
hereby approve of the following resolution passed by the West
Harbour Borough Council on the seventh day of October, one
thousand nine hundred and forty-seven, in so far as it affects the
sides and portions of streets described in the Schedule hereto,
viz. :-
“ That the West Harbour Borough Council, being the
local authority having control of streets in the Borough of
West Harbour, by resolution declares that the provisions of
section one hundred and twenty-eight of the Public Works
Act shall not apply to that portion of street known as Argyle
Street adjoining that piece of land being Lots 21, 22, 23,
D.P. 98, Township of Roseneath, being parts Sections 23 and
26, Sawyers Bay Survey District, to that portion of street
known as Shandon Street adjoining that piece of land being
Lots 21, 22, 23, D.P. 98, Township of Roseneath, being parts
Sections 24 and 26, Sawyers Bay Survey District, to that
portion of street known as Prospect Row adjoining that piece
of land being Lots 21, 22, 23, D.P. 98, Township of Roseneath,
being parts Sections 24 and 26, Sawyers Bay Survey District ”;
subject to the condition that no building or part of a building shall
at any time be erected on the land fronting the north-eastern side
of the portion of Argyle Street, the south-western side of the
portion of Shandon Street, or the western side of the portion of
Prospect Row (described in the Schedule hereto) within a distance
of thirty-three feet from the centre-lines of the said portions of
streets.
SCHEDULE
THE north-eastern side of all that portion of street in the Otago
Land District, Borough of West Harbour, known as Argyle Street,
fronting Lot 23 and part Lot 21, D.P. 98, Township of Roseneath.
Also the south-western side of all that portion of street in
the said land district and borough, known as Shandon Street,
fronting Lot 23 and part Lot 22, D.P. 98, Township of Roseneath.
Also the western side of all that portion of street in the said
land district and borough, known as Prospect Row, fronting Lot 21
and part Lot 22, D.P. 98, Township of Roseneath.
As the same are more particularly delineated on the plan
marked P.W.D. 126262, deposited in the office of the Minister of
Works at Wellington, and thereon edged red.

Consenting to the Assignment to Howell St. Clair Williams, of
Whatoro, Farmer, of the Rights, Powers, and Privileges under
an Order in Council authorizing Franklin Robert Cripps, of
Whatoro, Farmer, to use Water for the Purpose of generating
Electricity, and to erect Electric Lines

HIS EXCELLENCE THE GOVERNOR-GENERAL IN COUNCIL.
P URSUANT to the Public Works Act, 1928, His Excellency the
Governor-General, acting by and with the advice and consent
of the Executive Council, doth hereby consent to the assignment
to Howell St. Clair Williams, of Whatoro, Farmer, of the rights,
powers, and privileges under an Order in Council dated the twenty-
third day of December, one thousand nine hundred and thirty-six,
and published in the Gazette on the eighth day of January, one
thousand nine hundred and thirty-seven, at page 6, authorizing
Franklin Robert Cripps, of Whatoro, Farmer, to use water for the
purpose of generating electricity, and to erect and use certain
electric lines.

HIS EXCELLENCE THE GOVERNOR-GENERAL IN COUNCIL
P URSUANT to the Public Works Act, 1928, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council of
the said Dominion, doth hereby consent to the land first described
in the Schedule hereto being taken for street, and to the land
secondly described in the Schedule hereto being taken in connection
with street-widening.
