The Servicemen’s Settlement and Land Sales Act, 1943.—Notice declaring Land taken for the Settlement of Discharged Servicemen

WHEREAS, pursuant to section 24 of the Servicemen’s Settlement and Land Sales Act, 1943, notice was given of the intention of the Minister of Lands to take under Part II of the said Act the lands described in the Schedule hereto, and a copy of the said notice was published in the New Zealand Gazette No. 40 on the 24th day of July, 1947, at page 912:

And whereas no objection was made in the manner prescribed by the said Act:

And whereas the said land is not the land of any serviceman who is for the time being serving outside New Zealand in any of His Majesty’s Forces or in any British ship:

Now, therefore, the Minister of Lands, acting in pursuance of section 27 of the said Act, doth hereby declare that the lands described in the said Schedule are taken for the settlement of discharged servicemen, and hereby specifies the 1st day of July, 1948, as the date on which the said lands shall be deemed to be vested in His Majesty the King.

SCHEDULE

AUCKLAND LAND DISTRICT

ALL that parcel of land situated in Blocks II and III, Te Atiamuri Survey District, containing by admeasurement one thousand and ninety-eight (1,098) acres, more or less, being Lots 1 and 2, Deposited Plan 15486, being parts of Whakamaru-Maungaiti No. 2 Block, and being all of the land described in certificate of title, Vol. 350, folio 285 (Auckland Registry).

As witness my hand, this 25th day of September, 1947.

By-laws regulating Traffic on the Oroua River Bridge, Rangiotu

IN pursuance and exercise of the powers conferred by section 9 of the Main Highways Act, 1922, and by section 155 of the Public Works Act, 1928, the Main Highways Board doth hereby make the following by-law in respect of the above-mentioned bridge, and doth hereby declare that the said by-law shall come into force on the 17th day of September, 1947.

BY-LAW

  1. THAT the Main Highways Board hereby gives notice that no person shall drive or take or permit to be driven or taken any vehicle upon or over the Oroua River Bridge at Rangiotu on the Palmerston North–Himitangi Main Highway at a greater speed than ten miles per hour or if the gross weight of the vehicle is in excess of 10 tons.

  2. (a) No person shall drive or cause or permit to be driven or allow any cattle in excess of forty at any given time to pass along or over the above-mentioned bridge.

(b) Cattle includes any bull, cow, ox, steer, heifer, or calf.

  1. (a) Every person who does or causes or procures to be done anything contrary to the terms of this by-law shall be guilty of an offence.

(b) Every person guilty of an offence against this by-law shall be liable to a fine not exceeding five pounds (£5) for each such offence.

The foregoing by-laws were made by a resolution duly passed at a meeting of the Main Highways Board held at Wellington on 17th September, 1947.

Price Order No. 770 (Amendment No. 4 of Price Order No. 658) (Main Crop Potatoes)

PURSUANT to the powers conferred on it by the Control of Prices Emergency Regulations 1939,* the Price Tribunal, acting with the authority of the Minister of Industries and Commerce, doth hereby make the following amending Price Order:—

  1. This Order may be cited as Price Order No. 770, and shall be read together with and deemed part of Price Order No. 658† (hereinafter referred to as the principal Order).

  2. This Order shall come into force on the 3rd day of October, 1947.

  3. (1) Price Order No. 753‡ is hereby revoked.

(2) The revocation of the said Order shall not affect the liability of any person for any offence in relation thereto committed before the coming into force of this Order.

APPLICATION OF THIS ORDER

  1. (1) This Order applies with respect to all potatoes which, being subject to the principal Order, are sold by a grower for delivery at any time after the commencement of this Order and on or before the 30th day of November, 1947.

(2) For the purposes of this Order no potatoes sold on the basis of f.o.b.s.i. or f.o.r.s.i. shall be deemed to be delivered to the purchaser after the commencement of this Order if—

(a) In the case of sales f.o.b.s.i. the vessel on which the potatoes are laden leaves the port of shipment at any time before midnight on the 2nd day of October, 1947; or

(b) In the case of sales f.o.r.s.i. the trucks on which the potatoes are laden leave the grower’s station at any time before midnight of the said date.

(3) Except as provided in the last preceding subclause, potatoes sold f.o.b.s.i. or f.o.r.s.i. shall be deemed to be delivered to the purchaser after the commencement of this Order notwithstanding that they may have been actually laden on board any vessel or trucks before the commencement of this Order.

MODIFICATION OF PRINCIPAL ORDER WITH RESPECT TO POTATOES THAT ARE SUBJECT TO THIS ORDER

  1. (1) Notwithstanding anything to the contrary in the principal Order the maximum price that may be charged by any grower for any potatoes to which this Order applies shall be determined in accordance with the following scale, namely:—

(a) For Sutton’s Supreme or King Edward potatoes grown in the South Island and sold for delivery—

Maximum Price per Ton f.o.b.s.i. a Port in the South Island. (f.a.q.). (Under-grade).

(b) For any other variety of potatoes grown in the South Island and sold for delivery—

(2) With respect to “tagged” potatoes the maximum price that may be charged by the grower shall be the price fixed in accordance with paragraph (c) of the last preceding subclause for f.a.q. potatoes, but may exceed such price by an amount not exceeding 10s. a ton in any case.
