A PROCLAMATION

IN pursuance and exercise of the power and authority conferred upon me by subsection one of section eight of the Housing Amendment Act, 1940, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, do hereby proclaim and declare the lands described in the Schedule hereto, being lands subject to the Housing Act, 1919, to be Crown lands available for reservation under the Land Act, 1924.

SCHEDULE

TARANAKI LAND DISTRICT

ALL that area containing by admeasurement 1 rood 17·98 perches, more or less, being part Lot 1, D.P. 5670, being part Section 48, Fitzroy District, situated in Block V, Paritutu Survey District, As the same is more particularly shown on S.O. plan No. 7968, lodged in the office of the Chief Surveyor at New Plymouth, and thereon edged red.

Also all that area containing by admeasurement 1 acre and 28·8 perches, more or less, being part Lot 1, D.P. 5670, being part Section 48, Fitzroy District, situated in Block V, Paritutu Survey District. As the same is more particularly shown on S.O. plan No. 7968, lodged in the office of the Chief Surveyor at New Plymouth, and thereon edged red.

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 10th day of October, 1947.

Boundaries of Borough of Balclutha and County of Clutha altered

At the Government House at Wellington, this 15th day of October, 1947

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS in pursuance of section one hundred and thirty-six of the Municipal Corporations Act, 1933, a petition was presented to the Governor-General praying that a certain area be excluded from the County of Clutha and included in the Borough of Balclutha :

And whereas a Commission appointed under the said section held inquiries and recommended that part of the said area be excluded from the County of Clutha and included in the Borough of Balclutha :

And whereas it is deemed expedient to make the alteration of boundaries recommended by the said Commission :

Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the Municipal Corporations Act, 1933, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that the area described in the Schedule hereto is hereby excluded from the County of Clutha and included in the Borough of Balclutha.

SCHEDULE

AREA EXCLUDED FROM THE COUNTY OF CLUTHA AND INCLUDED IN THE BOROUGH OF BALCLUTHA

ALL that area containing 354 acres, more or less, being parts of Blocks XXXIII, XXXV, and XXXVI, Clutha Survey District, bounded by a line commencing at a point on the right bank of the Clutha River (Koau Branch) in line with the south-western boundary of Lot 24, Rosebank Estate; thence north-westerly to and along that boundary, and across a public road to the south-eastern boundary of Lot 23, Rosebank Estate; thence south-westerly and north-westerly along the south-eastern and south-western boundaries of the said Lot 23 to a point in line with the south-eastern boundary of Lot 21 on the plan numbered 4791, deposited in the office of the District Land Registrar at Dunedin; thence south-westerly to and along that boundary, the south-eastern boundaries of Lots 22 to 39 inclusive on the aforesaid plan, and the abuttal of Wilson Road; thence north-westerly generally along the north-eastern boundaries of the land shown on the plan numbered 3264, deposited as aforesaid, to and along the south-eastern and north-eastern boundaries of the land shown on the plan numbered 2900, deposited as aforesaid, to the westernmost corner of the land shown on the plan numbered 4236, deposited as aforesaid; thence north-easterly along the north-western boundary of the last-mentioned land, and the production of that boundary to a point 250 links from a public street forming the north-eastern boundaries of Lots 4, 3, and 2 on the plan numbered 397, deposited as aforesaid; thence north-westerly along a right line parallel to the aforesaid street to Owaka Road; thence north-easterly along that road to the northern corner of Lot 2 on the plan numbered 397 aforesaid; thence north-westerly across the Main South Road to the southern corner of the land shown on the plan numbered 2888, deposited as aforesaid; thence north-easterly along the north-western side of the Main South Road to the southern corner of the land shown on the plan numbered 6257, deposited as aforesaid; thence north-easterly along the north-western boundary of that land, and the south-eastern boundary of Section 12, Block XXXV, Clutha Survey District, to the southern corner of the land contained in Certificate of Title, Volume 279, folio 116 (Otago Registry); thence north-westerly along the south-western boundaries of that land and of the land shown on the plan numbered 5901, deposited as aforesaid; thence north-easterly along the north-western boundaries of the land shown on the last-mentioned plan and of the land contained in Certificates of Title, Volume 279, folio 116, Volume 252, folio 247, and again Volume 279, folio 116, all Otago Registry, to the Clutha River; thence down the right bank of that river to the boundary of the Borough of Balclutha, as described in the New Zealand Gazette of 1938, at page 489; thence south-westerly and south-easterly along that boundary to the right bank of the Clutha River (Koau Branch); thence down the right bank of that river to the point in line with the south-western boundary of Lot 24, Rosebank Estate, being the point of commencement.

Directing Sale of Railway Land at Whangarei under the Public Works Act, 1928

At the Government House at Wellington, this 8th day of October, 1947

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers and authorities conferred upon him by the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby direct the sale of the land described in the Schedule hereto, such land being no longer required for the public work for which it was taken.

SCHEDULE

APPROXIMATE area of the piece of land directed to be sold: 22·6 perches.

Being Lots 28 and 29 of Section 12 of a subdivision of part of Allotment 1 of the Parish of Whangarei, and being the whole of the land comprised and described in Certificate of Title, Volume 777, folio 280 (Auckland Land Registry).

Situated in Whangarei Borough.

Consenting to the Raising of a Loan of £5,500 by the Hawke's Bay Catchment Board and prescribing the Conditions thereof

At the Government House at Wellington, this 15th day of October, 1947

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS the Hawke's Bay Catchment Board (hereinafter called the said local authority) proposes, pursuant to the provisions of section thirty of the Soil Conservation and Rivers Control Act, 1941, to borrow the sum of five thousand five hundred pounds (£5,500) by a loan to be known as “Plant Loan, 1947” (hereinafter called the said loan), for the purpose of purchasing plant:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising by the said local authority of the said loan for the said purpose up to the amount of five thousand five hundred pounds (£5,500), and in giving such consent doth hereby determine as follows:—

(1) The term for which the said loan or any part thereof may be raised shall be eight (8) years.

(2) The rate of interest that may be paid in respect of the said loan or any part thereof shall be such as shall not produce to the lender a rate exceeding three pounds ten shillings (£3 10s.) per centum per annum.

(3) The said loan or any part thereof, together with interest thereon, shall be repaid by equal aggregate annual instalments extending over the term as determined in (1) above.

(4) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.
